Description:
Complaint' Received a call from tenant,Brian Griffin,617.850.5373. He has been in this ground level apartment for almost a year in October. They went away for the weekend
and came back,and there was mold in bedroom,personal items,closets,etc. R.C.maintenance came to the apartment and conducted a moisture reading which
registered at 86%. Royal Crest said that they would move the family out temporarily while they work on the apartment. He does not know yet when this might be.

Materially Impair Your Health or Safety
Under the state sanitary code, the following violations are considered conditions that
may"materially endanger"the health of you and your family. (You can find these in the
Massachusetts Code at 105 C.M.R. §410.750) If you or the local board of health has notified
your landlord of these violations,you may legally withhold all or a portion of your rent.

Conditions That Must Be Fixed Within 30 Days

Your landlord must repair or provide the nems and services listed below within 30 days of
being notified that there is a problem. If these problems are not fixed, they become conditions
that "materially endanger" the health and safety of you and your family and you may withhold
all or a portion of your rent.
Kitchen
O Sink must be large enough to wash dishes, 410.100,
get hot and cold water, and have proper 410.350
drainage.
O A stove and oven must be provided in good 410.100
working condition (unless written agreement
requires tenant to provide these).
O All sinks, owner-installed refrigerators and 410.351
stoves, and gas- and oil-burning equipment
must be kept in good working condition.
O At least one working light fixture and 410.251
two wall outlets must be provided.
O Floors must be smooth,non-corrosive, and 410.504
waterproof. Carpeting and wooden floors are
permitted as long as the carpeting has a nonabsorbent
and water-repellent backing and wooden floors
have a water-resistant finish and no cracks.
O Must have space and proper facilities for 410.00
the installation of a refrigerator.
Bathroom
O One toilet, free from defects, must be provided 410.150(A)(1)
in a room not used for living, sleeping, cooking
or eating.
O One wash basin, free from defects, 410.150(A)(2)
must be provided.
O One shower or bathtub, free from defects, 410.150(A)(3)
must be provided in a room not used for living,
sleeping, cooking or eating.

O Each room that contains a toilet,bathtub 410.150(A)(4)
or shower must have a closable door.
O One electric light fixture, in good repair, 410.252
must be provided.
O Adequate ventilation(see section below) 410.280
must be provided.
O Floor and walls, to the height of four feet, 410.504
must be constructed of nonabsorbent,
easily cleanable material.
Water
O There must be enough water,with adequate 410.180
pressure, to meet your ordinary needs.
O There must be enough hot water at a temperature 410.190
between 110 and 120 degrees, with adequate
pressure, for your ordinary use,unless a written
lease requires you to provide it.
O The water heater must be vented to a chimney 410.202
or duct leading outdoors (unless the heater
is electrical). Old-fashioned open-flame water
heaters are illegal.
O The toilet,wash basin, kitchen sink, shower, 410.350
and/or bathtub must be properly connected
to the drain line.
O The landlord must provide and pay for water G. L. c 186,
and may bill a tenant for water and sewer only §14, and
if the tenant moved into the apartment on or after 410.180
March 16, 2005 and if the landlord has:
1. Installed and is maintaining a water submeter
that measures water going only to your unit;
2. Installed low-flow water conservation devices
on all showers, faucets, and toilets in your unit;
3. Described in detail in a written rental agreement
the water billing arrangements between you and
the landlord(because the landlord is the"customer"
and responsible for paying the water company,
which in most cases is a local municipality); and

4. Filed a certificate with the local board of health
or agency responsible for enforcing the State
Sanitary Code that your unit is in compliance
with the law. (The Department of Public Health
requires landlords to give you a copy of the
certificate with your written rental agreement
prior to occupancy.)
O A landlord must also allow you access to 410.354(E)
any water submeters that affect your unit
so that, if you need to,you can have the
accuracy of the submeter checked.

Heat
From September 16 to June 14, the landlord must provide
facilities to heat every room(including bathrooms) to at least:
O 68 degrees Fahrenheit between 7 a.m. and 11 p.m. 410.200-201
O 64 degrees Fahrenheit between 11 p.m. and 7 a.m. 410.200-201
O Heating equipment must be provided and 410.351
maintained in good working order.
O Space heaters must be vented to a chimney or 410.202
vent leading outdoors (unless the heater is
electrical).
O The landlord must provide and pay for heat 410.201
unless there is a written agreement requiring
tenant to pay for heat.
O The temperature must not exceed 78 degrees 410.201
at any time during the heating season.
Ventilation and Light
O Every room must have either windows, skylights, 410.280
floors, or transoms in the exterior wall or roof
that can easily be opened to measure a minimum
area of 4% of the floor area of that room;
OR adequate mechanical ventilation systems.

O Each room(except a kitchen smaller than 410.250(A),
70 square feet, or a bathroom)must have 410.257
transparent or translucent glass that admits light
from the outdoors and which is equal in area to
no less than 8% of the floor area of that room.
Glass obstructed by an outside structure less than
3 feet away does not count toward meeting this
requirement.
O In larger buildings (10 or more units)there 410.483
must be an emergency lighting system
in the halls and at exits.
Electricity, Wiring, and Gas
O The landlord must provide and pay for 410.354
electricity and gas unless the tenant's apartment
is individually metered and there is a written
rental agreement requiring the tenant to pay.
O Electrical service must provide sufficient 410.255
amperage to meet the reasonable needs of
the occupant.
O For each room other than the kitchen and 410.250
bathroom, either two separate electrical outlets
or one electric light fixture and one wall outlet
must be provided.
Electric light fixtures must be located so that light
will be available for the safe and reasonable use of-

Sufficient lighting must be provided in all parts
of the house, including:

O Interior passageways. 410.254
O Hallways. 410.254
O Stairways. 410.254
O Wiring must not pass under rugs or other 410.256
floor coverings, or through doorways.
O Temporary wiring may not be used(but extension 410.256
cords to portable appliances or fixtures are OK).
O Buildings with 10 or more units must have an G.L. c. 143,
auxiliary emergency lighting system independent §21D
of the conventional system.
Safety
O There must be at least 2 exits from each apartment, 410.450
more if necessary for"safe passage of all people."
O Exits for more than one unit must be kept free 410.451
from obstruction.
O All exits shall be safe, operable, and kept free 410.452
of ice and snow.
O Fire extinguishers must be properly located 527 C.M.R.
as required by the local fire chief. §10.02
O There must be locks on all operable exterior 410.480D,E
windows and entry doors.
Buildings with more than three apartments must have:
O A main front door that closes and locks 410.480C
automatically.
O Locks on all other entry doors in common 410.480B
areas.
O Buildings over 70 feet high must have an G.L. c. 148,
automatic sprinkler system(Building Code). §26A

O Landlords must maintain all pipes, oil- and 410.351
gas-burning equipment,and electrical equipment
so that it is free from leaks, obstructions, and
other defects.
O Buildings with 10 or more units must have G.L. c. 143,
lighted signs indicating both a primary and §21D
a secondary means of exit by diagram.
O Most buildings must be equipped with smoke 410.482
detectors in good working order.
Structural Maintenance
O The landlord must maintain the property"in good
repair and in every way fit for the use intended."
O Foundations must be weathertight, insectproof, 410.500
and rodentproof.
O Floors must be free of holes, cracks, loose mortar 410.500
or other defects.
O Interior walls must be free of holes, cracks, 410.500
and loose plaster, and must be cleanable
and weathertight.
O Exterior walls must be free of holes, cracks, 410.500
warping, loose or rotting boards, or other
hazardous conditions.
O Ceilings must be free of holes, cracks, and 410.500
loose plaster, and must be cleanable and
weathertight.
O Doors and windows must be weathertight. 410.501
O Roof must be free from holes and cracks, 410.500
and must be weathertight.
O Chimneys and other structural elements 410.500
must be in good repair.
O Staircases must be stable with a handrail or 510.500, 503
bannister if the stairs rise 30 inches or higher.

O Handrailings must be at least 3 feet high and 410.503
are required on every porch,balcony or roof
over 30 inches above the ground and used by
tenants.
O Every dwelling unit must have at least 410.400(A)
150 square feet for the first occupant and
100 square feet for each additional occupant.
General Maintenance
O The landlord must maintain common areas in 410.602(D)
a clean and sanitary condition.
O Apartment must be kept weathertight 410.500, 501
and in good repair.
O An absentee landlord must(unless a 410.481
manager/agent lives in the building)keep
a sign at least 20 square inches inside the
building giving the name, address, and phone
number of the landlord or his/her agent.
O A landlord may not turn off or interfere with 410.620
a tenant's water, hot water, heat, light,power,
gas, or telephone service, except as necessary
for repairs (for which landlord may temporarily
shut off utilities if tenant is given"reasonable
notice."
O In buildings with three or more units, there Fed. Postal
must be one Federal Postal mailbox per apartment, Regs. A(1)a,
and it must be kept locked and maintained in E(l, 2, 4)
good repair.
O Screens are required on all doors and windows 410.551
that open to the outside.
O Exterior stairways must be kept free of snow 410.452
and ice.
The following equipment and facilities must be maintained
so that they are properly installed and free of leaks, obstructions,
and other defects:
O Water-heating facilities, gas pipes, 410.351
heating equipment, and water pipes.

O Landlord-installed equipment, including stoves, 410.351
ovens, dishwashers, clothes-washing machines,
dryers,refrigerators and garbage grinders.
O Catch-basins,vents, drains, and all other similar 410.351
fixtures supplied by the landlord.
O Connections to the water, sewer, and gas lines, and 410.351
to the subsurface sewage disposal system,if any.
O All electrical fixtures,outlets, and wiring. 410.351
O All heating and ventilation equipment. 410.351
Rats and Roaches
O No rats or roaches or other insects are allowed 410.550
in the apartment or building. The landlord must
exterminate them when they are found in common
areas or in any individual apartment.
Garbage
O In buildings with three or more units,the landlord 410.600
must provide enough watertight garbage cans with
tightly fitting covers "to contain the accumulation
before the final collection."
Lead Paint
O No lead paint may be used inside apartments. 410.502
O Existing lead paint must be removed or covered G.L. c. 111,
by the landlord if you have a child under the age §197
of six. This must be done up to a height of five
feet from the floor level. Repainting with a
non-lead paint is not good enough.

C Air Duct Services will install engineering controls within regulated work area(s)
consisting of 6 mil.Poly sheeting at all openings.
e Air Filtration Devices(AFD's)equipped with HEPA filters shall be installed within
regulated area to establish a negative air environmental and provide air
filtration/scrubbing. The negative air ventilation will be adwated to the nearest
opening leading to the outside of the building. These machines will run throughout
the entire project.
Once engineering controls are in place and negative air is established,Air Duct
Services will commerce with the demolition and surface disinfection of the mold-
impacted areas as specified.

All Air Duct Services employees used on this project will be involved in a medical
surveillance program in accordance with 29 CPR 1926.1101 and 29 CFR 1910.120. Air
Duct Services employees will follow the Respiratory Protection outlined in 29 CFR
1910.34.
Our employees are also required to attend training and safety course covering the hazards
involved with working with mold abatement exposure,safety,and health precautions,the
use and requirements of protective clothing,equipment and respirators in accordance to
29 CFR 1910.34. In addition all workers will be trained in accordance with the United
States Environmental Proctection Agency 40 CFR,part 763 ARRA Model
Accreditation Guidelines.

transported and disposed of as"Sanitary Waste to a Municipal Solid Waste landfill, It is
understood that Air Duct Services is not the generator of the Waste.
PROJECT SCREDULE:
It is understood that work will commence within 48 hours upon receipt of your
authorization to proceed, Work will be continuous until receipt of suable post
remediation air sampling results. Air Duct Services will perfonm the described Scope of
Work,working normal business hours(8-hour shifts):
EXCLUSION AND CLARIFICATION ;
• Owner to provide all utilities,water,electric and restroom facilities required to
accomplish this work at no additional cost to Air Duct Services.
Air Duct Services assumes flee and clear access to the premises during the scheduled
work periods.A designated Owner representative will coordinate access/egress to the
building.
Air Duct Services does not warranty any mold remediation project to be mold free.
• No delays interfering with the diligent execution of the work beyond Air Duct
Services control will be encountered, If such delays are encountered,additional
compensation may be acquired.
This proposal is valid for 30 days.
Air Duct Services is not responsible for any reoccurrence of mold growth once we
have met the scope of this proposal.

This letter consists of a visual inspection'of Mold for the above locations.
Air Duct Services performed the following procedures for Mold inspection.
• In unit#4 visible mold was noted on building material and contents
throughout unit,shectrock and ceilings appears to be surface mold.
• Removed test areas of sheetrock along exterior walls(6)and inspected behind
walls and wall cavities no mold visible behind walls.
• Master bathroom showed shower the walls with missing grout allowing water
to penetrate to shed rock behind.Wall Paper had email amount of visible
mold.
• Building 3 wait 4 master bathroom shower has weakened tile walls within the
shower sten allowing water to penetrate to building material.
• In summarization,Air Duct Services is confident that the Mold is primarily
surface mold with the exception of the 2 master bathrooms shower stalls and
is caused by moisture within the unit and scot by water intrusion
