Respectfully, Michael McGuire Local Building Inspector i From: Ravi and Sarita Kanjolia, 150 Old Farm Road North Andover, MA 01845 Date: August 14, 2003 Detailed explanation of the variance request (Section 5) Special note: The requested variance has already been permitted by the zoning board last year (see attached copy). The reason for the re-application is the expiration of the variance as per MA General Laws 40A (see attached letter from the town). Hence we are re-applying for the variance. We request a speedy pproval from the board so that we can complete the work before the snow arrives. The property located at 150 Old Farm Road has a lot size of 219,191 square feet. Currently, the house on the lot is situated in a very tight space using only <0.5% of the lot. The dimensions of the existing structure house are 34"x26". On the left side, the house is limited by a 30' sewer easement to the town, in the back it complies with the wet land laws, and on the right is in compliance with the set back of 30' as per R-2 zoning district. The house is a standard colonial with a two car garage underneath. The driveway leading to the garage has a steep slope with no room to turn around (see pictures). Only one car can be parked inside the garage. There is not enough space on the driveway to turn the second car in the garage. The problem is further compounded when the New England winter begins. Due to the wind, snow drifts in the valley (driveway) and piles as high as 4-5 feet. We face extreme hardship in the winter with weather causing dangerous condition on our driveway. The retaining wall at the bottom of the driveway makes it difficult to bring even one car down . as the collision potential exists. The driveway is so difficult that even snow plowing trucks refused to remove the snow. You can imagine our plight when heavy snow falls and we can not get any help. The spring rain does not bring any relief to our hardship. All rainwater tends to accumulate at the bottom of the driveway. On occasions, the single drain at the bottom does not keep up with the rain and flooding begins. After discussing with several architects and contractors, the addition of a 10'x24' garage with a 9'x8' hallway to the basement appears to be our only option. This has been also approved by ZBA last year. The garage is set in the rear right of the house with hallway exactly behind the house. This has been agreed upon with the immediate neighbor-Mr. And Mrs. Axelrod and has been approved by the conservation department. The proposed plan involves closing the existing garage, filling the driveway, and building a one car garage at the street level. This requires a variance from the zoning board, as the proposed addition is not within the q g P P 30 setback on the right side. We appeal to the board to grant us the variance of 10 on i the right hand side to provide relief from this extreme hardship. Furthermore, it is our belief that this addition will enhance the aesthetic appeal of the neighborhood, as it will remove the lone unsightly driveway. I appeared with my clients at the hearing scheduled for July 10, 2001 and explained the Axelrods' concerns. The proposed addition will be within 6 feet of the Axelrods' property line in a district that requires a minimum setback of 30 feet. At that hearing it was proposed that the matter be continued so that input from the Town Conservation Commission could be obtained. I was unable to obtain any information from the secretary of the Zoning Board of Appeals prior to the continued hearing. She indicated that the Zoning Board was still waiting for a response from the Conservation Commission. O 12 Farnsworth Street RE: Wetland Delineation Boston,MA 02210 (617)350-7906 150 Old Farm Road Dear Mr. Kanjolia: This letter is in regard to the delineation performed on your property by Hancock Environmental Consultants on January 19, 2001. The delineation was conducted to facilitate permitting of the proposed construction of a garage addition. Fifteen flags, labeled A-1 through A-15,were hung along the edge of a bordering vegetated wetland identified on your subject property. The majority of the delineation is along the toe of fill placed during the development of your lot. Vegetation, soils and hydrologic condition were investigated during the delineation. Dominant vegetation within the identified resource area consists of an overstory of red maple(Acer rubrum), American ehn(Ulmus americana)and birch (Betula spp.). The understory shrub layer-is dominated with highbush blueberry(Vaccinium corymbosum),glossy buckthorn(Rhamnus frangula),elderberry(Sambucus canadensis)and winterberry(Ilex verticillata). The herbaceous vegetation along the boundary of the delineation was difficult to identify due to the approximate one foot of snow cover. A small finger of wetland was flagged behind the house at the toe of fill. The area is identified by flags A-8 through A-12. The area has been disturbed by fill conditions,however wetland hydrologic indicators (groundwater fluxuation indicators,hydric soils and wetland vegetation) were still present to warrant a delineation of the area. A stake was placed within the lawn to display an approximate 50 foot setback from flag A-10. According the North Andover Wetland Protection Bylaw,no structures are allowed within fifty feet of identified wetland resource areas. According to the sketch you presented me, your proposed garage may be within several feet of the 50 foot setback. A topographic survey will be necessary to determine the location of the wetland resource area in relation to the proposed limits of the proposed garage location. The house is a standard colonial with a 2-car garage underneath. The driveway leading to the garage has a steep slope with no room to turn around (see picture). Only one car can be parked inside the garage. There is not enough space on the driveway to turn the second car in the garage. The problem is further compounded when the New England winter begins. Due to the wind, snow drifts in the valley (driveway) and piles as high as 4- 5'. We face extreme hardship in winter with weather causing dangerous condition on our driveway. The retaining wall at the bottom of the driveway makes it difficult to bring even one car down as collision potential exists. The driveway is so difficult that even the snow plowing trucks refused to remove snow. You can imagine our plight when heavy snow falls and we cannot get any help. The spring rain does not bring any relief to our hardship. All rainwater tends to accumulate at the bottom of the driveway. On occasions, the single drain at the bottom does not keep up with the rain and flooding begins. After-discussing with several.architects.and,contractors-the,addition of a' garage ge (see plans)g on the right side of,the.house at the street level is � our only option. The proposed plan involves, closing the existing garage, filling the driveway, and building a 2-car garage at the street level. The other options were ruled out due to the following reasons. 1. We cannot build garage on the left hand side of the house as it is on the sewer easement as well as is within 50' of the wetlands. 2. We cannot build garage in the back as it is within 50' of the wetlands. 3. The proposed addition is beyond the 50' buffer zone (see environmental study letter). However, this requires a variance from the zoning board, as t pl obdd2001 D addition is not with in the 30' setback. We appeal to the board to grant us the variance to provide relief to us against this extreme hardJq� RD OF APPEALS Furthermore, it is our belief that this addition will enhance the aesthetic appeal of the neighborhood, as it will remove the lone unsightly driveway. At that time we were advised of all setbacks as well as the lot to the left of us, Lot l0A was unbuildable. A sewer line crosses the lot which was not on the original site plans. The house at 150 Old Farm Road, even though apposed and was not allowed any variances in 1988-1989, was built to conform to the neighborhood setbacks. During the construction of 150 Old Farm Road, our electrical wiring was dug up whereas it crossed that property underground. This shows that the town knew at the time our home was being constructed that the lot was not going to be developed by issuing an electrical permit at our address. We feel that our home is entitled to and protected by the same minimum setbacks as the rest of the neighborhood being at least 60 feet between each dwelling. A lesser amount will have an effect on our area of the neighborhood as well as a direct effect on our home value. The visual and openness effect would also be destroyed. Therefore we oppose the variance as it is now planned. This hardship was created by the town when it issued a permit for a home that would not be of the same customary layout of the development. This house was built and bought with the full knowledge of the limits of that lot and its current construction. The proposed garage is 2/3 the size of the current dwelling footprint. This increase was not allowed at the time of the construction, and should not be allowed now. The variance is not just for a few feet, it is for an entire 100% of the proposed additional structure. We have no objection to the garage being built on the opposite side of the home, or around the back of 150 Old Farm Road, to allow the 30' setback to the side. We respectfully request the town to protect our property and deny the variance as it is currently written. We believe that a plan can be designed that would allow our neighbor to redesign his home without dramatically effecting the side setback and the space between our dwellings.
