Francis Gucciardi requesting a variance from the requirements of Section 7 , Paragraph 7 . 1 , 7 . 2 , 713 and Table 2 of the Zoning ByLaWS sp as to permit division of property into two (2 ) lots having less than the required frontage and area . . The follow- ing members were present and voting : Alfred Frizelle , Vice-chair- man, Augustine Nickerson , Clerk , William Sullivan , Walter Soule and Raymond. y.ivenz.iA .: :�:. The hearing waS., adgertiSed in the North Andover Citizen on September 25 , 1986 and QctOlier. 2 , 1986 and all abutters were notified by regular' mail . Upon a motion made, by Raymond Vivenz•io and seconded by William Sullivan , the Board Voted unanimously to GRANT the variances as requested subject !to the following conditions : 1 .. The . existing garage shall be razed prior to a Building Permit being issued for construction of a single family , dwelling. 2 . , Only a sipgle family dwelling shall be constructed on Loi #l. l 3 . :The plans.' shall -bit revised showing a single family in " accordance with the decision and be presented to the Board within 15 days from the date this decision is filed with the Town Clerk . The Board finds, that due to the size and shape .of :the lot in question , a subs tantial' hardship exists and that granting the variance will not derogate from the intent and purposes of the Zoning Bylaws nor adverse- ly affect the neighborhood. Seller will maintain and insure the remaining garage stall . 3 . Buyer shall give Seller a deeded recordable life tenanc•- lease for the portio. of land or which th-e remaining Qarage encroaches on to Lot #1. Said lease shall be given at closing and shall be held in escrow by Buyer ' s attorney until Seller obtains a determination from the town as to whether said remaining garage can remain on Lots 1 & 2 or whether said garage must be raze in order for Buyer to obtain a building permit for Lot X61 . In the event that the town determines the garage must be razed, the escrow agent shall destroy said lease , and no lease will be given. If the town determines it is : unnecessary for the garage to be razed, then, upon obtaining such determination, the escrow agent shall record said easement at the proper Registry of Deeds . In any event , Seller shall obtain the decision from the town on or before April 1 , 1987 . If Seller fails to obtain same by April 1 , 1987 , Seller will raze remaining garage at her sole expense. This strip of land shall only be used to house the existing garage and shall not be used for any other purposes during the life of this lease.
