an audit of this site is performed. Exxon in consultation with Groundwater Technology will continue
to monitor site conditions and proceed with site-investigation/remediation under Waiver of Approvals

review.

5. The Phase II assessment should characterize the french drain and the potential for
discharges from the french drain to be contaminated. If applicable, discharges from
the french drain should also be brought into compliance with 314 CMR 5.00.
6. Additional monitoring well(s) should be installed to the east of mW-8 along Sutton
Street, to more effectively evaluate the extent of the site/lateral contaminant
plume migration.

(1) Sign and return one copy of the WAIVER APPLICATION DISPOSITION Form (section VIII) to:
Massachusetts DEP, Northeast Regional office, 10 Commerce way, Woburn, MA 01801, Attn:
Site Assmt Sect/ waiver Unit. Retain one copy of the form for your records.
(2) It is the responsibility of the waiver Recipient to promptly notify the Local Board of
Health and Chief Municipal official (i.e. Mayor, Manager, Selectmen) in the affected
community(ies) of waiver approval. Notice shall be provided in writing and be copied
to this Office. Notification to local officials shall include a copy of the Waiver
Application Disposition Form.
(3) Required reports and other document submittals to this Office must clearly indicate the
DEP Case Number and contain the designation "waiver suhmittal-.
(4) Contaminated soils from this site may not be transported to any other location within
Massachusetts without specific approval from this Office. Unapproved , off-site
disposition, including traw-"ent, reuse, or disposai, may constitute a "release- of ail
or hazardous materials and create a new "site" .
Soils contaminated only with virgin petroleum fuels should be handled in accordance with
DEP's "Management Procedures for Excavated Soils Contaminated with virgin Petroleum
Oils" (Policy #WSC-400-89) . Treatment or reuse options are preferred. In-state
landfill disposal will only be considered if documentation is provided that all
available and applicable treatment options are not feasible.
Soils contaminated with other oils or hazardous materials require site-specific
approval, unless transported by a licensed hazardous waste transporter, under manifest,
to a licensed facility, per 310 CMR 30.00, the "Massachusetts Hazardous Waste
Regulations-. Proposals to treat, dispose, or reuse contaminated soils outside of
Massachusetts must conform to all applicable in-state and out-of-state regulatory
requirements, but do not otherwise require approval from the Regional Office.
The review and approval of soil disposition proposals by the Department is solely from
the context of preventing releases of oil and hazardous materials in new locations, and
is not to be construed as a review or approval of the Final Remedial Response Plan for
the Waiver site under consideration.
(5) If a public involvement petition has been or is hereafter submitted for the site under
M.G.L. c. 21E, Section 14(b) and 310 CMR 40.203, the waiver grantee must develop and
implement a Public involvement Plan in accordance with 310 CMR 40.203(4) and DEP's
~Public Involvement Plan Interim Guidance for waiver sites".
(6) App;l.ca�tb are reminded of the necessity. to comply with the risk characterization and
permanency requirements specified. in 310 CMR 40:545.
(7) Dissolved volatile organic compounds (bOCs) at the water table interface can partition
into the soil gas, and migrate into subsurface structures, including basements. such
a migration pathway should be considered at sites where water-table plumes of dissolved
VOCs are identified proximate to or under inhabited structures.
(8) This Office should be notified in writing immediately in the event of a shut-down, for
any reason, of any treatment system(s) operating at the site. This could potentially
affect site conditions, and could warrant a re-evaluation by the Department of the "Non-
Priority- site classification.
(9) This Office will conduct detailed audits on selected waiver sites, on both a random
basis and as a result of our initial review of waiver applications and report documents
submitted (or not submitted) pursuant to the conditions specified in Section Iv.

NOTIFICATION
Dear Local Official:
This letter is to inform you that the Department has received
an application for "Waiver of Approvals" for the above referenced
disposal site. The application was submitted by Exxon Company,
U.S.A. . The Massachusetts Contingency Plan (310 CMR, 40.00)
establishes procedures for assessing and remediating sites where
there has been a release of oil or hazardous materials. The
Massachusetts Contingency Plan requires that six specific reports
be submitted to the Department during the response action process.
The Department must approve each of the reports before the next
phase of work can be conducted (310 CMR 40.536) .
The Massachusetts Contingency Plan also allows those
conducting response actions at non-priority sites to apply to the
Department for a waiver of required approvals (310 CMR 40.537) .
When such a waiver is granted, remedial response actions must still
meet all of the other requirements of M.G.L. c. 21E and The
Massachusetts Contingency Plan, including submittal of documents to
the Department. However, no Department approvals of reports, plans,
or other documents will be required as long as the waiver remains
in effect.
A waiver of approvals will expedite the performance of a
remedial response action. At this time, the Department is focusing
its limited resources on the disposal sites which present the
greatest and most immediate threats to public health

and to the environment. These are generally sites classified as
priority, based on specific criteria in the Massachusetts
Contingency Plan. At non-priority sites, contamination does not
threaten public health or the environment, but may at some time in
the future if no action is taken. A waiver of approvals allows
assessment and cleanup of non-priority sites which otherwise would
have to wait until the Department has staff available to oversee
response actions.
The DEP expects to complete its review of this waiver
application and all other relevant information within �6:Odays of
receipt of the application in the regional office. The waiver
application and any other information submitted to the department
may be reviewed by appointment. To make an appointment, please
contact the assigned DEP staff person at the phone number listed in
the closing of this correspondence.
In deciding whether to grant a waiver of approvals for this
site, The Department welcomes any additional information that you
may wish to be considered for this case. Please submit any
information and comments to the Waiver Unit of the DEP regional
Office listed above. Information must be submitted on or by thirty
days from the date of this letter so that we may include it in our
review of this application. The Department will notify you as to
the decision made on this waiver application.

The Department of Environmental Quality Fngineering (Department) has
received a written report from you concerning environmental conditions at
the above referenced property.
If you are a potentially .responsible party as described in Section
5 (a) of MGil ch. 21E, the Massachusetts Oil and Hazardous Material Release
Prevention and Response Act, you are also responsible for ensuring that
appropriate assessment and remedial action, if necessary, occurs at this
property. These and other r.esponsibi.a.i_ti.es/liabilities are described in MGL
ch. 21E.
Based on a preliminary review, the Department believes that the
conditions as described in the report do not constitute an imminent hazard
to the pu"b1ic hea-Ith, safety, welfare, or the environment requiring
immediate action by the Department. Consequently, further review of the
report and/or investigation of the property cannot be given top priority
because of the need to attend to cases which appear to pose the most serious
threat to public health, safety, welfare, or the environment. Your case
will be reviewed in the order in which it was received as staff can be
diverted :from top priority cases.
In orCler that the Department 's review of your report is as expeditious
as possible, you are urged to determine whether the report conforms to the
enclosed /au;idelines. Unfortunately, many reports fail to provide sufficient
information to fully assess the problem or to allow sound decisions
concerning further assessment or .remedial action. Deficiencies often

include a lack of validated data, expert professional interpretation of data or .
recommendations for further action. We suggest that you examine your report in
light of the general guidelines and policies enclosed to determine whether
there are additional steps you should undertake to expand upon your report.
Please note that this letter does not: constitute a statement that the
referenced property is or is not subject to the provisions of MGL ch. 21E. In
addition, be advised that present statutory .requirements compel the Department
to maintain and publish a list of locations "to be investigated as possible
disposal. sites" of oil or hazardous materials (MGL ch. 21E, section 3A) .
Accordingly, based upon information contained in the submitted report, the
subject property may be so listed by the Department, and you may be contacted
at a future date and be requested to complete a "Preliminary Assessment" and/or

Notice of Responsibility
Pursuant to M.G.L. Chapter 21E
Dear Sir/Madam:
The Department of Environmental Quality Engineering is in receipt of an
engineering report prepared by IEP, Inc. concerning environmental conditions
at the subject site. This report is dated June 1985 and is entitled "21-E
M
Site Assessment, North Andover Citgo, Route 125 and Hillside Road, North
Andover, Massachusetts". Such an assessment has been voluntarily conducted
to determine the possible presence of oil or hazardous materials that could
potentially constitute a basis for regulatory action by the Department under
the provisions of M.G.L. Chapter 21E. .
According to IEP, Inc. , the site has been operated:.ae a .service station
since 1953, although gasoline pumps and underground storage tanks have
probably existed on the site since the mid 1930's. Six underground storage
tanks were removed from the site by Zecco, Inc. on April 10, 1985. One 550
gallon tank containing heating oil and one 550 gallon waste oil ,tank were .
excavated from along the west side of the building. Four 5,000 gallon steel
gasoline tanks were removed from northeast of the building, one of which
contained holes. The other four tanks reportedly had surf icial rusting, but
were otherwise sound.
The investigation conducted by IEP, Inc. was of a limited scope and
included: the observation of underground storage tank excavation, installation
of four groundwater monitoring wells, screening of soil samples with an HNu
photoionization detector, and the analysis of groundwater samples for Volatile
Organic Compounds (VOCs) by EPA Method 624. Results of groundwater analyses
reveal the presence of four Volatile Organic Compounds including benzene,
xylene, toluene and ethylbenzene in monitoring well OW-1 at a total concentration
of 4150 ug/l. These compounds are components of gasoline.

Statement of Conclusions/Statutory Liabilities
Based upon the aforementioned investigation, a condition of soil and
groundwater contamination by Volatile Organic Compounds (VOCs) has been documented
at the subject site.
Be advised that such conditions constitute a "release" of oil/hazardous
materials at the site. The prevention and/or mitigation of such a release or
threat of release is governed by Massachusetts General Law, Chapter 21E, the
"Massachusetts Oil and Hazardous Material Release, Prevention and Response Act".
Chapter 21E identifies as responsible parties the current owner or operator
of a site at which there has been a release or threat of release of oil or a
hazardous material; the. past owner or operator of such a site; any person who
directly or indirectly arranged for the transport, disposal, storage or treat-
ment of hazardous materials to or at such a site; and any person who caused or is
legally responsible for a release or a threat of release at such a site. Such
parties are liable without regard to fault; the nature of this liability is
joint and .several.
This letter is to inform you in writing that:
(1) The Department has determined that a release of oil/hazardous material
has occurred at the subject site.

(2) Additional investigation and assessment is needed to adequately define
the impact of this release on public .health. and the environment, and to
determine what, if any, remedial/clean up measure is necessary.
(3) Information available to the Department indicates that you, as owner
of the subject site, are a liabile and "responsible" party pursuant
to Section 5(a) of Chapter 21E.
(4) Should you fail to implement those acitons deemed necessary by this
' Office., the Department may, pursuant to M.G.L. Chapter 21E, take or
arrange for any and all necessary actions at the site. If public
's funds are expended under such conditions, Chapter 21E, Section 11
stipulates that the Attorney General of the Commonwealth of Massachusetts
may initiate legal action against the responsible party to recover all
costs incurred by the Department in the assessment, containment, .and
removal of any release or threat of release of oil or hazardous materials.
(5) The liability .of responsible parties in (4) above includes up to three
times the cost of:
a) all response costs incurred by the Department 'due to the release/
threat of release, including all contract, administrative, and
personnel costs; and

b) all damages for any injury to, destruction, or loss of, natural
resources due to the release/threat of release.
This liability constitutes a debt to the Commonwealth. The debt, together
with interest, would constitute a lien on all your property in the Commonwealth.
In addition to the foreclosure remedy provided by the lien, the Attorney General
of the Commonwealth may recover that debt or any part of it in an action against
you. You may also be liable for additional penalties or damages pursuant to
other statutes or common law.
Requisite Site Actions
The extent of investigation conducted at the site, as reported in the IEP,
Inc. report is deemed to be deficient in the following respects:
1) The process of determining groundwater flow'direction was not reported.
2) If the groundwater flow has been accurately determined to flow north/
northeast, no monitoring wells have been installed downgradient of the
source of the release, i.e. , the underground storage tanks.
3) Access to the building was not attained, preventing the inspection
of internal sumps and floor drains.
4) Reportedly, three underground storage tanks existed on the site prior
to 1959; one 500 gallon capacity and two 1000 gallon tanks. In 1959
the 500 gallon tank was replaced by a 4000 gallon tank. The disposition
of these tanks has not been determined.
In light of the above, the following additional actions are necessary to
adequately define and evaluate site conditions and provide sufficient data to
theDepartment to determine what, if any, remedial actions are warranted at the
site:
1) Groundwater elevations must be accurately measured relative to a common
datum and a groundwater contour map must be constructed.
2) A monitoring well must be installed downgradient of the former leaking
underground storage tank with subsequent groundwater sampling and
analysis to evaluate groundwater quality.
3) Determine the disposition of all underground storage tanks historically
permitted to occupy the site.
4) An internal inspection of the building should be executed to determine
the existence and status of sumps and floor drains.
A written response indicating your intentions to comply with the provisions
of this letter is requested within 14 days.

This office has received Geologic Services Corporations (GSC) report for the short
term pump test completed at the above referenced site on June 28, 2000.
The report contained the volume pumped and monitoring results for pH, volatile
organics—PID, TPH by 8100 modified, Total BTEX, Benzene and MTBE by 8021B.
All results were non-detected. Accordingly, a permit application for the long-term
treatment and discharge of treated groundwater is enclosed. Please complete the
application and include treatment system drawings detailing effluent sampling and
metering locations. Also please attach relevant documents or testing requirements as
stipulated by the Massachusetts Department of Environmental Protection.
Once the completed permit application package is received by this office and an
on-site inspection is done by the GLSD Pretreatment Inspectors; a treatment permit may
be issued to Exxon Mobile Refining & Supply.

necessarily ensure the granting of a building permit as the applicant must abide by all applicable local,
state and federal and building codes and regulations,prior to the issuance of a building permit as
requested by the Building Commission.

Enclosed please find a copy of the Release & Utility-Related Abatement Measure (RAM &
URAM) Transmittal Form (B WSC-106) and Release Abatement Measure Plan for the above
referenced site. The enclosed documentation has beenP Pre aced under the direction of Licensed Site
Professional Mr. Donald Pomeroy of Geologic Services Corporation (GSC).
The RAM activities proposed are to address to presence of NAPL. Gauging and bailing events will
be conducted every two weeks for selected monitoring wells (at minimum wells B-2, MW-10, and
MW-11) for a period of 2 1/2 months. This schedule may vary based on observed site conditions
during the gauging events.
The proposed RAM activities will be conducted concurrently with additional monitoring and
assessment activities as part of the pending Phase I1 investigation for this site. If you have any

Geologic Services Corporation(GSC), on behalf of Exxon Company, USA(Exxon)has completed
this Release Abatement Measure(RAM) Plan for the above referenced site pursuant to 310 CMR 40.0444.
Please forward one copy of this report along with the original signature copy of the enclosed transmittal
form BWSC-106 to the attention of Ms. Patricia Donahue at Department of Environmental Protection
(DEP),Northeast Regional Office, 205 Lowell Street, Wilmington, MA 01887. Upon receipt of a copy of
the transmittal to DEP,GSC will forward copies of this RAM Plan to the Chief Municipal Officer and
Board of Health Department of North Andover in accordance with the requirements of 310 CMR
40.1403(3)(d).
Subject Property Description
The subject property is situated on the southern side of Sutton Street in a commercial/residential
area of North Andover, Massachusetts. The subject property is currently owned and occupied by
Trombley Brothers, Inc. (Trombley), and is presently an automobile repair facility complete with four
service bays, one 10,000-gallon gasoline underground storage tank(UST), one gasoline pump dispenser
island, one 1,000 gallon used oil UST,one 1,000-gallon kerosene UST,and one 500-gallon heating oil
UST. Please refer to Figures 1 and 2 (Attachment A) for a depiction of the subject site and surrounding
area.
Background/Regulatory Status
In September, 1987, six Exxon-owned USTs were removed from the subject property. These six
USTs had been utilized on-site in the storage of gasoline, kerosene, and used oil. During the UST removal
activities, a light, non-aqueous phase liquid(NAPL)was observed on the surface of groundwater within the
UST excavations. As the result of these UST excavation activities, approximately 150 cubic yards of
impacted soil was removed from the UST excavation area and transported to an off-site facility for
recycling/disposal.
The DEP subsequently listed the subject site as a Location to Be Investigated on October 15, 1988
(WSC/SA#3-0870) in response to the detection of petroleum-related compounds in collected soil and
groundwater samples, and the presence of NAPL in the UST excavations.

I
A Waiver of Regulatory Approvals(Waiver)was subsequently issued to Exxon for the
continuation of response actions at the subject site,effective September 22, 1993. Response actions
completed at the subject site to-date include soil excavation,NAPL recovery, well installation,and periodic
groundwater monitoring. A Tier II Classification Extension Submittal dated July 16, 1998 has been
submitted to the DEP for the completion of response actions after the expiration date of the Waiver.
Recent Assessment Activities
Site-related monitoring wells were gauged with an electronic interface probe(EIP)on May 27,
1998 (refer to Figure 2-Attachment A for well locations). Monitoring well gauging data are presented in
Table 1 (Attachment B). NAPL was detected in monitoring wells B-2, MW-10, and MW-11 at thicknesses
ranging from 0.03 feet in MW-10 to 0.10 feet in MW-11. Based on the May 27, 1998 gauging data,a
groundwater contour map was prepared and is shown as Figure 3 (Attachment A). The groundwater
contour map indicates that groundwater flow is in a northerly direction, exhibiting a hydraulic gradient of
approximately 0.051 between monitoring wells MW-1 and MW-8.
The presence of NAPL in monitoring wells B-2, MW-10, and MW-11 is considered to be a
previously existing condition;therefore,no new Release Tracking Number(RTN)has been issued to these
detections. Table 2 (Attachment B)displays the historical groundwater sample analytical results from the
site-related monitoring wells. As noted in Table 2, samples collected from B-1 and MW4 exhibited
concentrations of the targeted analytes in excess of the applicable MCP Method 1 Groundwater Standards.
Figure 3 (Attachment A)also depicts the analytical results of groundwater samples collected from site-
related wells on May 27, 1998.
Release Abatement Measure Activities
The RAM activities proposed herein to address the presence of NAPL consist of periodic gauging
of selected site-related monitoring wells (at minimum wells B-2, MW-10, and MW-11)with an EIP, and
the recovery of detected NAPL with disposable bailers and/or sorbent/passive skimmers. The proposed
gauging and bailing events will take place every two weeks for a period of approximately 2/Z months. This
schedule may be varied based on conditions observed during the gauging events.
The proposed RAM activities will be conducted under the DEP-issued Waiver, while additional
monitoring and assessment activities continue concurrently with this RAM as part of the pending Phase II
investigation for the subject site.
Management of Remediation Waste
Recovered NAPL and disposable sorbent skimmers and/or bailers will be stored on-site within
appropriate secondary containment until disposal. The proposed RAM activities will commence
approximately one week following the submittal of the RAM Plan to the DEP and the appropriate public
notification pursuant to 310 CMR 40.1403. Should the proposed scope of work change significantly prior
to or following implementation, Exxon will submit a RAM Plan Addendum specifically outlining
modifications to the workscope.
Scope of Release Abatement Measure Activities
If site conditions become significantly different from those previously documented or if an
Imminent Hazard or two or 72 hour notification condition exists,all work being performed in conjunction
with the RAM will be temporarily suspended until the DEP is notified and approval to continue is received.
A site-specific Health and Safety Plan has been prepared for these activities.
