In that letter I stated that I was not in favor of having the shed located directly behind our house. Since that time I was contacted by Jay Toye to discuss the size and height of the shed. I would now not object to the location of the shed as long as the existing fence is extended three sections or 24 feet behind the shed (perpendicular to the current end of the existing fence). The following members were present and voting: Mr. Soule, Mr. Karpinski, Mr. Pallone, Mr. Vivenzio and Mr. Faris. Mr. Sullivan was present but not voting. The hearing was advertised in the North Andover Citizen on December 21 and 28, 1994 and all abutters were notified by regular mail. Upon a motion by Scott Karpinski and seconded by Raymond Vivenzio, the Board voted unanimously to GRANT the variances as requested with the following condition: The existing fence shall extend three sections or 24 feet behind the shed as requested in a letter by Mr. Gary Wilkinson dated January 4, 1995. SCOTT SSAcNuse Director September 18, 1996 Ms. Joyce Toye 1511 Great Pond Road North Andover, MA 01845 Dear Ms. Toye: A complaint has been filed that you have not complied with the Zoning Board of Appeals Decision 9001-95, dated January 20, 1995 which allowed you to construct a 12 ft. by 12 ft. wooden shed within five (5) feet of the front and side lot lines. The Decision also stated that the existing fence shall be extended twenty-four (24) feet perpendicular (behind the shed) to the existing fence. Investigation proves a true complaint as the fence has not been erected. You have thirty (30) days from receipt of this notice to erect the fence, as stipulated in the Zoning Board's Decision. Section 10.13 of the North Andover Zoning By-Law states the following: "Whoever continues to violate the provisions of this Bylaw after written notice from the Building Inspector demanding an abatement of a zoning violation within a reasonable time, shall be subject to a fine of three hundred Dollars ($300.00). I only agreed to this petition if the existing fence was extended 24 feet. The shed was build in the spring of 1995. The fence has yet to be erected. I understand that if I do no protest the fact that the fence has not been erected within two years of the above date, the fence does not need to be erected.
