The Board of Appeals held a regular meeting on Tuesday evening,
September 10 1996 upon the petition of Son/Sun Trust & Jeanne Woelfel
requesting a variance from the requirements of Section 8, Paragraph 8. 1
(7) for the purpose of off Street parking and for a Special Permit
under Section 4, Paragraph 4. 11 (3) Zoning By Laws for the purpose of
having the zoning boundary line moved in order that all buildings on the
lot will be in a general buisness district presently in the GB/IS Zoning
District.
The following members were present and voting: William Sullivan, Walter
Soule, Raymond Vivenzio, John Pallone, and Ellen McIntyre.
The hearing was advertised in the North Andover Citizen on 8.27.96 &
9.3. 96 and all abutters were notified my regular mail.
Upon a motion by John Pallone, seconded by Ellen McIntyre, the Board
voted to accept a letter to withdraw the variance pursuant to Section 8,
Paragraph 8 . 1 (7) without prejudice from off street parking and to GRANT
the Special Permit as requested to move a zoning district boundry line
to the General Business District. Voting members in favor of the
petition were: William Sullivan, Walter Soule, John Pallone, and Ellen
McIntyre.
Note: The granting of the Variance and/or Special Permit as requested by
the applicant does not necessarily ensure the granting of a Building
permit as the applicant must abide by all applicable local, state and
federal building codes and regulations, prior to the issuance of a
building permit as required by the Building Commissioner.

The Board of Appeals held a public hearing on Tuesday evening, June 14, 1988 upon
the application of Dilip K. Mukerjee, MD requesting a variation from the require-
ments of Section 4, Paragraph 4.11(3) of the Zoning Bylaws so as to permit chang-
ing zoning from Industrial to General on the premises located at 14 Main Street,
stone building in rear. The following members were present and voting: Frank
Serio, Jr. Chairman, Augustine Nickerson, Clerk, William Sullivan, Walter Soule,
and Lou Rissin.
The hearing was advertised in the North Andover Citizen on May .26 and June 2, 1988
and all. abutters were notified by regular mail.
Upon a motion made by Mr. Rissin and seconded by Mr. Sullivan, the Board VOTED,
unanimously, to allow the petitioner to WITHDRAW WITHOUT PREJUDICE as requested.

RE: Section 4 . 11 (3) Moving Zoning Line
14 Main Street
Staff recommends that the Board not take action on this matter
due to a deficient legal notice advertised in the Citizen. While the
section of the zoning bylaw cited is correct , the test that a citizen of
the Town can reasonably determine what action is contemplated by the
application of Mr . Mukerjee cannot be met by the notice as printed .
The Board is moving a zoning line by special permit as outlined
in Section 4. 11 (3 ) and is not rezoning the property. if the Board still
wishes to conduct the hearing at the very least , staff recommends that
Board request a legal opinion from Town Counsel as to the adequacy of
the notice.
Staff also requests that a survey of the property be submitted
which shows the existing location of the zoning line and its proposed
location by action of the Board .

DECISION
The Board of Appeals held a public hearing on Tuesday evening, August 9, 1988 and
a Special meeting on August 22, 1988 upon the application of Dilip K. Mukerjee,

Zoning Bylaw in order to move a zoning district line which divides a lot of record
up to 100' . The lot of record is location at 14 Main St. and shown on Assessor
Map 29, parcel 8. The existing location of the zoning line is 165' from the
center line of Main St. The application under this application wishes to move
the line in order to correspond to the rear property line of the lot described,
The current zoning of the lot is General Business(GB) and Industrial-S(IS) . The
following members were present and voting: William Sullivan, Acting Chairman,
Augustine Nickerson, Clerk, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on July 14 and July 21,
1988 and all abutters were notified by regular mail.
Upon a motion made by Ms. O'Connor and seconded by Mr. Nickerson, the Board
voted, unanimously, to GRANT the Special Permit as requested, subject to the
condition that the petitioner present revised plans to the Town Planner showing
the curb cuts on Main Street and parking, and that this revised plot plan be
complete prior to our next regular meeting.
The Board finds that the petitioner has satisfied the provision of Section 10,
Paragraph 10.3 and 10.31 of the Zoning ByLaws and the granting of this Special Permit
will not derogate from the intent and purposes of the Zoning ByLaws nor will
it adversely affect the neighborhood.

DECISION

14 Main Street Special Permit
Staff has reviewed this application and has found that the zoning
line appears to run through the existing stone structure.
Staff would like to see a plot plan for Lot 8 , which shows the
existing structures , parking spaces and curb cuts located on Main Street.
We have also observed traffic conflicts with vehicles turning off
Main Street into this lot which conflicts with traffic turning off
Sutton Street onto Main Street. The proximity to the one curb cut
on this lot and a curb cut which serves Community Savings is also
a dangerous situation.
Staff requests that a plot plan be submitted prior to the Board
acting on this application in order to address the concerns outlined
above.

SECTION 4 BUILDINGS AND USES PERMITTED
4. 1 District Use Regulations
4.11 General Provisions
(1) In the zoning districts above specified, the
following designated buildings and alterations
and extensions thereof and buildings accessory
thereto and the following designated uses of
land, buildings, or parts thereof and uses
accessory thereto are permitted. All other
buildings and uses are hereby expressly pro-
hibited except uses which are similar in
character to the permitted uses shall be treated
as requiring a Special Permit (1985/26 ) .
(2) When a lot in one ownership is situated in part
in the Town of North Andover and in part in an
adjacent town or city, the provisions, regula-
tions and restrictions of this By-Law shall be
applied to that portion of such lot as lies in
the Town of North Andover in the same manner
as if the entire lot were situated therein.
(3) When a zoning district boundary divides a lot
of record on June 5 , 1972 in one ownership, all
the zoning regulations set forth in this zoning
By-Law applying to the greater part by area of
such lot so divided may, by Special Permit, be
deemed to apply and govern at and beyond such
zoning district boundary, but only to an extent
not more than one hundred (100) linear feet in
depth (at a right angle to such boundary) into
the lesser part by area of such lot so divided.
(4) Accessory uses, as defined herein, shall be on
the same lot with the building of the owner or
occupant, and shall be such as not to alter the
character of the premises on which they are lo-
cated nor impair the neighborhood. Where manu-
facturing of any kind is allowed as an accessory
use, it shall be restricted to such light manu-
facturing as is incidental to a permitted use
and where the product is customarily sold on the
premises by the producer to the consumer.

Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
February 8 , 1982 upon the application of Or Dilip Mukerjee :
The hearing was advertised in the Lawrence Eagle Tribune on
January 25 and February 1 , 1982 and all abutters were notified
by regular mail . The following members were present and voting :
Frank Serio , Jr. , Chairman ; Alfred E . Fri zelle , Esq . , Vice -Chairman ;
Richard J . Trepanier , Esq . , Clerk ; Augustine W . Nickerson ; and
Wal ter F . Soule .
The petitioner seeks a. Special Permit under Section 9 , Par . 9 . 1
and 9 . 2 and Section 10 , Par . 10 . 3 in order to permit the expansion
and renovation of existing lawfully non-conforming buildings and
uses on the premises located at 14 Main Street ,
The petitioner proposes to develop the premises for use as pro-
fessional offices . In order to make the property economically
feasible , the petitioner proposes to add a second floor to the
building closest to Main Street . The stone building to the rear
of the premises will also be converted to office use
At the hearing , there was no opposition to the proposal .

Upon a motion made by Mr . Frizelle and seconded by Mr . Soule , the
Board voted unanimously to grant the Special Permit as requested
subject to the following conditions :
1 . That the existing small structure used as a taxi stand and
shown on the plan as "to be razed " be removed prior to the
issuance of a building permit .
2 . That sufficient parking , in accordance with the requirements
of the Zoning By Law , be shown on a plan and presented to the
Building Inspector prior to the issuance of a building permit .
The Board finds that the site is appropriate for the proposed use
and that the proposal will not adversely affect the neighborhood
nor create a nuisance or be hazardous to vehicles or pedestrians .
The Board also finds that the proposal is in accordance and harmony
with the general purpose and intent of the Zoning By Law .

Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
July 12 , 1982 upon the application of Dr . Dilip Mukerjee . The
hearina was advertised in the Lawrence Eagle Tribune on' June 28
and July 6 , 1982 and all abutters were notified by regular mail .
The following members were present and voting : Frank Serio , Jr . ,
Chairman ; Alfred E . Frizelle , Esq . , bice Chairman ; Richard J .
Trepanier , Esq . , Clerk ; William J . Sullivan ; and Augstine W .
Nickerson .
The petitioner requests a Special Permit under Section 9 , Para-
graph 9 . 2 and Section 10 , Paragraph 10 . 3 of the Zoning By Law
so as to permit the extension and enlargement of an existing
non -conforming building that does not conform to the existing
setbacks at 1A Main Street .
The petitioner had earlier sought and recdived a Special Permit
for a second floor from this Board on the same premises . However ,
due to structural defects , the petitioner could not construct the
second floor . Rather than attempt to comply with the first per-
mit be a piece-meal approach , the petitioner prepared plans for
a new structure , placing said structure further back from the
side lines than the original building .
Upon a motion made by Nr . Frizelle and seconded by Mr . Trepanier ,
the Board voted unanimously to grant the Special Permit as requested .
The Board finds that each of the provisions of Section 10 . 31 have
been satisfied .

The buildings are existing and the Zoning Board of Appeals
approved the request to extend the occupancy of the non-
__ conforming building_., Nowoverwhen investigating the foundations
of the present front structure, the forst wall only goes 21-011 -
below the grade. It would _be more advisable from an engineering
and oafety standpoint to raze the foundation. -
