The Board of Appeals held a regular meeting on Tuesday evening,
December 13 , 1994 upon the application of Gary Laurendeau
requesting a variation of Section 7 , Paragraph 7 . 3 and Table 2 of
the Zoning Bylaw law to allow construction of a deck which would
require ten feet of relief from the 30-foot rear setback on the
premises at 13 Belmont Street. The following members were
present and voting: Mr. Sullivan, Mr. Soule, Mr.Vivenzio, Mr.
Pallone and Mr. Karpinski.
The hearing was advertised in the North Andover Citizen on
November 23 and 30, 1994 and all abutters were notified by
regular mail .
Upon a motion by S. Karpinski and seconded by R. Vivenzio the
Board voted unanimously to GRANT the variance as requested as
shown on the plan with the condition that 6-foot high fencing or
shrubs be planted providing screening along Laurendeau' s property
line, whichever the homeowner prefers.
The Board finds that the petitioner has satisfied the provisions
of Section 10, Paragraph 10. 4 of the Zoning Bylaw and that this
variance may be granted without substantial detriment to the
public good and without nullifying or substantially derogating
from the intent or purpose of the Zoning Bylaw.

Whose property abuts 13 Belmont St. property, object to the
request of a variance to relieve ten ( 10 ) feet of the rear
setback, to allow a deck, which would require ten ( 10) feet
of relief from (30) feet requirement at 13 Belmont St.
We feel our privacy is being invaded.
This deck will be close to our back door, you can see right
in our kitchen and dinning room.
It will be in line of our sink and counter, with our back door
opened in the summer, they' ll be no privacy in our kitchen at all .
As it is , now, our view, the sun for our garden and our back yard
privacy, has been taken away by the house.
Couldn' t a smaller deck be considered or a variance for the other
side, Belmont side be granted, at least it wouldn' t be all in
our back yard.
As tax payers and abutters don' t we have any rights

The Board of Appeals held a regular meeting on Tuesday evening,
December 13 , 1994 upon the application of Gary Laurendeau
requesting a variation of Section 7, Paragraph 7 . 3 and Table 2 of
the Zoning Bylaw to allow construction of a deck which would
require ten feet of relief from the 30-foot rear setback on the
premises at 13 Belmont Street. The following members were
present and voting: Mr. Sullivan, Mr. Soule, Mr.Vivenzio, Mr.
Pallone and Mr. Karpinski.
The hearing was advertised in the North Andover Citizen on
November 23 and 30, 1994 and all abutters were notified by
regular mail.
Upon a motion by S. Karpinski and seconded by R. Vivenzio the
Board voted unanimously to GRANT the variance as requested as
shown on the plan with the condition that 6-foot high fencing or
shrubs be planted providing screening along Laurendeau' s property
line, whichever the homeowner prefers.
The Board finds that the petitioner has satisfied the provisions
of Section 10, Paragraph 10. 4 of the Zoning Bylaw and that this
variance may be granted without substantial detriment to the
public good and without nullifying or substantially derogating
from the intent or purpose of the Zoning Bylaw.

relief until such time as it is made on the official application
