Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening, June
10, 1985 upon the application of James Toye . The hearing was
advertised in the North Andover Citizen on May 23 and 30, 1985 and
all abutters were notified by regular mail . The following members
were present and voting: Frank Serio, Jr . , Chairman; Alfred E.
Frizelle, Esq. , Vice Chairman; Augustine W. Nickerson , Clerk;
William J. Sullivan; and Walter- F. Soule.
The petitioner seeks a variance from the provisi )ns of Section 7,
Paragraph 3 and Table 2 of thte Zoning By Law 3o as to permit
relief from the side setback requirement to ally j the continued
existence of a dwelling located at 1505 Great Pord Road .
Mrs . Toye testified that through an engineeri: .g error , the
partially constructed dwelling was placed six fe .t too close to
the side lot line . . She added that it would oe 'ery costly to
relocate the structure .
No oppostion was voiced at the hearing.
Upon a motion made by Mr . FrizelIe and seconded by Mr . Sullivan ,
the Board voted unanimously to grant the variance as requested .

In granting the variance , the Board finds that Section 10. 4 of the
Zoning By Law has been satisfied.
In particular , the Board finds that a literal enforcement of the
By Law would create a substantial financial hardship to the
petitioner and that desirable relief may be granted without
nullifying or substantially derogating from the intent and purpose
of the Zoning by Law .

*Every application shall be submitted with an application charge cost in
the amount of $25. 00. In addition, the petitioner shall be responsible
for any and all costs involved in bringing the petition before the Board.
Such costs shall include mailing and publication, but are not necessarily
limited to these.
Every application shall be submitted with a plan of land approved by the
Board. No petition will be brought before the Boarl unless said plan has
