* AMENDED DECISION
The Board of Appeals held a public hearing on Tuesday evening, January 9, 1990 and a
meeting for discussion on February 13, 1990 upon the application of Harry J. Manzi
requesting a Special Permit from the requirements of Section 5.5, Paragraph 2 of the
Zoning Bylaw so as to permit removal of 19,000 cu. yds. of earth off Lot 26 Coventry Lane in
order to put in foundation and driveway and grade to 2-1slope. The following members were
present and voting at the January 9th meeting: William Sullivan, Vice-chairman,
Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio and Louis Rissin. The
following members were present and voting at the February 13th meeting: Frank Serio, Jr. ,
Chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on November 22, 1989 and
November 30, 1989 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously,
to GRANT the Special Permit as requested subject to the following conditions:
1. All erosion controls shall be in place on-site and off-site and
approved, by the Building Inspector prior to any earth removal
from Lot 26 Coventry Lane.
2. Daily street cleaning where necessary.
3. Information reports to Building Inspector as to where the fill
is going, in advance of removal.
4. Post a $2,000 bond for Lot 26 with the Town Treasurer for
street cleaning on Coventry Lane, and on-site restoration.
5. All work to be completed within 90 days of the issuance of
permit by Building Inspector.
6. All work to be performed according to Section 5, Paragraph 5.8(2) (4) (5) (7) .

RE: Procedure for taking bond money.
At your request, I have reviewed the decisions rendered by your
board for lots 25 and 26 of Coventry Estates.
In order for your board to use the $2, 000. 00 posted on each lot
you would be required to make a favorable vote of at least four
members at a regularly scheduled public hearing. The seizing of a
bond does not. have to be published.
After that vote is taken a certified letter should be sent to the
bank demanding release of the funds. Further, the applicant
should be notified by certified mail that this action has been
taken due to their failure to perform as outlined in the Special
Permit issued by your board.
I would recommend that any motion made to seize a bond include
specific reasons why this action is being taken and that those
reasons become part of the public record. I hope this answers any
questions you may have on procedure, please feel free to contact
my office with any further questions or concerns.

I have recently inspected the condition of Lots 25 and 26
Coventry Estates as part of a general inspection of the entire
subdivision. The work on these two lots, as well as many others
in the subdivision, has been poorly managed for some time. Soil
erosion and siltation continues to wash down the street, clogging
catch basins and undermining the roadway and driveways.
In the interest of public health and safety, I hereby
recommend that you contact those individuals holding the earth
removal permit and begin the procedure to seize the bond. Please
contact the Town Planner if you have any questions regarding the
procedure as the Planning Board has been through this process.

Dear Members,
Please consider this a request for an extension of a Special Permit for excavation
issued by the Town and approved by the Board on February 13, 1990.
This permit was issued for the excavation of land .at 136 Coventry Lane for the
purpose of building a personal residence. Due to extreme circumstances and the
weather, the completion of this excavation will not be accomplished by the
May 14th deadline.
Thus I am requesting that an extension be granted for this work referenced by
condition 5 of the Board's decision.
I want to take this time to thank you all for your recent decisions on my behalf.
Hopefully, one of these days I will be able to say that I AM a North A?:dover

The Board of Appeals held a regular meeting on Tuesday evening, June 12,
1990 upon you request for an extension of your Special Permit for earth

Upon a motion made by Ms. O'Connor and seconded by Mr. Sullivan, the

Dear Memberf,
We the undegsigned, all residents of Coventry Estates, Coventry Lane, North
Andover; Massachusetts, wish to voice our support for Mr. & Mrs. Dennis Cote
and Mr. HarManzi, currently building on lots 25 and 26 respectively. We
understand �t at the Town of North Andover has given them until June 14 to
complete all site work on lots 25 and 26.
They and their site excavator, Mr. Robert Slombo, have been working very hard
since February 1990 to complete this work, and they have also been very co-
operative with all of the residents. We feel that the June deadline has
become unrealistic due to the unusual weather conditions everyone has had to
endure, this has been the wettest spring in many years. Work on these lots
has been drastically delayed because of the rain.
We would like to see these houses completed as they will add to our neighbor-

'adequately maintained. I hope_ the. Zoning Board of Appeals will

2 . Sideri Watershed Variance
The Conservation Commission has visited the site and confirmed
the wetland line. We hope to close the public hearing on this
application pp on May 2, 1990. I must express some concerns
regarding the grounds for granting a variance from this section
of the zoning bylaw. According to the Zoning Bylaw, a variance
can only be granted based on soil, shape or topography of the
land. The Zoning Board of Appeals should clarify with 'Town
Counsel the meaning of the phrase "shape . . . of the land" before
granting this variance.
3 . Gilbert Variance
The plan submitted shows frontage that may be unusable by
Conservation Commission standards. These lots may need to be
redrawn. The applicant should make every attempt to provide
upland access to new lots and not cross wetlands with several
driveways.

Mr. Harry Manzi applied to the Building Dept for a
permit to build a single family dwelling on lot 26 Coventry
Lane. Upon reviewing the plans Mr. Manzi supplied to the office,

I discovered the house was too high according to the North
Andover Zoning Bylaws. The plans show the house to be
approximately 39 feet, measured from the peak of the roof to the
finished grade on tho east side of the house.
This house has a garage under which lowors the grade
considerably; however, ether people have came into the office
with the same problem and they have modified their plans to con-
form to the Zoning bylaws.
Please referance Section 7, Paragraph 7. 41 Table B, and
also Section e, Paragraph S. 27 under Definitions of the North
Andover Zoning Bylaws.

The Board of Appeals held a public hearing on Tuesday evening, April 10, 1990
upon the application of Harry J. Manzi requesting a variation from the require-
ments of Section 7, Paragraph 7.4 and Table 2 of the Zoning Bylaw so as to
permit construction of a dwelling whose height exceeds the 35' bylaw limitation
on the premises located at 136 Coventry Lane. The following members were present
and voting: Frank Serio, Jr. , Chairman, William Sullivan, Viec-chairman,
Augustine Nickerson, Clerk Walter
Soule and Raymond Vivenzio.
The hearing was advertised in the Lawrence Tribune on March 28 and March 29,
1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board,
voted, unanimously, to GRANT the variance as requested.
The Board finds that the petitioner has satisfied the provision of Section 10,
Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance will
not derogate from the intent and purposes of the Zoning Bylaw nor will it
adversely affect the neighborhood.

Each application and petition to the Board shall be accompanied by
five (5) copies of the following described plan:
The size of the ,plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet; it shall have a north point, names of streets,
!' zoning districts, names and addresses of owners of properties
i within a minimum of 200 feet of the subject property, property
1 lines and location of buildings on surrounding properties. The
location of buildings or use of the property where a variance is
3 requested and distances from adjacent buildings and property lines
shall be verified in the field and shown on the plan. rhe
1 dimensions of the Lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances, exits, driveways, etc. that are
pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red.
Any topographical feature of the parcel of land relied upon for a
j variance, such as ledge, rock peat, or natural condition of water,
i brook, or river, shall be shown on the engineering plan. When a
variance is requested to subdivide a parcel of land, the dimen

si'ons and area of the surrounding lots may be taken from the deed
or lotting plan for comparison of the size of the lots in the
neighborhood, noted on the plan as such, and marked "approximate" .
The plan shall be signed and bear the seal of a registered
surveyor or engineer. Any plans presented with the petition shall.
remain a part of the records of the Board of Appeals.
if Living quarters are to be remodeled, or areas are to be
converted into living quarters, in addition to the plot plan, five
(5) copies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be clone
or areas converted into living quarters;
