Daniel Long , Town Clerk Town Office Building North Andover , Mass . 01845 Dear Mr. Long : The Board of Appeals held a public hearing on Monday evening , February 8 , 1982 upon the application of Phyllis V. Jackston . The hearing was advertised in the North Andover Citizen on January 21 and 28 , 1982 and all abutters were notified by renular mail . The following members were present and voting : Frank Serio , Jr.. , Chairman ; Alfred E . Frizelle , Esq . , Vice- Chairman ; Richard J . Trepanier , Esq . , Clerk ; Augustine W-. . Nickerson ; and Walter F . Soule. The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7 . 3 and Table 2 of the Zoning By Law to allow the con- tinued use of a single family dwelling with less than the required front and side set backs on the premises located at 145 Beverly. St. The petitioner testified , through counsel , that the dwelling was constructed in 1958. In 1959 , area and frontane variances were granted , but the set backs were never addressed. The violations were recently discovered through the conveyance- of the property . Upon a motion made by Mr. Frizelle and seconded by Mr . Nickerson , the Board voted unanimously to grant the variance as requested . Phyllis V . Building is 21 feet from road and a 4 ft. variance is require and on one side, a 1.5 foot variance is required. B. Book Page The principal points upon which I base my application are as follows : ( Must be stated in detail ) The premises were erected in 1958, and a variance was previously allowed for the area and frontage. However, no set back variances were granted, and there is a severe hardship in that the owners cannot sell the home unless the setback variances are allowed. These forms shall be furnished by the clerk upon request . Any communication purporting to be an application shall be treated as mere notice of intention to seek relief until such time as it is made on the official application form .
