Your Engineer will stakeout the area between tree #1 and #2 prior to the installation of the landscape timbers. The bottom landscape timber shall be set below the lowest grade point of the abutter's property. The elevation of the top landscape timber shall be set above the finish grade of the side yard elevation of 14 Wright Avenue in order to prevent water run off into the abutting property. The landscape timbers must be backed with a 4" perforated PVC drainpipe; lay in a bed of and surrounded by crushed stone. The stone will be covered with filter fabric and six (6) inches of seeded loam will be placed over the filter fabric and then seeded with the surrounding area Enclosed is a sketch of the proposed work to be performed Work will take place between trees #land #2. It is understood that all work will commence Friday the 5th and be completed by the end of the workday on Monday the 8h of July. The grading is still almost to the top of my stone wall in some places. This is going to be a problem when the stone wall is removed to put up a privacy fence. The topography of that lot matched mine prior to the construction - and it should again match mine prior to the occupancy permit being issued. They have also dislodged some of the stones during their work. That is defacement of my personal property and against the law. I still do not have a written response to my e-mail to you dated May 16th regarding the exact portion of the zoning bylaw that allowed the additional unit without a special permit. My records -indicate that under the 14 day rule I should have had a written response by 05131102. As indicated in my letter to Mr. McGuire of 12/14/01 (of which you were copied) I understood that Mr. Ahearn had the right to convert and specifically stated that I had "no problem with that as long as all is done according to law". I am seriously thinking about requesting copies of all building permits issued during the years of 2000 and 2001 (90/316 and 98/286 respectively) in order to ascertain how many more of these nightmares have occured. If necessary I will go through the Attorney General's office under the public records law for this and also for clarification of the zoning bylaw regarding the special permit for the original conversion. I did not get home from work until IOPM on Wednesday evening and last night I did not go out and look due to the heavy showers and a personal business meeting that lasted until 9PM (well after dark). As per our discussion on Wednesday morning the grading that will be required is as follows, 1) Locate the property bounds on the property to the left and for a minimum of 2' (two) feet in towards your property keep the same grade as the abutting property. 2) From that measurement create a swale in towards your property of approximately 2' (two) feet in width and V 6" (one and one half) feet in depth along the level grade so as to bring all water away from any abutting properties. Banking the swale as required. I am enclosing a sketch of what was discussed between us on Wednesday morning as well as what was discussed with Ms. Mills and Mr. Nicetta earlier that morning. (Rule of thumb uses a 10 foot span for each floor in my memory bank.) I would also appreciate clarification on the fact that the property was advertised by Ms. Jamie Dixon of Remax in the 01/06/02 issue of the Tribune on page D13 as a condex. Has a conversion of this property been approved by the Town? If so - when and how. I still have issues on the increase of the level of the lot following the original excavation of the cellar hole. Although it has been backfilled following the completion of the foundation - the topography still remains too high compared to what it was prior to the construction being started. The grading is still almost to the top of my stone wall in some places. This is going to be a problem when the stone wall is removed to put up a privacy fence. The topography of that lot matched mine prior to the construction - and it should again match mine prior to the occupancy permit being issued. They have also dislodged some of the stones during their work. That is defacement of my personal property and against the law. I still do not have a written response to my e-mail to you dated May 16th regarding the exact portion of the zoning bylaw that allowed the additional unit without a special permit. My records• indicate that under the 14 day rule I should have had a written response by 05/31/02. As indicated in my letter to Mr. McGuire of 12/14/01 (of which you were copied) I understood that Mr. Ahearn had the right to convert and specifically stated that I had "no problem with that as long as all is done according to law". I am seriously thinking about requesting copies of all building permits issued during the years of 2000 and 2001 (90/316 and 98/286 respectively) in order to ascertain how many more of these nightmares have occured. If necessary I will go through the Attorney General's office under the public records law for this and also for clarification of the zoning bylaw regarding the special permit for the original conversion. The grading is still almost to the top of my stone wall in some places. This is going to be a problem when the stone wall is removed to put up a privacy fence. The topography of that lot matched mine prior to the construction - and it should again match mine prior to the occupancy permit being issued. They have also dislodged some of the stones during their work. That is defacement of my personal property and against the law. I still do not have a written response to my e-mail to you dated May 16th regarding the exact portion of the zoning bylaw that allowed the additional unit without a special permit. My records indicate that under the 14 day rule I should have had a written response by 05131/02. As indicated in my letter to Mr. McGuire of 12/14/01 (of which you were copied) I understood that Mr. Ahearn had the right to convert and specifically stated that I had "no problem with that as long as all is done according to law". I am seriously thinking about requesting copies of all building permits issued during the years of 2000 and 2001 (90/316 and 98/286 respectively) in order to ascertain how many more of these nightmares have occured. If necessary I will go through the Attorney General's office under the public records law for this and also for clarification of the zoning bylaw regarding the special permit for the original conversion. It is also appreciated that you will speak to Mr. Ahearn about correcting the problem with my apple tree and present grading issues along with property line. As discussed, I maintain concern on the actual property line location in connection with the proposed placement of foundation according to the plan and actual footage on the side setback. I will wait until such time that the foundation is actually poured prior to asking my surveyor to verify that actual footage on the required setback, but as stated this morning it will be my intention to do so. I understand that they are approved under current by-law to undergo the present proposal for an addition to a "two family / duplex" and have no problem with that as long as all is done according to law. This also includes preservation of my property from any defacement and proper drainage issues being addressed to prevent runoff.
