In conversations with personnel at the Department of Public Works it has been established that a few years ago a portion of the work was completed, but the sewer line which was ; run to the road was not actually hooked into the internal plumbing of your home. The Health Department has specific regulations regarding sewer tie-ins, which were promulgated in 1994. Your home is in violation of this regulation. Section: 4.1 All establishments that currently do not have municipal sewer available to them must connect to the sewer as soon as it becomes available, with a maximum time limit of six months. Due to the sensitivity of the watershed area, this department is very concerned with the few remaining septic systems in operation in your area. The Board of Health has a regularly scheduled monthly meeting. Next month's meeting will be held on Thursday, April 27, 2000. Dear Gerry: I have just found out from George that he has conveyed his interest in 1438 Great Pond Rd to you. I was extremely disappointed to hear this because the whole issue of the sewer easement over our property has not been resolved. George and I had initially come to an understanding that in return for granting this secowould relinquish the first one that we had granted some time ago. As you know, Carole and I agreed to the scenic easement because it was our understanding that it was needed to obtain a building permit to enclose your porch. Apparently,,it was subsequently determined that it was not necessary. When the issue of the second easement surfaced it was understood that the first easement would be terminated and an agreement as to the second would be worked out. Apparently, because of the divorce, none of this was done. George now tells me that there is nothing he can do because it was determined that he had no authority to enter into any agreements for the trust and was ordered by the Probate Court to convey his interest to you. This now places Carole and I in an awkward position. We assumed, in good faith, that we had an agreement and now we find ourselves in this mess. As you know, no consideration was ever extended to us for these proposed easements and they were only granted because of our close friendship with George. At this stage, I am not looking to cause any further aggravation for either you or George, but these issues have to be resolved because, as it stands now, without an understanding on these easements,there is an encroachment on our property and a serious issue as to the legality of your sewer rights. T am sending a copy of this letter to George so that the two of you can address this and someone can get back to me, as this issue needs to be resolved and hopefully complete what was the original understanding. As you know,this was in response to my recent communication to both of you concerning the issue of the easements. I have not heard from you and although I would be more than willing to discuss this matter directly with you, I can certainly appreciate the fact that you might not want to do that. In that event, I would be amenable to review and hopefully resolve this difficulty, which was not of our making, with anyone you so designate. Naturally, as you know, no sewer hookups can be made until a legally binding easement is recorded, outlining the easement area and the rights and responsibilities of both parties along with termination of the prior easement. Although I was specifically ordered by Judge Stevens to pay the bill owed to Ramey, for the sewer line, nothing was ever mentioned by the attorneys during the past 2'/z years, concerning- the oncerningthe easement,: At this time, I have been paid the monies due me by Ms. Murphy, and I have no direct or indirect interest in my former residence. I must also direct your attention to the"Agreement for Judgment", in the Superior Court, a copy of which is enclosed. You will note that it was unanimously agreed that I had no authority to bind Ms. Murphy, or The Five Star Trust. This fact may place in jeopardy the easement you and Carole granted to me, as Trustee, a few years ago. Obviously, the only binding 7athority I had was to obtain a discharge of my parent's mortgage, which you notarized, while the agreement for obtaining the discharge, signed at the same time, was not valid. It's hard to figure. I suggest you deal directly and exclusively with my former wife concerning the issue of encroachment. Best wishes to you and Carole. Mrs. Stella is looking for some documentation of this release to protect herself from future problems should the product migrate onto her property in the future. I told her that we could probably assist her in getting copies of whatever Notices of Release etc. are filed at DEP under the state MCP. She seems concerned that becuse this is in the watershed that she is going to wind up in trouble with the Town, etc. I told her that either Mike or Sandy might give her a call and discuss the MCP process and how she might get copies of the reports for future reference.
