The Board of Appeals held a meeting on Tuesday evening, December
14, 1993 upon the application of Nancy Melvin requesting a
variation of Section 7, Paragraph 7. 1 and 7.2, Table 2 of the
Zoning Bylaw so as to permit conveyance of a strip of land twenty
feet (201 ) wide on the Southerly side of the property at 127 High
Street to Ralph S. Wilde, the owner of the property at 119 High
Street. The following members were present and voting: Frank
Serio, Jr. , Chairman, William Sullivan, Vide-chairman, Walter
Soule, Clerk, Raymond Vivenzio and Robert Ford.
The hearing was advertised in the North Andover Citizen on
November 23 and December 1, 1993 and all abutters were notified
by regular mail. .
Upon a motion by Mr. Vivenzio and seconded by Mr. Ford, the Board
voted unanimously to GRANT the variance as requested.

Every application for action by the Board shall be made on a form
approved by the Board. These forms shall be furnished by the
Clerk upon request. Any communication purporting to be an
application shall be treated as mere notice of intention to seek
relief until such time as it is made on the official application
form. All information called for by the form shall be furnished
by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties of
Interest" which list shall include the petitioner, abutters,
owners of land directly opposite on nay public or private street
or way, and abutters to the abutters within three hundred feet
(3001 ) of the property line of the petitioner as they appear on
the most recent applicable tax list, notwithstanding that the
land of any such owner is located in another city or town, the
Planning Board of the city or town, and the Planning Board of
every abutting city or town.
*Every application shall be submitted with an application charge
cost in the amount of $25. 00. In addition, the petitioner shall
be responsible for any and all costs involved in bringing the
petition before the Board. Such costs shall include mailing and
publication, but are not necessarily limited to these.
Every application shall be submitted with a plan of land approved
by the Board. No petition will be brought before the Board
unless said plan has been submitted. Copies of the Board ' s
requirements regarding plans are attached hereto or are available
from the Board of Appeals upon request.

7 . Parties seek permission of the Board for conveyance of a strip
of land twenty feet wide on the southerly side of the Melvin
property at 127 High Street to Ralph S. Wilde, owner of the
property at 119 High Street. Melvin' s lot currently conforms to
all dimensional requriements of the Zoning By-Laws; Wilde ' s lot is
currently non-conforming.
If the variance is granted and the conveyance takes place,
Melvin' s resulting lot will still be conforming; Wilde ' s lot,
though it will have a larger area and more frontage than it
currently has, nevertheless , still will not conform.
ATTACHMENT N0. 2
Wilde currently has a lot properly laid out on a 1904 plan, which
lot has slightly more than half the area and slightly more than
half the frontage required in an R-4 District.
His neighbor has been gracious enough to offer to sell him Three
Thousand Six Hundred ( 3 , 600 ) square feet of land to add to his
lot.
The result, if allowed by the Board, would be a benefit to the
neighborhood . Melvin ' s lot will still conform. Wilde ' s lot will
be closer to conforming. The lots will be more balanced in size.
The neighborhood will see no detriment at all . There will be no
new building. Wilde is attempting to make his lot "more
conforming" . It would be a hardship to deny him this opportunity.
