The following members were present and voting: Frank Serio, Jr. , Chairman, William Sullivan, Vice-chairman, Walter Soule, Clerk and John Pallone. The hearing was advertised in the North Andover Citizen on April 21 and 28, 1993 and all abutters were noti-4ied by regular mail. Upon a motion by Mr. Sullivan and seconded by Mr. Pallone, the Board voted to allow the petitioner to WITHDRAW WITHOUT PREJUDICE. The vote was unanimous. Dated this 19th day of May 1993 . You will see from the enclosed plan which we had prepared by a professional land surveyor that our property extends by 30 . 9 feet from our foundation to the beginning of your property (Lot #18 ) . Your plans are premised on this measure- ment being only 25 feet, nearly 6 feet less than what it actually is . Thus, we view the variance you seek as a serious encroachment on our rights as property owners. Any communication purporting to be an application shall be treated as mere notice of intention to seek relief until such time as it is made on the official application form. All information called for by the form shall be furnished by the applicant in the manner therein prescribed.
