RE: VIOLATION NOTICE and subsequent site inspection at 14 Chickering
Road,North Andover, MA.
Dear Sir:
Per our discussion on Thursday August 31, 1995 and after an inspection of the above
. referenced premises a Violation Notice has been issued to the property owner of record,
Mrs. Mary Burke. A Violation Notice was hand delivered to you during the time of
inspection (enclosed is a second copy for your records).
Violations observed on the property include the following:
• alteration of the Buffer Zone of a Bordering Vegetated Wetland (BVW). This
resource area bordered on a potential intermittent stream and along the northern
portion of the property where the topography slopes downward;
• alteration of a BVW (confirmed through soils analysis).
As we discussed, the following restrictions and/or conditions limiting future work on the
property have been established for those portions subject to the jurisdiction of the North
Andover Conservation Commission (NACC):
1. The potential intermittent stream shall be free of fallen vegetation (i.e. sumac) along
the headwall. Removal of vegetation shall be by hand only and without machinery;
2. It is the opinion of this Department that restoration of the BVW Buffer Zone or the
BVW itself is not warranted as vegetative species observed on-site will regenerate
quickly. Existing grade changes or filling of wetland resource areas was not observed.
It is also the opinion of this Department that the ability of on-site wetlands to function
• as defined in the Act and local ByLaw has not been impaired as a result of cutting
practices;

• 3. Future clearing of the field is allowed up to the potential intermittent stream along the
western side but machinery is not permitted to cross it nor is alteration of vegetation
along the bank permitted;
4. No alteration of any kind is permitted on the eastern side of the potential intermittent
stream;
5. Access to the field is permitted off of Cotuit Street along the northwest portion. This
area is to be utilized for access only and those locations as shown in the field are not to
be altered;
6. Additional clearing is allowed along the northern side where access is permitted
through the Heritage Green apartment complex. Clearing is only allowed up to the
existing apple tree as shown in the field.
Future work on the property which is subject to NACC jurisdiction(limit of work within
100' of any wetland resource area)will require the filing of a Notice of Intent or Request
for Determination of Applicability. The conditions set forth within the context of this
letter are binding, however, the NACC reserves the right to revise or disagree with this
Department's recommendations. A wetland delineation was neither confirmed or denied
by this Department at the time of inspection as a formal request for such an action has not
been filed with the NACC. The potential for an intermittent stream and adjacent BVW
was noted.

RE: Violation of the Wetlands Protection Act(M.G.L. c.131 s.40) and
Town of North Andover Wetland ByLaw (Ch. 178 of the Code of N. Andover) at
#14 Chickering Road.
Dear Mrs. Burke:
Visual inspection of the above referenced property location from Chickering Road on August 28,
1995 revealed potential violations of the Massachusetts Wetlands Protection Act and local
wetland ByLaw. Any activity proposed or undertaken within an area specified in the Act (3 10
CMR 10.02)(1)(a) which will remove, fill, dredge or alter that area is subject to regulation under
M.G.L. c.131 SAO and requires the filing of a Notice of Intent with the Conservation
Commission.
Furthermore, any activity proposed or undertaken within 100' of an area specified in 310 CMR
10.02 (1)(a) (hereinafter called the Buffer Zone) which in the judgment of the issuing authority,
will alter an Area Subject to Protection under M.G.L. c.131 s.40 is subject to regulation and also
requires the filing of a Request for Determination and/or a Notice of Intent.
It is the opinion of this Department that an unknown square footage of Bordering Vegetated
Wetland (BVW), Bank and Intermittent Stream, as defined by the above referenced regulations,
was potentially altered. Alteration appears to be limited to clearing but further inspection is
warranted. Upon receipt of this document please promptly call this office so that we can schedule
a site visit and evaluate the condition of the site.
