The Board of Selectmen is fully supportive of your attempts to enforce the Driveway
Bylaw and will provide whatever protection is necessary in your endeavors to stop the
silting problems caused by the construction of two new homes in the vicinity of 1532
Salem Street.

The Board is in receipt of a letter from Louis G . Rasetta, 1532
Salem Street , complaining about "the continuing run-off of silt, mud
and heavy water flow from a newly-constructed subdivision of homes
abutting my property" . He indicates that he has spoken often with
the builder , Stephen Jones , the Highway Surveyor , and the Building
Inspector about this situation .
Our office has asked Mr . Cyr and Mr . Foster to supply us with
their written comments in time for this evening' s meeting; and we
have referred the matter also to the Planning Board and the
Conservation Commission. It would seem that the matter would fall
under the jurisdiction of the Conservation Commission, and if such
turns out to be the case after Mr . Rasetta makes his plea on Monday
evening, then the Board could refer him to the Conservation
Commission .

Gentlemen:
At Mr. Rasetta's request, I inspected his premises and
the adjacent portion of Salem Street in regard to ground water
carrying silt onto his property. I then spoke to Mr. Steve Jones
and instructed him to place hay bales in the proper location to
slow down or stop the siltation problem. This he has done.
In explanation, Steve Jones has excavated for two steep
driveways entering from Salem Street. There is no subdivision
involved so the Planning Board has no jurisdiction and there are
no regulations in the Building Code to control problems such as
this. The control comes from the authority of the Selectmen who
have jurisdiction over the streets and roads of the town and
through the Highway Surveyor who requires a driveway permit for
any new driveways. If the situation cannot be controlled by your
Board or by Mr. Cyr, it then becomes a private matter between the
two parties.

Re: Salem St . Driveway Violation
Dear Steve :
This is the third Driveway Violation Notice to
be sent to you with no results . I have received no
communications from you , and the situation on the
driveways involved have not improved.
The driveways involved are a public safety
hazard , as well as , drainage and excessive siltation
and dust problems .
This is a FINAL warning. If plans are not pro-
vided to this department and implementation of these
plans , approved and in progress by June 27 , 1985 , we
will proceed to block youraccess to Salem St . and
restore the road shoulders as they were prior to your
construction. This warning is FINAL and no extended
time will be considered.
In the intrim you must remove and refrain from
u ha bales or an other obstructions within the

public way.
You must also clean up all the silt and debris
that has washed down the road and into the abutters
property . This includes cleaning the culvert under
Salem St .
