The Board finds that owing to circumstances relating to the shape of 15 Ironwood Road,specifically,the street frontage slants inward towards the left side setback and existing structures block an addition within the setbacks on the other side of the garage. The Board finds that these circumstances especially affecting this land and residential structure but not affecting generally the Residential I zoning district in which it is located,a literal enforcement of the provisions of Paragraph 7.3&Table 2 would involve substantial hardship,financial or otherwise,to the petitioner. The Board finds that all Ironwood Road abutters signed the November 10, 2005 petition in favor of the proposed addition and that there was no written or spoken opposition. The Board finds that the 3d stall will remove the need for on-street parking. The Board finds that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the North Andover Bylaw. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local, state,and federal building codes and regulations,prior to the issuance of a building permit as required by the Building Commissioner. Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it shall lapse,and may be re-established only after notice,and a new hearing. To the best of my knowledge there exists no particular and or unusual circumstances relating to soil conditions, shape or topography which would effect the variance sought. C. The substantial hardship claimed is that of having vehicles that exceed the type of garage presently in use. Currently, a two-car garage that fits only one of our cars because it is impossible to enter and exit our home if the second car is in the garage. Further,the existing slope of the driveway causes vehicles to"bottom out"on a continual basis.
