Failure to Obtain a Building Permit:
Please be advised your Massachusetts State Building code 7b addition780 CMR,requires all homeowner
obtain a building permit prior to altering an existing structure(garage addition). As requested in April and
again Yesterday, June 19th the Building Department is requiring you to obtain a Certified Plot Plan of the
illegally constructed structure and immediately file for a building permit. After reviewing your building
File it is also apparent there may have been numerous other alterations to the main building structure
without obtaining proper building permits, The town of North Andover will give you 30 Days from the
receipt of the letter to obtain a Certified Plot Plan and submit a permit application
780 CMR 5110 Permit Application. It shall be unlawful to construct,reconstruct, alter,repair, remove
or Demolish a detached one and two family dwelling; or to install or alter any equipment for which a
provision is made or the installation of which is regulated by 780CMR 51.0-99.00 without first filing a
written application with the Building Official and obtaining the required building permits therefore.
780 CMR 5118.0 Violations
5118.4 Violation Penalties: Whoever violates any provision of 780 CMR shall punishable by a fine of not
more than$1000 per day for each such violation.
Your Failure to fully comply with this Notice of Violation letter will result in my filing an
application for criminal complaint against you in District Court with possible fines of$1000 (sec.10.13)
for each day during which violation continues to exist.
Ample time has been given to address the issues stated. To date,no formal action has been by
taken by you to correct these violations. Please contact the Building Inspection Office about these issues
and violations.
