RE: NORTH ANDOVER-ERB-N93-0186 245 Summer Street Release/Threat of Release at Boston, MA 02108 151 Hillside Road pursuant to M.G.L. c . 21E ATTENTION: Audrey Olmstead Dear Madam: This letter is in regard to a release/threat of release of about 100 gallons of #2 oil at 151 Hillside Road, North Andover, Massachusetts to which the Department ' s Emergency Response Branch Staff person investigated on February 19, 1993 . This release was apparently the result of a line leak from a home heating 275 gallon oil tank. On February 19 , 1993 during the Department ' s initial response to this incident, the Department determined that you were responsible for this release of oil which was impacting the basement of the property house, and notified you accordingly. At that time, you accepted responsibility and hired EnviroCorp. of Marlborough, MA to take all response actions deemed necessary by the Department . As part of the response actions taken relative to this incident , EnviroCorp. has : (1) Removed oil contaminated wooden interior walls . i (2) Removed 8 cubic yards of oil contaminated soil from the sump area. (3) Conducted soil and groundwater sampling for total petroleum hydrocarbons . The results of the remedial actions and assessment were summarized in a August 25, 1993 report prepared for you by EnviroCorp. 10 Commerce Way • Woburn, Massachusetts 01801 0 FAX(617)935-6393 • Telephone(617)935-2160 Recoll Management Co. Page 2 A copy of this report was received by the Department on August 30 , 1993 and reviewed. Although analytical data did document the presence of certain hazardous constituents, total petroleum hydrocarbon levels of up to 3 , 600 pmm, the contamination is limited to approximately one yard of soil and contained within the footing of the foundation of the building and deemed not to pose an imminent nor substantial threat to public health or the environment . In light of these facts relative to the above referenced release/threat of release, no further emergency remedial actions by the Department are anticipated at this time . The Department ' s determination in this matter shall not limit the response actions that might be taken regarding this property in the event that further information comes to the attention of the Department . Should it be found at any time in the future that conditions on the property pose a release/threat of release of oil/hazardous materials subject to M.G.L. Chapter 21E, the Department will exercise its response and enforcement authority accordingly. (508) 686-3812 REPORT OF INCIDENT - 151 HILLSIDE ROAD DATE OF INCIDENT, 2/18/93 REPORT OF FIRE CHIEF WILLIAM V. DOLAN At 16:46 Engine 2 was dispatched to 151 Hillside Rd. for a reported fuel oil spill in that residence. Mr. Ken LaGrasse of Meridith Management company (1-800-722-9052) met the crew of Engine 2 at the scene. After a survey of the scene Lt. Ed Morgan requested that the Chief 'respond. The Chief and the Fire Prevention Officer, Lt. Ken Long, responded in Car 1. Upon arrival the Chief entered the building from the front kitchen area and could smell fuel oil. This odor increased as the Chief proceeded to the lower level of the house. In the basement area fuel oil was found in the sump area to the left rear and wall paneling was stained and smelled of fuel oil. "Speedy dry" , an absorbent, had been spread in areas of the cellar, under the stairs, near the fuel oil tank, and to the rear of the bathroom. The Chief requested that representatives of the Board of Health, Conservation, DPW and the Building Inspector come to the scene. Mr. Perna of the DPW inspected the site while the Chief was present and Mr. Nicetta inspected the site after the Chief had left the scene. The Conservation Administrator and the Board of Health inspected the site on Friday 2/19. The Chief contacted FAWCETT Fuel oil service who had made a fuel oil drop on 2/13/93 . The company confirmed that the drop had been made and that 219 gallons of fuel oil had been delivered to the site and transferred to the fuel oil tank in the basement. At this time the person to which the Chief spoke at the company informed the Fire Chief that they had not done any other work on the site other than the fuel oil delivery. The Chief had left the scene under the charge of Lt. Morgan. After discussion with the Building Inspector, the Fire Department placed a fire watch on the building. This was later removed by the Fire Chief. The Chief had tried to contact the DEP on Thursday evening at 09:00 on Friday (2/19/93) who assigned a field inspector, Mr. Mike Gorassi. Chief Dolan spoke with Mr. Gorassi at 15:05 Friday and was informed that the DEP would be taking charge of the oversight of the cleanup which was to be performed by a private firm. That cleanup firm was ENVIRO CORP and the contact employee,Tom Lubey. ''SMOKE DETECTORS SAVE LIVES'' 2 Prior to this the Chief had conversations with other persons regarding the property. At 09:30 Friday 2/19/93 the Fire Chief spoke to Mr. Richard Pinkham of Robert Fawcett & Sons. Mr. Pinkham related the following to the Fire Chief. On 2/13 an employee of Fawcett entered the basement area and noticed a fuel oil spill on the floor "an 1/8" deep approximately 5-6 gallons" a loose fitting on the fuel line from the tank was also tightened. On Wednesday employees of Fawcett notified the management company of the spill that an appreciable amount of oil was unaccounted for and that approximately 70 gallons was all that was in the tank. This was when they were made aware of the presence of the sump pit. The Fire Chief related his concern that the fire department was not notified upon the initial finding of an oil leak. Mr. Pinkham stated that he did not believe it was required if the spill was under 10 gallons. In accordance with 527 CMR 9 - 9.20 Response to Leaks the spill should have been reported to the Fire Department on Tuesday. If the company was sure of the 10 gallon spill notification then they should have notified the fire department when they discovered that there was only 70 gallons in the tank. The company did not insure as is required in, 527 CMR 4.02 (5) Fuel Oil Delivery, that a permit existed for the site. The company found a problem with the current installation and corrected the problem but did not notify the fire department to have the system inspected. The Fire Chief expressed his concern to Mr. Pinkham about his failure to notify the fire department and his fear that FAWCETT may have done other work in the community without proper notification to the fire department. The Chief also expressed concerns that from his observations and the staining on the wood in the basement that the spill was larger than five or six gallons. The Fire Chief received a call from Mr. Patrick Bodden (1-800-722- 9052 xt 1272) of Meridith Management. The Chief and Mr. Bodden discussed the fire watch of the prior evening and the reasons for it. Mr. Bodden had discussed the situation with Lt. McCarthy who was on duty at Station 1 on the eveMs. Olmstead stated that either Mr. Tom Lubey or Mr. John Weston of ENVIRO Corp. would be going to the site. The Chief related the conversation he had with Mr. Pinkham. The Fire Chief called the State Fire Marshal's Office and spoke to Mr. Wayne Delaney regarding the situation. Mr. Delaney recommended that documentation be sent to the Fire Marshal for review. The Chief will send this report with a request for a review of the situation and the actions of "ROBERT FAWCETT & SONS" actions. The Chief had conversations on Friday 2/19 with Richard Doucette the Conservation Administrator, Karen Nelson- Director of the Community Development and Planning, Robert Nicetta, building inspector and George Perna, DPW director regarding the situation. All town departments requested by the Fire Chief, responded and investigated the scene. s 3 The Chief notified all town agencies involved through their department heads that the DEP had taken charge of the scene for cleanup and that they would be at the site on Monday 2/22 at 11:00 A.M. should they want to speak to DEP representatives.
