SSACHW` TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Josephine Cristaldi Petition: #101-89 14 Appleton St. N. Andover, MA 01845 DECISION The Board of Appeals held a public hearing on Tuesday evening, March 13, 1990 upon the application of Josephine Cristaldi requesting a variation from the requirements of Section 2, Paragraph 2.37.1 and a Special Permit of Seciton 4.121(17) of the Zoning Bylaws so as to permit construction of a family suite larger than allowed by the bylaw on the premises located at 14 Appleton Street. The following members were present and voting: Frank Serio, Jr. , Chairman, William Sullivan, Vice- chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on February 22, 1990 and March 1, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Sullivan, the Board voted, unanimously, to GRANT the variance and Special Permit as requested, subject to the following conditions: 1. The premises be occupied by Mr. & Mrs. Cristaldi. 2. The Special Permit shall expire at the time Mr. & Mrs. Cristaldi cease to occupy the family suite. 3. The Special Permit shall expire at the time the premises are conveyed to any person, partnership or corporation. 4. The applicant, by acceptance of the Certificate of Occupancy issued pursuant to the Special Permit, grants to the Building Inspector or his lawful designee the right to inspect the premises annually. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 and 10.4 of the Zoning By-law and the granting of this variance and Special Permit will not derogate from the intent and purpose of the Zoning Bylaw nor will it adversely affect the neighborhood.
