Response: As noted above,the proposed three-family dwelling use significantly furthers the Towns interest to diversify its housing stock by creating dwelling uses which represent a more affordable alternative to the dominant single family housing use within the Town. As a result,the proposed use will help to fill a use with a significant market demand for veterans housing within the Downtown area,close to an employment center and commercial uses,both in close proximity to transportation alternatives. 3.The degree to which the application addresses the following design standards: i. Achieve compatibility with the established pattern of uses in the district. The Residential 4 District consists primarily of single-family dwellings near the Stevens Memorial Library Area and off of Massachusetts Avenue,and more compact neighborhoods with a mix of residential uses toward Waverly Road. New construction or substantial alteration of buildings must compliment and reinforce the design features of these neighborhoods. Response: The proposed building design is reflective of the design of residential dwellings within the residential neighborhood which consists of both single family and multi-family dwellings. The proposed building design compliments and reinforces the design features of this neighborhood. ii. Achieve design compatibility with architectural features and exterior materials of surrounding structures. Response: As depicted on the architectural plans,the building is compatible with the architectural features and exterior materials of surrounding structures. iii. Preserve existing structures of historic value. Buildings,dwellings or structures listed on the National Register of Historic Places or the State Register,and are more than 50 years old as of the date of application for a special permit,may be converted,constructed,reconstructed,restored or altered only in a manner that maintains or promotes their status as listed or eligible historic resources. For purposes of zoning compliance,additions or alterations that adhere to the U.S.Secretary of the Interior's Standards for the Treatment of Historic Properties will generally be presumed to maintain or promote such status. Response: The proposed building design is consistent with the character and design of other residential dwellings within the neighborhood. (Multi-Family Dwelling Special Permit Memorandum -- Zoning Board of Appeals) 3 iv. Preserve established,mature vegetation. Response: To the extent practicable,the Project is integrated into the existing layout of the lot,except that the addition and parking areas will be added to the Property. As a part of the Property layout,a number of measures were incorporated to preserve established vegetation,including: (a) the reduction in pavement along the frontage of the Property;and, (b)although the parking areas to the rear of the lot will be expanded,the existing tree line to the rear of the Property will be preserved to the extent practicable to create a buffer to the surrounding residential uses,thus maintaining the natural vegetative cover surrounding the perimeter of the Property. For these reasons,the Applicant has demonstrated that the Application complies with the purposes of this Zoning Bylaw,and is consistent with the use of the site for the purpose permitted within the Residential 4 District. B. MULTI-FAMILY DWELLING SPECIAL PERMIT STANDARDS ,(Section 10.31) Sections 10.3 and 10.31 of the Zoning Bylaw provides that the Zoning Board of Appeals shall not approve any such application for a Special Permit unless it finds that in its judgment all the following conditions are met. The following lists the criteria and how these criteria are met. a. The specific site is an appropriate location for such a use,structure or condition. Response:As the property is zoned for residential use(R4),and that the majority of dwellings within the vicinity of the Property are a mix of single family,two-family,and multi-family dwellings,the site is an appropriate location for the proposed Project. The site layout compliments the surrounding uses and provides for access,as well as for sufficient water and other utilities. b. The use as developed will not adversely affect the neighborhood character. Response:The Project has been previously reviewed as a part of the Community Preservation Act review process,and the lot area will be in excess of minimum requirements,and the proposed addition to the {Multi-Family Dwelling Special Permit Memorandum -- Zoning Board of Appeals) 4 t existing building will be constructed in a manner consistent with surrounding residential uses. Accordingly,the proposed uses are well suited for its proposed location. C. Social,economic,or community needs which are served by the proposal. Response:As noted above,the proposed Project will provide for additional housing opportunities in an established residential neighborhood and at a density which is consistent with the surrounding residential neighborhood. d. There will be no nuisance or serious hazard to vehicles or pedestrians. Response:Driveways have been located to provide for the best available sight distance along High Street,and site distances,lot layouts and other design features are consistent with other residences within the neighborhood and present no hazard to vehicles and pedestrians. e. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Response:The project is adequately and appropriately serviced by municipal water,sewer and other utilities that adequately address the needs of the Project. f. The use is in harmony with the general purpose and intent of this Zoning Bylaw. Response:The development of a three-family dwelling on this lot is in harmony with the general purpose and intent of this bylaw,for the following reasons. First,the conversion of the existing building for multi- family use is appropriate as the Property is surrounded by other residential lots having much less lot area. Second,the conversion of the Property to multi-family use will have the effect of converting the vacant site into new residential uses which fit in with the neighborhood which consists of both multi-family and single family buildings. Lastly, the Property, as shown on the Site Plans,complies with the Zoning By-Law. For these reasons,the proposed improvements noted herein are in harmony with the general purposes and intent of Section 1 {"Purposes'} of the North Andover Zoning Bylaw. V. REQUEST FOR APPROVAL For the above reasons, the Applicant has demonstrated that the Application complies with the purposes of this Zoning Bylaw, and is consistent with the use of the {Multi-Family Dwelling Special Permit Memorandum -- Zoning Board of Appeals} 5 site for the purpose permitted within the Residential 4 District. As a brief overview, this is a project that will be funded almost exclusively by CPA funds which were approved by vote of town meeting,the board of selectmen and the finance committee (as well as the CPC).The town's attorney and counsel for Veterans Northeast Outreach are working on all of the necessary documents which should be approved at the September 9t"selectmen's meeting. The project proposed is a three unit rehab expansion to the existing two family home. The open area to the left of the existing house is not to be used for an additional home or further expansion beyond three units. Although the documents are in draft form the following is undisputed language contained within the Declaration of Restriction that will be executed by the parties: "1. Prohibited Acts and Uses. The Declarant hereby imposes the following restrictions on the Property: The Declarant acknowledges and agrees that the Property shall not be further subdivided nor shall the Property contain more than three (3) units of housing in one residential structure. I attended the two CPC meetings regarding this project and all of the residents in attendance (approximately 10-12) supported funding for the project assuming there would be no more than 3 units and that the green space to the left would not constructed upon.
