The Board of Appeals held a regular meeting on Tuesday evening February 14, 1995 upon
the application of Rodney and Kristen Hollenbeck requesting VARIANCES from the
requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaws and a
SPECIAL PERMIT under Section 9 Paragraph 9.2(1) of the Zoning Bylaws. The
applicant is requesting two variances so as to permit relief of 4.5 feet for the required side
line setback of 30 feet, and 5 feet for the required front line setback of 30 feet. The
applicant is also requesting a special permit to extend a legal non-conforming structure
located at 145 South Bradford Street. The following members were present and voting:
Raymond Vivenzio, Walter Soule, Joseph Faris and Scott Karpinski.
The hearing was advertised in the North Andover Citizen on January 25 and February 1,
1995 and all abutter were notified by regular mail.
Upon a motion by Mr. Pallone and seconded by Mr. Vivenzio the Board voted
unanimously to GRANT the VARIANCES as requested.
The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph
10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect
the neighborhood or derogate from the intent and purpose of the Zoning Bylaw.
Upon a motion by Mr. Pallone and seconded by Mr. Vivenzio the Board voted
unanimously to GRANT the Special Permit as requested.
The Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.1
of the Zoning Bylaw and that such change, extension or alteration shall not be
substantially more detrimental than the existing non-conforming use to the neighborhood.

The Board of Appeals held a regular meeting on Tuesday evening
February 14, 199" upon the application off Rodney and Kristen
Hollenbeck reaues--ing a VARIANCE from the requirements of Section
7, Paragraph 7 .3 and Table 2 of the Zoning Bylaws and a SPECIAL
PERMIT under Section 9 Paragraph 9 . 2 (1) of the Zoning Bylaws so
as to pe=:nit relief of 4 . 5 feet from the required setback, 25 . 5 '
from the lot line, in order to alter and extend a non-conforn«ng
legally existing structure located on 145 South Bradford Street .
The following members were present and voting : Raymond Vivenzio,
Walter Soule, John Pallone, Joseph Faris and Scott Karpinski .
The hearing was advertised in the North Andover Citizen on
January 25 and February 1, 1995 and all abutters were notified by
regular mail .
Upon a motion by Mr. Pallone and seconded by Mr. Vivenzio the
Board voted unanimously to GRANT the Variance as requested.

Applicants are requesting a special permit and variance to allow
the structure to remain 25. 5 feet from the lot line. 30 feet is
required in Zoning District R-1. A three room addition will be
added onto the house. It was clarified that the Public Notice
contained a typing error. The structure will exist 25. 5 feet from
the lot line, 4 . 5 feet of relief is needed.
Walter questioned opposition or favor to the proposal. The
applicants will be tying into sewer.
Motion by John Pallone to GRANT the variance and special permit to
allow the structure to remain 25.5 feet from the lot line, seconded
by Ray Vivenzio. Unanimous. Voting in favor: Ray Vivenzio, Walter

Applicants are requesting a special permit and variance to allow
the structure to remain 25.5 feet from the lot line. 30 feet is

added onto the house. It was clarified that the Public Notice

the lot line, 4 . 5 feet of relief is needed.
