The Board of Appeals he`l.d a public hearing -on Monday evening,
September 19, 1983 upon the application of Allen Deary and
James Lanigan. The hearing was advertised in the North Ando-
ver Citizen.on Septemberl and 8,.1983 and all abutters were
notified by regular.mail. The.following members were present
and voting:__Frank- Ser -i o, Jr.., Chairman; Alfred E. frizelle,
Esq. Vi ce Chairman; _R_i chard-_ J_: Trepanier, Esq..-, Cl erk; Mauri ce
Fou -1 -d -s-; and -Walter F. Soule.
The petitioners seek a Special Permit under Section 4, Paragraph
4.122 of the Zoning By.�Law so as to permit the conversion of a
two family dwelling into a -three family dwelling on premises lo-
cated at 144-146- Waverly Road.
The petitioners 'testified that -the dwelling -is in need of extensive
repair Iand the income .from a third unit is necessary to finance the
renovations. The neighborhood is comprised of multi -family dwellings.
In addition,--there-are-two dwellings in -the area which were recently
con_ve-rte.d=_to__three fami-ly units after securing Special Permits from
the Board of Appeals.
No opposition was voiced at the hearing.
Upon a motion made by Mr. Frizelle and seconded by Mr. Foulds; the
Board voted unanimously to grant the Special Permit with the con-
dition that there be a parking area -in the rear of the building
to accommodate --six (6) cars to .be hottopped or paved and that the
parking area -be created :befo_r-e.the building permit -t -o convert the
dwelling is issued...

The Board finds that Section 10.31 of the Zoning By Law has been
satisfied._ Specifically; the Board finds that the.site is an
appropriate location for a three family dwelling, since there
are other three family dwellings in the -neighborhood -a-nd ample
parking will be provided; the use as developed will not adversely
affect the neighborhood; there will be no nuisance or hazard to
vehicles or pedestrians; adequate and appropriate facilities will
be provided for the proper operation of the proposed use; and
the -use is in harmony with the general purpose and intentof the
Zoning By Law.

Enclosed please find a corrected legal notice concerning the
Special Permit application of Allen Deary and James Lanagan
who are requesting permission to convert a two family dwelling
to a three family dwelling on premises located at 144-146
Waverly Road.
The notice you received in the mail contained an incorrect date
for the Board's meeting. The meeting will be held on Monday
evening, September 19, 1983 at 7:30 p.m. in the Town Office
Meeting Room. The enclosed legal notice reflects this correction.
We apologize for any confusion this error may have caused.

including the proposed additional unit. There is also a large
back yard providing recreational space.
'The time and money spent revitalizing the house will in turn aide
the neighberhood in general.

Enclosed are three (3) legal notices for publication on Sep-
tember 1 and 8, 1983.
You will notice that there is a corrected notice for Allen
Deary and Jamas Lanigan. The previous notice which was pub-
lished on August I8 and 25, 19.83 contained an incorrect date
for the.2oard of Appeals meeting. In checking my records,
I find that both the Citizen and Myself made _mistakes on this
notice. 'I typed September 12, 1983 and the Litizen printed
August 12, 1983. As you can see, the correct dente for the
meeting is September 19, 1983.
Please forward the bi4l for this corrected notice to the
Zoard of Appeals office. I have already notified the applicants
that they will not be responsible for this error.
