Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ;
June 8 , 1981 upon the application of Atty . John F. McGarry .
The hearing was duly advertised in the North Andover Citizen
on May 21 and 28 , 1981 , and all abutters were notified by
regular mail . The following members were present and voting :
Frank Serio , Jr . , Chairman ; Alfred E . Frizelle , Esq . , Vice-
Chairman ; Richard J . Trepanier , Esq . , Clerk ; Augustine W .
Nickerson ; and Maurice S . Foulds .
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7 . 3 and Table 2 of the Zoning By-Law to enable the
construction of a garage having less than the required front
set-back on Chestnut Court , on the premises located at 147
Chestnut Street .
The petitioner introduced evidence showing that the garage will
not conform to the front set-back requirement on Chestnut Court
because of the corner lot requirements of the Zoning By-Law .
The variance would not be necessary if the lot was not on a
corner .
Upon a motion made by Mr . Frizelle and seconded by ` Mr . Trepanier ,
the Board voted unanimously to grant the variance as requested .
Thb Board finds that each of the provisions of Section 10 . 4 of the
Zoning By-Law nave been satisfied and that the granting of the
variance will not derogate from the intent and purpose of the By Law .

The principal points upon which I base my application are as follows: (must be stated in
detail). Our existing garage was built almost 50 years ago and is tco small for
contemporary cars, bicycles and other necessary storage. It is also in need of
extensive repair. The existing driveway fronts on busy Chestnut Street at the
intersection of Chestnut Court and the Happy Hollow Condominium entrance, wcrea s --
a hazardous condition when backing cars out of the driveway on to Chestnut Street.,
and especially with our children exiting and entering on their bicycles.
Therefore, we would like to replace the old garage, with a new larger garage,
fronting on Chestnut Court, which would eliminate the hazardous traffic condition.
The new garage would also be consistent with e style o e o er newer garage
on Chestnut Court, and would not derogate from the intent of the zoning by-laws.
I agree to pay for advertisin in newspaper and ' cidental expenses. *

Every application for action by the Board sha�l be made on a form approved by the Board.
These forms shall be furnished by the clerk upon request. Any communication purporting
to be an application shall be treated as mere notice of intention to seek relief until _
such time as it is made on the official application forma All information called for by
the form shall be furnished by the applicant in the manner therein prescribed.
Every application shall be submitted with a lit of "Parties in Interest" which list
shall include the petitioner, abutters, owners of land directly opposite on any public
or private street or way, and abutters to the abutters within three hundred feet of�the
property line of the petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner. is located in another city or town,''Ahe
Planning Board of the city or town, and the Planning Board of every abutting. city or town.
* jEvery application shall be submitted with an application charge cost in the amount of
$25.00. In addition, the petitioner shall be responsible for any and all costs involved
�. in bringing the petition before the Board. Such costs shall include mailing and publi—
,cation, but are not necessarily limited to these.

I have the following comments to make on petitions

1. Salvatore Marchese: Mr. Marchese was refused a building
permit because the garage would be closer to the lot line
than is required by the Zoning By—Law.
jJohn McGarry: . McGarry was refused a building permit
