Re: development of property behind 72 Prescott St., North Andover
Dear Sir/Madam:
Enclosed, please find a letter that we have copied to you regarding a problem
we are having with our property located at 12-14 Summit St. (off Prescott St.).
As you will read, for 23 years we have had major problems with an underground
spring flowing underground from 72 Prescott St., and rain water run-off(caused
by a culvert pipe located behind 72 Prescott Street, which contributes to street
run=off as'it empties into Summit Street). There also appears to be a wetland
area between the barn and an older structure on the property.
There are plans to build on the above property (behind 72 Prescott Street)
across the street from our home on Summit Street. The two lots have already
been subdivided and recorded and the property was surveyed yesterday by
Christiansen & Sergi, Inc.
As building on this property is directly going to affect our property we are very
concerned about the water problems we experience and would like to know what
can be done to prevent the water we're getting from the underground spring and
street run-off.
Any help you can provide would be extremely helpful.

Re: Property being developed behind 72 Prescott St.
Dear Sirs,
We understand that the Robert Rockwell(now deceased) property at 72 Prescott
Street, North Andover, is up for sale and it appears that they are preparing to build
houses in his back yard which has already been subdivided. There is also an area of
wetlands between the barn and an older structure on the property. There is also a
culvert pipe close to the older structure that diverts water to the road and our property.
Since buying our two-family home in May of 1979, we have been inundated with water
drainage problems. Our home is built like a ranch split with the rental apartment in the
lower level.
Our concern is that building anything on the above stated property will cause more
flooding and water problems to our property. Even with all the precautions we have
used taken, which have included:
1. the building of a new deck with stairs that went off the back of the house
instead of towards the front of the house on the side abutting the Leach
property where after a heavy rain or snow melt would look like the Mississippi
River;
2. digging to the footings of our home and applying pitch;
3. backfilling with gravel from the house footings up to surface with stone;
4. installing an undergone water diversion system around two sides of our
home,
5. installing a catch basin/drainage system across the length of the garage door;

6. the digging of a two foot deep ditch from the end of the driveway drain
system around the side of the house;
7. and, the installation of several berms (over the years) at the top of the
driveway to keep excess water away,
we still get an unacceptable amount of water from the underground spring and road
(the culvert pipe directs water to the road).
In our front yard water comes up from the underground spring and during a non-drought
year we get standing water in a large portion of our front yard that can be there for
weeks to months (depending on rain and snow melt).
We have a hole in our front yard, made by the underground spring, that forms a geyser
in our front yard and has spouted as high as 8"during a heavy rainstorm. There is a
large rock placed in that area for safety reasons, but there is quite a large hole under
the rock which was formed by the underground water pushing its way through.
Our major concern is that there is an underground spring that travels underground and
cultvert water that drains onto Summit Street. With disruption of the land and water
table this problem is only going to be made worse for us.
Please, let this be on record that these issues need to be addressed with any
prospective buyer as this is a serious problem for us. There needs to be an
underground water diversion system and a catch basin in front of 12-14 Summit Street
to divert the spring/road water from our property.

This letter is confirm that on April 5, 2002,I inspected the property at 72
Prescott St. and the adjacent lots an Summit Ave. in North Andover. Upon walking
the site, identifying the vegetative.Species and observing soil probes in several
locations,I did not f ind any area that wouid be considered a jurisdictional wetland
resource area under the Massachusetts Wetlands Protection Act or the North
Andover Wetlands Bylaw. Only one soil probe had indicators of a high water table,
however,there were no wetland Indicator plant species and the area was less that
100 square feet. There were no other indicators of hydrology.

Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
November 14 , 1983 upon the application of Douglas and Cynthia
Berube . The hearing was advertised in the North Andover Citizen
on October 27 and November 3 , 1983 and all abutters were notified
by regular mail . The, following members were present and voting :
Frank Serio , Jr . , Chairman ; Richard J . Trepanier , Esq . , Clerk ;
William J . Sullivan : and Associate Members Walter F. Soule and
Raymond A . Vivenzio..
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7 . 3 and Table 2 of the Zoning By Law so as to permit
relief from the rear , setbatk requirement to allow the continued
existence of an open deck which does not meet the rear setback
requirement on premises located at "12 -14 Summit Street .
Mrs . Berube testified that through an engineering error , the new
deck was placed one foot too close to the rear lot line . Denial
of the variance would create a harship to the petitioner .
Upon a motion made by Mr . Sullivan and seconded by Mr . Soule , the
Board voted unanimously to grant the variance as requested .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . Specifically , the Board finds that a literal enforce -
ment of the Zoning By Law would create a hardship to the petitioner
and such relief may be granted without nullifying or substantially
derogating from the intent and purpose of the Zoning By Law .

4 . The Engineer or any members of his staff shall not, during
site visits or as a result of any observations of
construction, supervise, direct or have control over
Contractor' s (s) work nor shall the Engineer have authority
over or responsibility for the means, methods, techniques,
sequences or procedures of construction selected by the
Contractor (s) or safety precautions and programs incident
to the work of Contractor (s) or for any failure of
Contractor (s) to comply with laws, rules, regulations,
ordinances, codes or orders applicable to Contractor (s)
furnishing and performing their work. The Engineer does
not guarantee the performance of the construction contract
by the Contractor(s) , and does not assume responsibility
for the Contractor' s (s) failure to furnish and perform
their work in accordance with the Contract Documents .
5 . Notify and meet with the Engineer before initiating any
work on this project.
6 . The General Contractor shall field verify all existing
conditions including but not limited to dimensions . Any
discrepancies from the drawings shall be brought to the
attention of the Engineer.

The current exemption for "homeowners" was extended to include owner
-occuoied dwellinzs of six units or less and to allow such homeowners to
engage an individual for hire who does not possess a license , provided
that the owner acts as supervisor . (State Building Code , Section 109 . 1 . 1 )
DEFINITION OF H0MEOWNER:
Person( s ) who owns a parcel of Land on which he/she resides or intends to
reside , on which there is , or is intended to be , a one to six family dwell-
ing , attached or detached structures accessory to such use acid/or farm
structures . A person who constructs more than one home in a two-year
period shall not be considered a homeowner . Such "homeowner" shall submit
to the Building Official , on a form acceptable to the Bulding Official ,
that he/she shall be responsible for all such work. performed udder the
building permit . (Section 109 . 1 . 1 )
