Deveau 101 Amesbury Street Suite 105 Lawrence, MA 01840-0137 Dear Attorney Deveau: On March 23 , 1992 , the Board of Health received a complaint of unsafe and unsanitary conditions from the North Andover Police Department on 1500 Great Pond Road, a property owned by your client Richard Leno, Sr. An inspection of the interior of the premise was conducted by this department in the presence of yourself, Richard Leno, Jr. and Detective Donald Foulds of the North Andover Police Department. The inspection revealed conditions amounting to unsanitary and unsafe conditions. At the time, discussions revealed your clients willingness to cooperate with the Health Department by eliminating the existing violations. To assist you in complying with the requests of this department we scheduled a meeting at the premise on Wednesday, April 1, 1992 with the intent of discussing exactly what measures would be necessary to bring the property into compliance with the State Sanitary Code. Prior to this scheduled meeting, I was presented with documentation from the North Andover Building Department declaring the residence an unsafe structure and required that the building be made safe to the public, i.e. boarded up. Whereby, the premise may not be occupied and orders have not been issued by this department, I am notifying you that the Board of Health has closed this case as the State Sanitary Code does not apply to a residence that is not approved for occupancy. Please be advised that the Board of Health will want to inspect the premise if at some future date plans to occupy the building materialize. Leno Jr 9222 JC 296 Gentlemen : In accordance with the notice required by the laws of the Commonwealth of Massachusetts, this is to provide you with a six month notice necessary prior to the commencement of any court action. While three persons were involved I represent only the above mentioned parties and this notice is limited to the above mentioned two parties . I will make every effort to outline the relevant circumstances so that you can make an intelligent choice of what to do . I also request, that if you do have a question, you reduce it to writing and I will respond . r One Richard A. Leno Sr . , is the record owner of 1500 Great Pond Road, North Andover, MA. Mr . Leno was incarcerated on March 19, 1992 . On March 22, 1992, at shortly after 2 : 00 PM Brandon Depew of Methuen, and one Brandon Hebert and Richard A. Leno Jr . , arrived at the above address for the purpose of finishing the moving, of the personal property, to an apartment that Richard A . Leno Jr . was renting. They were in the process of moving . Very shortly after they arrived the North Andover police, Officers Hillner, Peek and Mosto as well as Inspector Foulds arrived . While Mr . Leno was known to be a resident of the address his comments were . ignored and basically nothing any of the men said made any difference . The three young men were placed under arrest, handcuffed, put in the police cruiser, taken to the police station, booked, and locked up in holding r cells . Their release was obtained around 6 : 00 PM or later after they had been locked up for hours . In the next couple days Inspector Foulds, without any real investigation, took it upon himself to appear at the Lawrence District Court and obtain complaints against each young man for Breaking and Entrying Daytime with intent to commit a felony C266 518, larceny of property over $250 C266 530, and malicious destruction of property over $250 C266, 5127 and trespass on land, dwelling etc. 0266 5120 . Another charge was placed against Brandon Hebert . The young men appealed to the six man jury and a trial was conducted on July 22 and 23, 1992 . Three counts had in fact been dropped by the Commonwealth. While the defendants had made a motion to dismiss all charges the Commonwealth stated to the court that it agreed to drop all but the malicious damage charges as to my clients, and on that one they objected to my motion. The court agreed with the Commonwealth and a trial was necessary. Judge . Sullivan directed a verdict for Richard A . Leno Jr . on the one remaining count of malicious destruction and the jury found Brandon Depew not guilty of the same charge . We now have three innocent young men being . arrested for trespass when the owner has asked them to be on the premises . They are charged with Breaking and Entrying with intent when one of them has keys to every lock on the premises and lives there . They were moving clothing belonging to the owner at his request and were charged with stealing it . They were accused of malicious damage because a police officer was of an opinion, but in court could not express a single solid fact upon which to base his opinion. How the District Attorney's Office could have prosecuted this matter is beyond me and my thirty-five years of practice unless they had an ulterior motive . Previously I had always thought they asked a few questions before proceeding . The police were already within the curtilage when they were requested to leave by a resident and known son of the record owner . They were wrongfully about the premises when they arrested the young men. The building inspector and board of health and dog officer were all called . A tow company was called to tow away the cars . One car was towed from the driveway and one from out of the garage and both were on private property, a number of items were admittedly taken and some were used as evidence while some were not . All was; done without even an investigation or search warrant . 2 1 Had the police conducted a thorough and complete investigation and made a mistake you would have heard nothing more, but such is not the case . Inspector Foulds testified that he made no effort to contact the owner about anything, nor did he talk to the informant, nor did he talk to any of the accused . When asked he Indicated that his entire investigation consisted of what he assumed based upon what he thought he knew. The Commonwealth dismissed all but one count, the judge directed a verdict and the jury took about five to ten minutes to vote the other defendant not guilty. The charges were carried in the local papers and resulted in parents calling to prevent the defendants from associating with their children. Friends ridiculed the defendants . At a 209A hearing in Lawrence District Court Richard A.Leno was called a criminal because of all the charges against him. Other pleadings in other cases have included the charges and allegations against the boys as if already proven. The Leno car was damaged in towing and estimated repairs were $500 to say nothing of towing charges . The animals had to be redeemed from the kennel and one had to be disposed of because of injuries . Personal property of the defendant and Richard A. Leno Sr was wrongfully converted by being taken from the house . The defendants were falsely arrested and wrongfully imprisoned for hours . Whether they were kidnapped by being wrongfully and forceably taken and detained against their will might be a question . As the property has a fence and a wall the police were within the curtilage when they arrested the young men, thus the police might be considered trespassers . They illegally searched the house without a warrant or even trying to get one . They placed all kinds of restrictions and requirements on Richard Leno going upon his own property thus exercising dominion over the property of another under the cloak of authority. Had they not prevented Mr . Leno Jr . from going upon the property who is to say that his presence or actions might not have prevented the subsequent fire that substantially damaged the house . At one point after giving the required notice to the police station officer Peek threatened to arrest Richard A . Leno Jr . and directed him to leave even though he had a prior police OK . 3 The list starts with false arrest, false imprisonment, conversion, malicious prosecution, harassment, violation of clients constitutional rights and goes on and on. The actual damage is not and cannot be assessed at this time . The charges were serious felonies and carried years in prison as a penalty. Needless to say neither of these young men or their families would go through this abuse again for a million dollars . I have prevailed upon Mr . Leno Jr . and Mr . Depew to allow me to temper their demands to $350,000 each. For you additional consideration I also attach a copy of the police report . Much of the report proved to be inaccurate or after the wrongful, search and seizure . What disturbed me the most is the idea that if I or anyone went on vacation, asked my child to get something he or she could easily find himself with numerous criminal charges if I lived in North Andover . The police apparently do what they feel like doing and to hell with the facts . Such tactics belong more appropriately in old Russia than a small New England community. A mistake is one thing but deliberately ignoring known facts to cause or create trouble is quite another . The trail of the real culprits is now very cold and with the evidence of past performance before us I feel safe in saying they will never be caught . This, of course, seriously impairs Mr . THE CALLER TOLD DISPATCH THAT IT SOUNDED LIKE GLASS BREAKING AND THE CALLER STATED THAT 3 MALES WERE OBSERVED GOING INTO THE HOUSE BY WAY OF THE GARAGE. OFF HILLNER, PEEK, AND MOSTO ARRIVED FIRST. WHEN I ARRIVED OFFICER HILLNER INFORMED ME THAT WHEN HE ENTERED THE HOUSE HE OBSERVED ONE OF THE MALES, LATER TO BE IDENTIFIED AS DEPEW, WIELDING A SLEDGE HAMMER IN THE KITCHEN AREA OF THE HOUSE. THERE WERE SEVERAL RED PLASTIC CANS AROUND THE HOUSE THAT CONTAINED GASOLINE. A GENERATOR WAS USED TO GIVE SOME ELECTRICITY WHEN NEEDED. 2 SPACE HEATERS WERE IN AN UPSTAIRS ROOM. A SMALL PROPANE STOVE WAS IN ONE ROOM. THE BATHROOMS HAD BEEN USED BUT DUE TO NO RUNNING WATER THE DROPPINGS INTO THE TOILET BOWLS HAD BUILT UP TO A POINT OF OVER FLOWING IN 2 BATHROOMS. AS WE WENT FROM ROOM TO ROOM TAKING PICTURES WE RECEIVED INFORMATION THAT ANOTHER DOG, BELONGING TO MR L,ENO WAS IN THE NEIGHBORHOOD AND HAD ATTACKED A FEMALE. THIS DOG WAS DESCRIBED AS A ROTWEILLER AND DANGEROUS. AT THIS POINT I REQUESTED AN ANIMAL CONTROL OFFICER AND A PERSON FROM THE N.A. BOARD OF HEALTH TO COME TO THE SCENE.
