Monday, June 16 8:49 a.m.: Vandalism was reported at Franklin School on Cypress Terrace. Police filed a report. 1:29 p.m.: A Massachusetts Avenue caller reported an injured cow. Animal Control was notified. 4:12 p.m.: Market Basket on Winthrop Avenue reported a man stole shrimp and took off on a green bike heading towards Lawrence. Local police notified the Lawrence police. 5:5o p.m.: Andover police reported a naked man was walking in the area of Harold Parker State Forest on Middleton Street. McCray, 41, of 156 Waverley Road, North Andover, was arrested and charged with assault and battery on a child with injury Jf r and possession of a Class D substance — subsequent offense. l 1 t Tuesday, June 17 10:23 a.m.: A Berry Pond employee reported a woman told him there was a naked man by the water. Police found no sign of the person. - 3:12 p.m.: A Patton Lane caller reported an ongoing problem with a solicitor selling educational books. She and several of the neighbors didn't like his selling tactics. Police planned to check the area. 6:14 p.m.: A Lincoln Street caller reported an ongoing problem among the neighbors. Police spoke with the caller and the situation was taken care of. Wednesday, June 18 7:03 a.m.: An Equestrian Drive caller reported her neighbor's puggle dog repeatedly has been loose and it charged at her that morning. She was afraid the dog would bite her and upset that it caused her own dog to get out of control. The complaint was forwarded to Animal Control. 7:42 a.m.: A caller reported a line to get into the Shell Station on Osgood Street, which wasn't open like it should be. Police found the building secure and believed the morning shift hadn't shown up to work. 8:17 p.m.: A caller reported a man followed her off the bus all the way to her front door on Chickering Road. Police could not find him in the area. Arrest Samara A. Williams, 35, of 27 Lakeside Blvd., North Reading, was arrested and charged with shoplifting — third offense. Thursday, June 19 3:02 a.m.: Police found a moped at the edge of the woods behind the middle school. They determined it belonged to a Salem Street resident. 6:53 a.m.: A cell phone caller reported several ducks were crossing Turnpike Street and a few didn't make it. The others on the side of the road were going crazy. Police checked the road all the way to the Middleton Line and found nothing. They notified the Middleton police. 11:47 a.m.: Thomson School on Waverley Road reported vandalized sidewalks on the school property. Police filed a report. 8:02 p.m.: A caller reported two women were screaming at each other on Water Street. Police found it was a verbal argument and gave the pair a ride to Sutton Street. 8:29 p.m.: A Beverly Street caller reported a group of youths were lighting off fireworks. Police found three people and spoke to them. 8:54 p.m.: A caller reported he was out for a walk with his daughter on Sunset Rock Road and his neighbor tried to hit him with a car. Police spoke to both parties and resolved the matter. Arrests Mathew Melanson,19, of 120 Edgelawn Ave., Apt. 7, North Andover, was arrested and charged with being a person under 21 in possession of liquor, drinking alcohol from an open container and a motor vehicle lights violation. Jermaine A. Polk, 25, of 33 Francis St., North Andover, was arrested and charged with assisting a person under 21 in the purchase of liquor and drinking alcohol from an open container in a motor vehicle. Friday, June 20 1:11 a.m.: A Webster Woods Lane caller reported two high -school-age kids rang his doorbell and took off, leaving a beer can on his property. They rang his doorbell a second time and ran. Police found nothing suspicious in the area. The girl refused, and the man drove away, but police could not find him. Page 1 of 2 EagleTribunexom, North Andover, MA June 16, 2009 Neighbors recount midnight paintball, pellet gun shooting in North Andover By Bill Kirk NORTH ANDOVER Terry McCray was sitting inside her 156 Waverly Road apartment around midnight Sunday when she heard people -screaming obscenities -in the street and squealing their car tires as they drove back and forth out front. Then she heard "pop -pop -pop," which sounded like gunfire. When she looked out the window, she saw what she thought were rifles pointed at the house. And when she heard a voice say, "Put the gun in the back," she called 911. "I thought one of them was a shotgun," she said. "I didn't know if it was a .22 or a paintball gun." As it turns out, it was a paintball gun, and it was being wielded by one of two youths later arrested by North Andover police, each charged with possession of a dangerous weapon, disorderly conduct and disturbing the peace, police said. Ahmad Hamdi, 18, of 10 Devon Court, North Andover, and Kenny Ferreras, 17, of 98 Autran Ave., North Andover, were arrested at 12:30 a.m. yesterday and are due to be arraigned on the charges today in Lawrence District Court. L The target of their attack; said police, was a 19 -year-old male who lives in one of the three 156 Waverly `Roa d -apartments and who had been at the -same Nashua, N.H., under -21 nightclub as the suspects earlier , - in -di ' he evening. The youths got into an argument over a girl, were thrown out of the club, and then drove ," Eback to North Andover, police said. Hamdi told The Eagle -Tribune that his ex-girlfriend and her friends picked a fight with him and his friends and followed them back to North Andover. He said that later, he was going to another friend's house on Waverly Road and just happened to drive by 156 Waverly. He said when he was driving past, people who were sitting on the porch approached his car in a threatening manner, so he got out his paintball gun to scare them. "I thought they were going to wreck my car," he said. "I had my paintball gun in the car because I go paintballing on Sundays in Dracut. I thought I could scare them off. Plus I had the pellet gun." Page 2 of 2 Chris Nunez, 20, of 154 Waverly Road, just next-door to the McCrays, said his grandfather, who lives on the first floor of the two-family house, heard the "pop -pop -pop" sound and also heard someone say, "Put the gun away." "My grandfather was scared to come outside," said Nunez, who was not frightened and stood on the porch and watched as events unfolded on the street below. He said he heard someone yelling, then saw a girl at 156 Waverly throw something at a gray Mustang. The people in the car then yelled back, jumped into their car and sped off, leaving a trail of tire marks behind them. That's when police pulled them over just the other side of the intersection with Middlesex Street and arrested them at gunpoint. Hamdi was on probation until tomorrow, said his mother, Helima Hamdi, stemming from charges he faced for driving a red Ford Mustang into the Gulf gas station sign on Route 114 in Lawrence in February. Hamdi said he drank a little rum and got into an accident because he was upset that his ex-girlfriend wouldn't leave him alone. Hamdi's mother said her son was doing well "until last night." All persons are considered innocent unless convicted in a court of law. Monday, May 17 12:17 a.m. A person came into the station and reported an unwanted person in her vehicle. An officer reported the person got out of the vehicle and waited for a cab to pick him up. 6:53 a.m. A caller reported a suspicious male in the Bradford Street area. He was a white male, approximately 18 or 19 years old, wearing a gray hooded sweatshirt, blue jeans and red baseball cap. An officer reported being with him at Bradford Street and sent him on his way. 10:34 a.m. The railroad reported trespassers on the tracks at Marblehead and Sutton streets. An officer responded and reported the paerson moved along. The officer advised him not to be on the tracks. 1:03 p.m. An officer reported a motorized boat on Stevens Pond. Another officer responded and spoke with the person. 1:19 p.m. An employee at Market Basket on Winthrop Avenue reported a customer's wallet was taken from a carriage in the parking lot. 1:36 p.m. A caller reported a neighbor digging without a permit on Chestnut Street. Tuesday, May 18 4:3o a.m. An anonymous cell phone caller reported a suspicious truck with two males parked at Bertucci's restaurant on Andover Street. The caller stated the males were inside the building. There was a full shift response. An officer reported the subjects are with Facilitec and are there to clean the pizza ovens. 7:25 a.m. An off duty officer reported a suspicious vehicle pulled in behind his vehicle on Herrick Road and a female appeared to be sleeping. Two officers responded. One of them returned with a female under arrest for operating under the influence of liquor and would file a report. 10:27 a.m. An officer reported finding an identification at Greene Street and Waverley Road. The owner was notified. 11:46 a.m. A possible fight at the high school on Osgood Street was reported. Three officers responded. One of them returned with one juvenile and transported the juvenile to court. 12:43 p.m. A caller reported credit card fraud on Turnpike Street. An officer investigated and would file a report. 2:36 p.m. A caller reported being assaulted on Orchard Hill Road. This has been an ongoing problem since at least 2004, when the Health Department took the first call. ACTION: Susan and Michele spoke with Mr. Morton at the counter. The Building Department is in the process of dealing with this issue. Advised Mr. Morton to get in touch with Gerry Brown at the Building Department. 0 TOWN OF NORTH ANDOVER 120 MAIN STREET NORTH ANDOVER, MASSACHUSETTS 0.1845 RECEIVE MAR 0 9 2006 TOWN OF NORTH ANDOVER HEALTH DEPARTMENT REPORT OF SURVEY BOARD TOWN OF NORTH ANDOVER 158 WAVERLY ROAD A Board of Survey was convened at the request of Building Inspector Gerald Brown under the provisions of 780 CMR 121.0 Unsafe Structures- and in particular 121.4. Failure to remove or make structure safe, survey board, survey report. This survey board consisted of Mr. Robert K. Daigle, P.E., Fire Chief William V. Dolan -Town of North Andover, and Mr. Thomas D. Zahoruiko- 121 Carter Field Road- North Andover — a disinterested person to review the property_, Also .in_attendance-was Mrs. Michelle --Grant- of -the -North Andover -Board of -Health - due to recent complaints from neighbors regarding health concerns with the building. Also in attendance was Deputy Fire Chief William Martineau, who was attending at the request of the fire chief. History The building experienced a significant fire on 23 August 2003. Fire was present on all three. floors with heavy fire to the top floor apartment. Since that time the owner has been contacted regarding the disposition of the building. The owner had claimed that he was going to rebuild. In 2005 a developer had contacted the fire department seeking the owners name with the intention of speaking to him regarding purchase of the property. Nothing apparently came of those discussions. At various times the fire department was contacted concerning unauthorized entry into the building and the fire department in the presents of the North Andover Police Department secured the lower pieces of plywood to deter entry. In December of 2005 Fire Chief Dolan was contacted by a neighbor due to concerns with roof collapse and the status of the existing chimney. The fire chief with the assistance of the State Police air wing at the Lawrence Airport took several pictures of the roof, which had collapsed and the chimney. The chimney is leaning inward and if it should collapse it would fall inward. A week prior to the survey of the property there were high winds in the area and the chimney is still standing although leaning. Since the fire there has been a change in building officials in the Town. No order was ever issued by the previous building inspector or his assistant regarding this building nor was a board of survey done. The fire chief had presented the board of survey option to the past building inspector and Town Manager. Report of the Disinterested Person — Member of the Board of Survey for 158 Waverly Road- Mr. Thomas Zahoruiko from an email sent to Fire Chief Dolan 2/25/06 - Chief Dolan, I just wanted to summarize my observations regarding the 158 Waverly Road property from Friday morning, February 24, 2006. 1 would hate -to -have my -family near this- roe - - -- -- Y Y property. rty. -Itis a disgusting and fitihy place, visibly weak and sagging throughout, and full of hazardous conditions and debris. If any child were to gain access, I can only imagine the possible tragedies which could occur if they fell through the open floors, had a ceiling fall in on them, or could not get back out in an emergency. The floor frame at every level is sagging and full of holes, mold is everywhere, plaster is ready to drop from ceilings, rusted metal and wood with exposed nails to step on or fall into are evident throughout. Stairways are full of debris and dangerous to pass through. The third level is almost completely exposed to the elements, and loose debris and unsecured structure are likely to blow out into the yard and surrounding properties and street in a strong wind. I can't see that there is any part of this property that is salvageable from the extreme state of deterioration and decay. I hope the owner or town is able to quickly resolve the hazard. Zahoruiko 121 Carter Field Road North Andover, MA Report of Fire Chief Dolan — Member of the Board of Survey for 158 Waverly Road The Fire Chief and Deputy Fire Chief met the other persons mentioned above at 10:00 A.M. on the morning of 17 February 2006 at 158 Waverly Rd. The ladder truck was summoned to assist with entry. FF Michael Colbert was the only person on the ladder that day. FF Colbert and Deputy Martineau gained access through the rear door, side C, with the use of a crow bar and haligan tool on the plywood covering the door opening. This door opened to a landing between the first floor and cellar. The consensus of the board of survey was to begin n the cellar and work up floor by floor. There is no fire damage in the cellar but the moisture has caused floor joist to have mold on them and in one case mold was abundantly growing between the studs. This moisture causes no present fire problem but if continued the wood -could -be expected to rot created potential -weak spots in the floors for entering firefighters. There is a 275 -gallon oil tank against the foundation wall beneath the cellar window on the AB side, which appears to have product in it. The fuel gauge was broken and the exact amount could not be determined. The oil tank is rusting due to the moisture in the area. The cellar is cluttered with materials included trash bags full of old trash. Electric wires hang exposed from the ceiling. Presently there is neither heat nor electricity in the structure. There was no fire damage in the cellar as the result of direct flame impingement, smoke or heat. The rear corridor showed signs of heavy fire damage the plaster has detached from the lath. The first floor apartment had heavy fire damage. Doors from the hall to the apartment had burned leaving only the frame of the door. The fire and heat damage continued throughout the first floor with void spaces in the ceiling to the floor joists of the second floor and through the second floor as a result of the fire and from firefighters efforts to seek fire extension during the fire. There was a hole in the middle of the living room crating a void space for fire travel to the second floor. All ceilings in the first floor apartment had no plaster and only the lathe. This condition would allow fire travel upward to the void space between the first and second floor and to the second floor where openings existed. It appeared as though all of the contents of the apartment were still present on the first floor and all contents were damaged by fire, heat and smoke to varying degrees. The front hall from the first floor apartment to the first floor front door and stairway to the second floor was not damaged in any way and the plaster and lathe were intact in this hallway on the first floor. The back hall stairway to the second floor had received_ heavy_ Are damage and -all. of the wainscoting in the stairwell had burned away. Void spaces exist in the walls, which would allow for vertical and horizontal fire travel. Handrails do not exist at the second floor entry foyer level. Second floor ceilings have lost all of the plaster and you can look directly through openings in the ceiling to the sky as there is no roof too much of the third floor. There is extensive fire damage to the was in the second floor, which would allow for vertical and horizontal fire travel. There were no furnishings on the second floor. The front hall at the second floor level had no fire damage. The third floor was mostly open to the outside with no protection from the elements. The chimney in between kitchen and the living room was exposed and the top section was leaning in towards the bathroom in the building. In the kitchen area the roof was totally gone and the wall on the D side (right side from Waverly road) was gone to the floor line. There was moss growing on the floor in the third floor. The back stairwell from the third to the second was heavily damaged and void spaces existed. The fire department considers this building a danger to firefighters in the event of a fire under the present conditions and has placarded the building to indicate this. In its present condition the building has many void spaces, which would allow fire to travel horizontally or vertically unchecked. Holes in the floors create unsafe conditions for walking and present potential entrapment hazards. The building has been exposed to the elements for almost three years and the affects can be seen in a deterioration of the interior or the structure and the rusting of metallic objects. D1535) Dear Chief Dolan: On Friday, February 24, 2006 at 10:00am we conducted a walk through visit of the referenced property to view the extent of fire and water damage to the structure. Said structure is a wood, two family house with a loft apartment on the third floor. The house sits on a rubble foundation. The fire damage is more pronounced on the upper levels where the majority of the roof is either completely missing or severely burned and on the verge of collapse. The brick chimney is listing significantly toward the center of the building. The third floor is burned through at locations. Moving down through the building, the fire damage decreases somewhat but the effects of water entering the building over the past three years has taken its toll. Much rot is evident in the floor framing and walls. 11 The lally columns in the basement are crushing into the underside of the center support beam which is rotting away as seen in the photo. The floor joists are supported off the sides of the center beam with a wood ledger which has started to rot and is pulling away from the beam. Numerous cracks exist in the field stone foundation. Shingles and other construction debris have blown off this building and litter the property. 12 It is my professional opinion based the observations made during this visit that the existing structure is in an extremely distressed condition. Furthermore, the roof structure is an immediate hazard to the abutting homes whereby high winds could pull off sections of the roof and possibly collapse the chimney. There is also the definite possibility that large sections of the roof may collapse as a result of heavy snows. This structure in our professional opinion is not salvageable and should be demolished. Every day this building remains standing creates and increasingly dangerous safety hazard to the abutting residences and passers by. As it is now a fire in the building would spread rapidly exposing the adjacent buildings to fire. Firefighters would not enter to save the building if there is no known or suspected life hazard. To do so would be to risk firefighters lives for a building that is already in serious trouble. I had asked Town Counsel to inform the Town Manager of whether the building inspector had the authority under the building code to act to make the declaration or convene the survey. I do not know the outcome of that inquiry.
