granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of

A. The particular use proposed for the land or structure:
We are requesting a variance for right side set-back dimensional requirement for the purpose of
constructing a 24'x 26'detached garage.
B. The circumstances relating to...conditions...affecting the property for which the variance is sought
which do not affect generally the zoning district in which the property is located:
We are desirous of building a garage. Our land is triangular shaped. The land to the east of our
house is for our proposed driveway and garage and is dose to the side set-back requirement. It is
also abutting our neighbors driveway. The land to the south of our house is the street which is the
walking route for children from the Atkinson School—there are no sidewalks. The land to the east
of our house is the most suitable for the garage which would get our cars off the street where the
children are walking and parents who have picked up their children are driving.
C. Facts which make up the substantial hardship,financial of otherwise,which results from literal
enforcement of the applicable zoning restrictions...
We are unable to obtain the additional . ntage and 1'side set-back. The garage would be '878

detriment to the public good:
As stated previously–our desire is to build a 24'x 26'detached garage which would benefit our
neighborhood by removing our two cars from the street(Beacon Hill Blvd). In addition–having
our cars off the street improves the safety of many children walking home from the Atkinson School
to the Mass.Ave.area. This same route is also used by parents picking up school children. So,
you have children walking around our cars and parents driving around the children who are walking
around our cars. Since there are no sidewalks on Beacon Hill Blvd it would greatly benefit the
children who walk home from school if they didn't have to walk around our cars into the street.
E. Facts relied upon to support a finding that a relief sought may be given without nullifying or
substantially derogating from the intent or purpose of the zoning bylaw.
It is our understanding that the intent of the side set-back requirement is to provide sufficient
distance between dwellings in the zoning district. There is a line of evergreen trees separating our
property and that of our neighbors Steve&Cheryl Cerretani. If allowed to build our garage the line
of trees would be separating our driveways as their home is to the east of their driveway and our
home is to the west of our proposed driveway and garage.

We are requesting a special permit to construct a 24'x 26'detached garage.
2. The specific site is an appropriate location for such use,structure or condition:
The site is appropriate as it would be beside our neighbors driveway separated by a line of
evergreen trees.
3. There will be no nuisance or serious hazard to vehicles or pedestrians:
Quite the opposite—having a garage built will enable us to have our cars off the street which will
improve safety to pedestrians and vehicles. Beacon Hill Blvd is the walking and driving route for
children coming home from the Atkinson School. There are NO sidewalks; you have children
walking in the street(around our cars)and then you have a line of cars driving around the children
who are walking around our cars. Our home is the last house on the street before turning onto
Mass.Ave.
4. Adequate and appropriate facilities will be provided for the proper operation of the proposed use:
A garage will facilitate off street parking for our cars thereby providing safer walking conditions for
our schoolchildren.
5. The use is in harmony with the purpose and intent of the zoning by-law:
