about the amount of the DPW permit fee to tie-in to the sewer. The amount of
Health the permit fee for municipal sewer tie-in is set by the Board of Selectmen. The
Department Board of Health has no part in the decision and has never been asked for input on

this decision. I can understand your reservations, but, unfortunately, the Board
of Health can do nothing to change the fee structure set by the Board of
Public Health Selectmen. They are two separate issues.

A letter was sent to the Board of Selectmen from the Board of Health after the
previous sewer tie-in meeting that you attended. To date there has been no
Planning
Department response. I suggest that you contact the Board of Selectmen concerning the tie-in
(978)688-9535 fee, The Board of Health must still require that you tie-in to the municipal sewer
solely for public health reasons. The Board wishes you luck in your endeavors
concerning the tie-in fee. Please feel free to call the office with any technical
questions you may have.

Three years ago I appeared before the Board on Health at an open meeting along with
other homeowners. I was given the opportunity to speak. I informed the board of health
that I was quite willing to tie my property to the sewer line on Appleton St. I did have a
question about the permits and fees. I was informed by the Department of Public Works
that there is a fee of One Thousand Dollars to obtain a permit. I felt then, as I do now
that that fee was exorbitant compared to the fees other towns charge. I asked that
because we homeowners are being forced buy the Board of Health to tie in, that the,fee be
waived(You actually get nothing of value for the fee). In fact, because of your ruling, my
water/sewer bill will at least double. At that time the Board was unaware of the cost of the
fee and the chairman stated that he would take this under advisement. I called a month
later and was informed of no movement on this issue. The only correspondence I have
received about this issue was your demanding letter on March 24.
I have been a good citizen of this town for 12 years. I am very sensitive to the needs of
the North Andover water supply and groundwater. As I was three years ago, I am ready
to pay a contractor to tie my septic into the existing sewer line. I wish the previous house
owner tied in when he had the chance to do it for One Hundred dollars. What I take issue
with is the permit fee. Being forced to spend One Thousand Dollars for nothing is not
fair. How much does it cost to generate the paper work? Twenty-five, fifty dollars? I'll
gladly pay that. The town should dispense with the exorbitant fee when tax-paying citizens
are being forced to tie in. I look forward to hearing from you on how best we can resolve
this issue.

Dear Mr. &Mrs. Burns:
The Health Department has been supplied with a list of all residences, currently on septic,
which have access to the municipal sewer system. As previously published at a Public
Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the
required sewer tie-in. The following timetable concerning your property status was
adopted:
4.1 All establishments that currently do not have municipal sewer available
to them must connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water, surface
waters, groundwater and surrounding environment. Sanitary sewer is believed to be the
most effective form of wastewater treatment. A copy of the entire regulation can be
obtained at our office.
Your property is in violation of this Board of Health regulation. Please contact the Health
Department regarding this matter immediately. If we do not hear from you by May 10,
2000 your name will be placed on the regularly scheduled Board of Health meeting agenda
and placed on public notice. The meeting will be held on May 25, 2000 for discussion of
legal action including court hearings.
