TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS May 23 , 1985 Mr. Daniel Long, Town Clerk Norwood, Malcolm Town Office Building 126-128 Main Street North Andover, MA 01845 Petition No. 19- 185 Dear Mr. Long : The Board of Appeals held a public hearing on Monday evening, -- April 8 , 1985 and continued to May 13, 1985 upon the application of Malcolm and Diane Norwood. The hearing w•-s' advertised in the North Andover Citizen on March 21 and 28 , 1915 and all abutters were notified by regular mail. The followinc, members were present and voting: Frank Serio, Jr. , Chairnan; Alfred E . Frizelle , Esq. , Vice Chairman; Augustine W. Iickerson , Clerk; William J. Sullivan; and Walter F. Soule. The petitioners seek a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 of the ZoningBy ,aw so as: to permit relief from the side setback requirement ,-o a. low the construction of a deck on premises located at 126-128 Main Lt:reet. Mr. Norwood, testifying on his own behalf, presented a plan showing the proposed deck on the second story of the building. The parcel is located next to the North Andover Fire Station and there is not ample land to meet the setback requirement. No objection was voiced at the hearing. Upon a motion made -by Mr. Frizelle and seconded by Mr. Nickerson , the Board voted unanimously to grant the variance as requested. In granting the variance , the Board finds that Section 10 . 4 of the Zoning By Law has been satisfied. , In particular; the Board finds that sufficient land is not available to the petitioner to meet the requirements of the By Law and that desirabl(- relief may be granted.
