Manzi * Petition #88-89 Lot 426 Coventry Lane N. Andover, MA 01845 * AMENDED DECISION The Board of Appeals held a public hearing on Tuesday evening, January 9, 1990 and a meeting for discussion on February 13, 1990 upon the application of Harry J. Manzi requesting a Special Permit from the requirements of Section 5.5, Paragraph 2 of the Zoning Bylaw so as to permit removal of 19,000 cu. yds. of earth off Lot 26 Coventry Lane in order to put in foundation and driveway and grade to 2-1slope. The following members were present and voting at the January 9th meeting: William Sullivan, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio and Louis Rissin. The following members were present and voting at the February 13th meeting: Frank Serio, Jr. , Chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on November 22, 1989 and November 30, 1989 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the Special Permit as requested subject to the following conditions: 1. All erosion controls shall be in place on-site and off-site and approved, by the Building Inspector prior to any earth removal from Lot 26 Coventry Lane. 2. Daily street cleaning where necessary. 3. Information reports to Building Inspector as to where the fill is going, in advance of removal. 4. Post a $2,000 bond for Lot 26 with the Town Treasurer for street cleaning on Coventry Lane, and on-site restoration. 5. All work to be completed within 90 days of the issuance of permit by Building Inspector. 6. At your request, I have reviewed the decisions rendered by your board for lots 25 and 26 of Coventry Estates. In order for your board to use the $2, 000. 00 posted on each lot you would be required to make a favorable vote of at least four members at a regularly scheduled public hearing. The seizing of a bond does not. have to be published. After that vote is taken a certified letter should be sent to the bank demanding release of the funds. Further, the applicant should be notified by certified mail that this action has been taken due to their failure to perform as outlined in the Special Permit issued by your board. I would recommend that any motion made to seize a bond include specific reasons why this action is being taken and that those reasons become part of the public record. The work on these two lots, as well as many others in the subdivision, has been poorly managed for some time. Soil erosion and siltation continues to wash down the street, clogging catch basins and undermining the roadway and driveways. In the interest of public health and safety, I hereby recommend that you contact those individuals holding the earth removal permit and begin the procedure to seize the bond. We understand �t at the Town of North Andover has given them until June 14 to complete all site work on lots 25 and 26. They and their site excavator, Mr. Robert Slombo, have been working very hard since February 1990 to complete this work, and they have also been very co- operative with all of the residents. We feel that the June deadline has become unrealistic due to the unusual weather conditions everyone has had to endure, this has been the wettest spring in many years. Manzi requesting a variation from the require- ments of Section 7, Paragraph 7.4 and Table 2 of the Zoning Bylaw so as to permit construction of a dwelling whose height exceeds the 35' bylaw limitation on the premises located at 136 Coventry Lane. The following members were present and voting: Frank Serio, Jr. , Chairman, William Sullivan, Viec-chairman, Augustine Nickerson, Clerk Walter Soule and Raymond Vivenzio. The hearing was advertised in the Lawrence Tribune on March 28 and March 29, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board, voted, unanimously, to GRANT the variance as requested. The location of buildings or use of the property where a variance is 3 requested and distances from adjacent buildings and property lines shall be verified in the field and shown on the plan. rhe 1 dimensions of the Lot and the percentage of the lot covered by the principal and accessory buildings and the required parking spaces shall be shown. Entrances, exits, driveways, etc. that are pertinent to the granting of the variance shall be shown. All proposed data shall be shown in red. Any topographical feature of the parcel of land relied upon for a j variance, such as ledge, rock peat, or natural condition of water, i brook, or river, shall be shown on the engineering plan. When a variance is requested to subdivide a parcel of land, the dimen - si'ons and area of the surrounding lots may be taken from the deed or lotting plan for comparison of the size of the lots in the neighborhood, noted on the plan as such, and marked "approximate" . The plan shall be signed and bear the seal of a registered surveyor or engineer. Any plans presented with the petition shall. remain a part of the records of the Board of Appeals. if Living quarters are to be remodeled, or areas are to be converted into living quarters, in addition to the plot plan, five (5) copies of the following described plans shall be furnished: 1. A floor plan of each floor on which remodeling is to be clone or areas converted into living quarters; 2. A floor plan showing the stairways, Balis, doors opening into the halls, and exit doors of each fLoor or floors where no re- modeling converting is to be done; or o 9 • . ' 3.
