Dear Mr. Murphy,
I am writing in regards to a piece of land I own on Great Pond Road ( Parcel A )
in North Andover.
There has been a considerable amount of confusion concerning the land as well
as a substantial monetary loss to myself and my ex-husband, Alan. Neither of us
have been able to purchase a home of our own in the past several years because our
money is naturally still tied up in the parcel of land.
We purchased the land in 1973 with an approved perculation survey, as well as
an approved special upgraded septic system plan put together by John Callahan and
Associated of Andover.
As our permit for the land was running out, I went over to the Board of Health
to have my permit extended. I was told that I could not have it extended which is
contrary to what John Callahan and others have told me since that time. At that
time my husband and I had separated and agreed to sell the land. To date we have
been unable in doing that.
We feel the extension should have been granted, naturally, after all we were
intending on building our home on the land which would have been built by now
if things had worked out for us.
We were told that anouther perc. test was required which we did. It. failed. . . . .
. .even though it had passed with full and proper approval previously . . . and
absolutely nothing has physically changed with regard to the land. This is some-
thing no one has been able to explain ! ! !
My husbands lawyer at the time -- an Atty. LaPiano did not particularly care
for the man who did the second perc test and wanted yet another test. We felt very
put upon at that time -- more money for nothing.
We originally purchased the land from James Champy of Champy Construction
Company of Lawrenceand have contacted him since so that he may hopefully shed
some light on the issue. He feels as we do -- that the land has not changed and
a permit should be granted or extended in good will.
Because of the above issue both Alan and I have lost a considerable amount I
of money to lawyers, land surveys and most importantly to landlords in RENT! !

I personally have had to move three times from rented homes because they have
been sold. I have two daughters in school and its more than aggravating to me
because I've just been told I'll have to move again. I have a chance to buy a house
of my own if I can possibly get my land approved so that I may sell it or obtain a
.loan on it until I do sell it.
At this point I am hoping you can assist me in getting my land settled once
and for all. I do not feel I should have to pay for a third perculation test when the
first one passed ( on which grounds we purchased the land ). We paid a sub-
stantial amount of money for the parcel of land with the towns approval and feel
we have been unjustly treated.
If we have to have another perc test and it fails , more time and money will
be wasted on lawyers in a suit and I just do not want to incur any more expense
or aggravation.
John Callahan, whom. I have hired to assist me in the issue told me he has met
with you so I• thought I would write this letter and hopefully help you to understand
our circumstances more fully.
Anything you can do will be greatly appreciated. If you would care to can
me collect to discuss the matter I certainly would appreciate it. You can call me

Dear Mrs . Savinelli :
I have been asked by Dr. Kay , Chairman of the Board of Health to
respond to your letter. According to our records , the test.ing
done on your property was satisfactory but additional information
was required to determine the extent of the ledge .
In order for you to obtain an approval on the design of a septic
system on this lot , you should contact Mr . Callahan , or any engineer
of your choice , so he might contact this Board to witness a percolation
test and perform the additional excavations required .
The Board ' s new watershed regulations would only apply , in your case ,
to the percolation rate , which should be no problem if it remains
the same as it was in 1973.

Dear Dr. Kay,
John Callahan recommended that I write_ you-this letter explaining a problem
I am having. I certainly hope you are able to clear the issue for me. I
certainly would appreciate it!
In September, 1973, my husband and I bought parcel A on Great Pond Road
North Andover from Atty. James Champy. Atty. Champ.yhad obtained a septic
and soil test permit on the parcel of land before we purchased it. He had
John Callahan draw up a set of septic plans for the parcel which were passed
and approved by the Town of North Andover.
We were still designing our house plans when I called the town rooms to have .
my septic permit continued for an additional year and I was told that another
test would have to be performed, but that there was no problem.
My husband and I separated during this time and have since become divorced.
He had a perc test done in May of 77 which flunked. The inspector was the same
inspector who had performed the original test but the engineer who did the test
thought it was a joke that the land passed initially. Needless to say, the inspector
was extremely red faced and we were left with a seemingly useless piece of land.
I asked my ex-husband to check into the matter. His lawyer , A tty. Lopiano,
wanted another test done because he had no confidence in the reputation of the
engineer who had performed the test and flunked the parcel. In any regard,
my ex-husband felt he was getting the run around and was willing to let the
issue float until North Andover had decided something conclusive concerning
the immediate area our land was in.
Just recently, I have learned that more stringent regulations have been passed
regarding septic and soil tests and that possibly the land will never pass a test.
We had the parcel up for sale during the time of the perc test and was offered
$22, 000 for it. Needless to say, I could not sell the land.
I recently wrote a letter to Atty. Champy and he suggested I contact John
Callahan which I have done. He believes something can be done to rectify the
situation. I have all my money tied up in that piece of land and consequently
have to rent a house to live i..n. I would very much like to sell the land so I
can purchase a house for my family.
I am hoping you can help solve this problem for me. I will be in Massachusetts
August 4 - 14 and would like to have a meeting with you at that time, if nothing
can be cleared up before then.
