NORTH ANDOVER Zoning Board of Appeals, hereby certifies that the following is a detailed record of
the board's proceedings and decision regarding the above captioned application regarding the property
located at Map='030.0' and Block='0008'which property is affected by this decision.
The above captioned application requests a(n)Variance from 7.3 of the North Andover Code to allow
Variance from 7.3&Table 2 for.
A True copy of the application is on file in the Office of the City Clerk.
A notice of public hearing on this application, a true copy of which is on file in the office of the City Clerk
was:
1. Published in the Eagle-Tribune, a newspaper of general circulation in the North Andover on ...

2. Posted in a conspicuous place in the North Andover on ...which was at least days prior to the
hearing; and
3. Mailed, postpaid on ...,which is at least days before the hearing,to the petitioner, abutters,

abutting municipalities. The notice was mailed to the names and addresses shown on the most

Dear Ms. Venske,
Upon your request for information on the above-mentioned site I have reviewed
the folders for this site and have found the following information.
1) In July of 1980 a variance was granted for front setback on a vestibule.
2) The property is located in the G-B (General Business) district of which the
requirements are 25000 square foot lot size, 45 foot height maximum, 25 foot front
and side setbacks and 35 foot rear setback. The side and rear setbacks must be
increased 15 feet when abutting residential districts
In closing by virtue of the placement of the structure on the property the property is
considered pre-existing non-conforming and as such any exterior additions or alterations
would require a special permit through the Zoning Board of Appeals.

A public hearing was held by the Board of Appeals on September 15, 1980
upon application of the Arlington Trust Co. The following members were
present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq.; i
William J. Sullivan; Augustine W. Nickerson; and Associate Members Walter F.
Soule; Maurice S. Foulds; and Raymond A. Vivenzio, Esq.
The hearing was advertised in the North Andover Citizen on July 24 and 31,
1980 and all abuttors were duly notified by regular mail.
The petitioner seeks a variance from the provisions of Section 7.3 and Table 2
of the Zoning By—Law to enable it to construct an addition to the structure
at 149 Plain St.
The petitioner testified that the variance is necessary because the existing
structure does not meet the front set—back requirements of the By—Law. It
is proposed to construct a vestibule for the purpose of conserving energy and
customer service.
On a motion made by Mr. Sullivan and seconded by Mr. Nickerson, it was voted
to grant the variance as requested. In granting the variance, the Board finds
that all of the provisions of Section 10.4 have been satisfied. Specifically,
the Board finds and makes note that in the downtown section of Plain Street all
of the dwellings and structures fail to meet the set back requirements of the
By—Law. The variance as granted will not detract from the intent and purpose
of the By—Law nor will it be a detriment to the neighborhood or zoning district.

The Board finds that to deny the variance would be a financial hardship to
the petitioner. Further, the Board finds that the unusual location of the
structure on the parcel of land makes it unique and requires that the variance
be granted.

_-r our letter dated July 30, 1980 regarding the
liTt=rt�a parry, I would like to remind the Board that
{ I have not received any data from the Arlington Trust Company
or tle Board of Appeals in regard to an expansion of the facilities.
I would like to take this opportunity to recommend that the Arl-
ington Trust Company make some revisions in regard to their drive
up window. In the past there have been problems created when sev-
eral vehicles were in line at the window causing traffic to back
up on Second Street and creating a dangerous condition. If a rep-
resentative from the bank would come to my office, I would be more
than happy to discuss this problem with them.
In this' situation, where a possible police problem exists, I do
not feel that any permits should be granted until the Police De-
partment has been consulted by the parties concerned.

tion of the drive up window which will alleviate the present traffic problem which
this window is now creating.
