Re: Violations of: 105 CMR 410. MGL Chapter II
Minimum Standards of Fitness for Human Habitation
Dwelling located at 126 Moody Street, North Andover, MA
Dear Mrs. Plano:
As a result of a complaint received by this Department an inspection was made of your
above captioned property on Tuesday, September 23, 1998, by myself along with Jack
Shotter of elder Services, and members of the North Andover Police and Fire
Departments. This inspection revealed conditions deemed to endanger or impair the
health, safety and well-being of a person occupying these premises, including, but not
limited to the following:
Section: 410.750 - a) Obstruction of exits and passageways due to excessive debris,
causing a potential hazard
b) Failure to comply with 410.602 (I). Maintenance of areas free
from garbage and rubbish which contribute to accidents and spread
of disease
As an Inspector for the Department of Public Health, and acting on behalf of the North
Andover Board of health, I hereby ORDER you as owner of this property, to see to it that
this dwelling is cleaned, sanitized, and the above noted violations are corrected to
this Department's satisfaction. (see attached order)
Furthermore as part of this ORDER, if compliance is not achieved in the allowed time
period, this dwelling shall be deemed uninhabitable. The dwelling will be condemned and
will not be occupied again until such time as the dwelling is inspected by this Department
and found to once again to be fit for human habitation in accordance with Chapter II of
the Massachusetts State Sanitary Code.

You are entitled to a hearing before the North Andover Board of Health if requested in
writing within seven(7) days of receipt of this ORDER. If you have any questions

VIOLATIONS TO BE CORRECTED NO LATER THAN FIVE (5) DAYS FROM
RECEIPT OF THIS ORDER LETTER:
VIOLATION REGULATION REINSPECTION
Exits obstructed by clutter and debris 410.750 (G)
■ All exits and travel ways throughout
the interior of the home must be free from clutter for
easy access. This includes the main
and lower level of the home. Non perishables
must be boxed, organized and stored so
as not to be a hazard.
All sinks rendered useless by excessive debris
and garbage build-up
■ All sinks and the bathroom tub must be free of all debris,
cleaned and sanitized
Bathroom not cleanable due to massive
quantities of debris piled up.
■ Must be cleared of debris, cleaned and sanitized
Kitchen not cleanable due to massive
quantities of debris
Multiple plates of cat food
found around the home
■ Designate one cat feeding area
and dispose of old plates of food
VIOLATIONS TO BE CORRECTED NO LATER THAN TEN (10) DAYS FROM
RECEIPT OF THIS ORDER LETTER:
Open food containers and piles of non opened 410.750 (1)
containers. Often many feet in depth and width.
■ Dispose of all open food which could
attract vermin and insects.
Non perishables must be boxed,
organized and stored so as not to be a hazard.
■ All potential hazards must be removed to the
satisfaction of the Board of Health Representative
