A site visit conducted on January 4 , 1991 revealed the following
conditions:
1. Front slope shows evidence of extreme erosion
amd does not have any type of stabilization.
2 . Hay bales are not staked and improperly placed
behind filter fabric screen.
3 . Silt erosion has collapsed the filter fabric
screen. The silt is running down the street
and into the lowlands at the foot of the roadway.
It is my opinion that the property owner has not complied with
the December 22 , 1990 deadline of the Zoning Board of Appeals.

The Board of Appeals held a Special Meeting on Monday evening, December 17, 1990
continued from December 11, 1990 upon the application of Harry Manzi requesting a
Special Permit modification from the requirements of Section 5.5, Paragraph 2 of
the Zoning Bylaws so as to permit the removal of 22,000 cu. yds. off Lot 25 ,
Coventry Lane. This would make a 25' setback now instead of the original 50'
granted by petition 88-89 issued on February 13, 1990. The following members
.were present and voting: William Sullivan, Vice-chairman, Walter Soule, Clerk,
Raymond Vivnezio and Anna O'Connor.
The hearing was advertised in the Lawrence Eagle Tribune on November 26, 1990
and December 3, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the Special Permit modification in accordance with the
plans dated December 14, 1990 showing a 25' setback replacing original 50' set-
back for rear lot line, subject to the following conditions:
1. Soil erosion controls be installed on the rear slope in
accordance with the requirements of the Building Inspector
and North Andover Conservation Administrator, within 30
(thirty) days.
2. Felled trees at the top of the slope are to be removed
from the property within thirty (30) days.

Dear Mr. Cote:
The Board of Appeals held a regular meeting on Tuesday evening, December 11,
1990 at which time they discussed the erosion control problem at 148
Coventry Lane.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Sullivan, the Board
voted, unanimously, that the entire bond money be seized, due to gross
non-compliance with the conditions of the earth removal permit by the
petitioner, unless all erosion controls required by both the Building
Inspector and the Conservation Administrator are in place no later than
December 22, 1990.
The Board would appreciate your prompt attention to this matter.

RE: Cote & Manzi, Request to modify a Special Permit.
148 & 136 Coventry Lane.
During a recent site inspection to both of the above referenced
locations I had several concerns which I would like your board to
address.
The slopes along the front of both properties are unstable and
eroding. In construction of the slopes along the rear of the
property a large pile of unused fill has been placed along the
top of the hill.
Due to severe erosion problems which have already occurred on
site I would recommend that any modification granted by your
board include the following conditions:
1. The applicant will be required tolace proper erosion
control devices P P
Ices as directed by the Conservation
Administrator. These erosion control devices shall be in
place within two (2) weeks of the issuance of this Special
Permit modification.
2 . The applicant shall be required to remove any unused fill
material from the siterior to the he issuance of a
Certificate of Occupancy.
3 . Any problems which arise with regard to erosion, and its
impact on the roadway or surrounding properties, shall be
addressed withoOseven (7) days. Should the applicant fail to
address the problem in that time frame the Board shall have

the option to use the he $2,000.00 posted as security against
erosion.
I am sure your board is aware of the ongoing problems associated
with both of these sites and I hope you find these conditions to
be useful. I would not recommend that your board release any
} security being held for erosion until an Occupancy Permit has
been issued from the Building Inspector.

concerns.

I have recently inspected the condition of Lots 25 and 26
Coventry Estates as part of a general inspection of the entire
subdivision. The work on these two lots, as well as many others
in the subdivision, has been poorly managed for some time. Soil

erosion and siltation continues to wash down the street, clogging

catch basins and undermining the roadway and driveways.
In the interest of public health and safety, I hereby
recommend that you contact those individuals holding the earth
removal permit and begin the procedure to seize the bond. Please
contact the Town Planner if you have any questions regarding the
procedure as the Planning Board has been through this process.

RE: Cote & Manzi, Request to modify a Special Permit.
148 & 136 Coventry Lane.
During a recent site inspection to both of the above referenced
locations I had several concerns which I would like your board to
address.
The slopes along the front of both properties are unstable and
eroding. In construction of the slopes along the -rear of the
property a large pile of unused fill has been placed along the
top of the hill.
Due to severe erosion problems which have already occurred on
site I would recommend that any modification granted by your
board include the following conditions:
1. The applicant will be required to place proper erosion
control devices as directed by the Conservation
Administrator. These erosion control devices shall be in
place within two (2) weeks of the issuance of this Special
Permit modification.
2 . The applicant shall be required to remove any unused fill
material from the site prior to the issuance of a
Certificate of Occupancy.
3 . Any problems which arise with regard to erosion, and its
impact on the roadway or surrounding properties, shall be
addressed withi0seven (7) days. Should the applicant fail to
address the problem in that time frame the Board shall have
the option to use the $2, 000. 00 posted as security against
erosion.
I am sure your board is aware of the ongoing problems associated
with both of these sites and I hope you find these conditions to
be useful. I would not recommend that your board release any
security being held for erosion until an Occupancy Permit has
been issued from the Building Inspector.
