RE: Subsurface Sewage Disposal System Plans for 1615 Osgood Street,Map 34 lot 44 North Andover,
Massachusetts
Dear Mr.Stella,
Due to complications that were discovered during the construction phase of 1615 Osgood Street,the North
Andover Board of Health required the engineer to redesign the septic systems for both sites, #44 and#28. In short,
it was found that the water table was much higher than was fust found in 2002.If this had not been identified,the
proposed septic systems would have been built in the water table,and could have failed prematurely.Hence,
although this change has caused a delay and hardship,in the long nun,it is best for the property owners and the
environment that this high water table condition was found
The response of the installer and engineer,who brought these conditions to light,was highly professional and
ethical.The Health Department has completed the review of the septic system design plans,for the properties,
submitted on your behalf by Bergman&Associates and last revised July 1,2005 and received on July 5,2005.
All other conditions of approval are still in place as was listed in the September 29,2004 approval letter for both
lots.
Your effort to provide a properly functioning septic system for your dwelling is greatly appreciated The Health

Re: 1591 Osgood Street
This memo concerns the proposal to develop the site at 1591 Osgood Street,
North Andover. Health Department personnel have reviewed the plans submitted
to the Planning Board for a special permit and have the following comment.
Please be advised that if the proposal adds any structure to the existing building,
the Health Department will have to assume that there is additional flow to the
septic. If such an addition were proposed the Health Department would then
have to look at the functioning of the subsurface disposal system. If there is no
additions to the existing building than this office has no outstanding issues.

Please be advised that I am in receipt of your letter dated August 14, 2001 requesting a
six-month extension for a variance. I have attached a copy of Chapter 40A: Section 10.
Variances, for your information.
Please note the last paragraph stating: "If the rights authorized by a variance are not
exercised within one year of the date of grant of such variance such rights shall lapse;
provided, however, that the permit granting authority in its discretion and upon written
application by the grantee of such rights may extend the time for exercise of such rights
for a period not to exceed six months;and provided, further,that the application for such
extension is filed with such permitrg anting authority_prior to the expiration of such one
year period's
In order for the Board to grant a one-time six-month extension you would have had to
apply for the extension in writing and then be placed on the August 14, 2001 Zoning
Board of Appeals meeting agenda.

GENERAL LAWS OF MASSACHUSETTS
Chapter 40A: Section 10. Variances.
Section 10. The permit granting authority shall have the power after public hearing for which notice
has been given by publication and posting as provided in section eleven and by mailing to all parties in
interest to grant upon appeal or upon petition with respect to particular land or structures a variance
from the terms of the applicable zoning ordinance or by-law where such permit granting authority j
specifically finds that owing to circumstances relating to the soil conditions, shape, or topography of
such land or structures and especially affecting such land or structures but not affecting generally the
zoning district in which it is located, a literal enforcement of the provisions of the ordinance or by-law
would involve substantial hardship, financial or otherwise, to the petitioner or appellant, and that
desirable relief may be granted without substantial detriment to the public good and without nullifying
or substantially derogating from the intent or purpose of such ordinance or by-law. Except where local i
ordinances or by-laws shall expressly permit variances for use, no variance may authorize a use or
activity not otherwise permitted in the district in which the land or structure is located; provided
however, that such variances properly granted prior to January first, nineteen hundred and seventy-six
but limited in time, may be extended on the same terms and conditions that were in effect for such
variance upon said effective date.
The permit granting authority may impose conditions, safeguards and limitations both of time and of
use, including the continued existence of any particular structures but excluding any condition,
safeguards or limitation based upon the continued ownership of the land or structures to which the
variance pertains by the applicant, petitioner or any owner.
If the rights authorized by a variance are not exercised within one year of the date of grant-of such,'
variance such-rights shall.lapse;provided, however, thatthe permit granting authority in its discretion_
and upon written application by the grantee of such rights may extend.the.time for exercise of such-
rights for a period not-to exceed six months; and provided, further,that the application for such.
-ex'teiision is filed with such-permit granting authority prior to the expiration of such one year period. If
the permit granting authority does not grant such extension within thirty days of the date of
application therefor, and upon the expiration of the original one year period, such rights may be
reestablished only after notice and a new hearing pursuant to the provisions of this section.

Dear Andy,
At the July 11, 2000 Zoning Board of Appeals meeting several issues were
raised relative to the S.P.E.C. petition for premises at 1591 Osgood Street. This
is a request for your input relative to the following issues:

As you may recall the petitioner, Chris Adams of S.P.E.C., was asked to submit a
corrected plan addressing all of the above issues before the ZBA will make a
decision, your input in requested prior to the next ZBA scheduled meeting of
August 8, 2000.

This report is the result of a denial of a building permit for warehousing of the self storage type by Mr.
D. Robert Nicetta the Building Inspector on 2.22.00.and owned by S.P.E.C. Realty Trust at the above noted
site The purpose of this report is to correct some apparent misconceptions by Mr. Nicetta and to present
proper technical backup for certain considerations and to focus on what S.P.E.C.Realty Trust perceives their
rights to be.
SITE HISTORY
The site is currently occupied by a restaurant(Jimmy;s Pizza),a miniature golf course adjacent to and
behind Jimmy's Pizza and vehicular rental parking on the parcel high ground behind the miniature golf course.
The restaurant predates S.P.E.C. Realty Trust(ie prior to 1958),the miniature golf course and the vehicular
rental parking came into existence on or before 1969. S.P.E.C. Realty trust took over all of these uses,
structures and associated rights on March 15, 1985 (See Deed in Figure 1). The zoning by laws in effect at
this time refer to the lot of record being under the zoning by laws and zoning district map as defined by the
zoning plan dated May 12 and June 5, 1972. This plan identifies the land falls into 1-S Industrial District .
This by law in section 4.11(3)general provisions identifies some restrictions that exist relative to the parcel
of land currently owned by S.P.E.C. Realty Trust to quote "when a zoning district boundary divides a lot
of record on June 5, 1972 in one ownership, all the zoning regulations set forth in this zoning by law
applying to the greater part by area of such lot so divided may by special permit be deemed to apply and
govern at and beyond such zoning district boundary but only to an extent not more than one hundred(100)
linear feet in depth(at a right angle to such boundary)into the lesser part by area of such lot so divided".
This same restriction also exists under Section 4.1.1.4 pg 25 of the amended Zoning By Laws dated
May 1999. Thus the zoning restriction prior to 1985 and as they exist today are the same. This limitation has
direct bearing on the setback that will be addressed under setback relief hereinafter included.
Mr.Nicetta has indicated that his denial decisions are based upon the 1999 Zoning By Laws. Clearly

the existing land use has been previously approved as uses in this district and are grand fathered uses in this
1-S district.
PLAN REVIEW NARRATIVE
Figure 2 identifies the reasons noted by the Building Inspector,Mr.Nicetta for denial of the building
permit. The denial was also based upon a set of drawings by P&A dated January 8,2000. These drawings are
herewith made part of this submission because they contain information that may have been overlooked or
misunderstood in developing the denials. The following segments of this report will deal with each item in Mr.
Nicetta's denial and will clarify what relief is sought and the reasons why the relief is sought.
DENIAL B-1
After presentation to zoning board of appeals the planning board will be brought into the overall
permitting process as is required.
DENIAL B-4(1) "The restaurant preexisted zoning. Under the present zoning by laws a restaurant is not
allowed in the I-S district(see summary of uses). If applicant desires to construct a warehouse a special
permit must be obtained to modify the restaurant use as it is not an accessory use to the principal use.
Sheet 6 of the P&A drawing indicates how the existing restaurant structure which is a grand fathered
use is to be integrated into the warehouse planning and does not present a conflict particularly when the
miniature golf course is eliminated. There clearly is no conflict between the major warehouse use and the
integrated minor restaurant use. The relief sought is major and minor grand fathered situations use existing
together in this case.
DENIAL B-4(2)
The topographic plan shows a two story storage unit and office structure. A special permit must
be obtained as it is an accessory use to the primary use(warehouse). We believe this to be an error in that
no office structure is planned for the site. The notation refers to the section of the facility that will get solely
as the management center for only the warehouse complex and is part and parcel of the warehousing complex.
This is the area ofthe warehouse project devoted solely to administering the warehouse itself and would occupy
about 1200 s.f of the front structure. This space is necessary to operate the facility. We would respectfully
note that this structure in the front is for warehouse space and administration space.
DENIAL B-4 (3)
"Special permit for use not listed but similar': Clearly the proposed use is warehousing in the true
sense of the word and is simply warehousing. We believe that no relief is required but will pray upon the
judgement of the Zoning Board of Appeals.

In the I-S district the rear setback is 30 feet plus 15 foot additional for a total of 45 feet." Mr. Nicetta
apparently did not consider that S.P.E.C. Realty Trust land comes under the relief noted previously under
Section 4.1.1.4. Thus S.P.E.C.Realty Trust seeks relief by invoking Section 4.1.1.4 by providing an additional
20 feet buffer of natural un-build upon land as noted in Figure 3. This provides the 45 feet required with only
25 feet of paving and 20'green zone buffer. The relief sought is shown in Figure 3. Unless this variation is
granted the owner due the topography will lose one structure creating a financial hardship.
DENIAL H-4
"Building height. No elevation drawing to verify height". Sheet 2 of the drawings supplied
indicates that the maximum height of the buildings would be between 25 and 30 feet. Attached as Figure 4 is
a schematic view of a typical structure which indicates a maximum building height of 26 feet.
DENIAL J-3
"Sign insufficient information': Sheet 2 of the drawing submitted as noted indicates " 1 free
standing,one entrance corner 32 s.f. max 15'high to conform to zoning by laws. Attached is Figure 5 which
yields greater detail of the proposed sign.
DENIAL K-4 PARKING SECTION ?.1 Paragraph 7
"A parkway space shall mean an area of not less than 9'x18' accessible over unobstructed
driveways not less than 25 feet wide. Note(1). No handicap accessible space have been shown."
This denial does not address the primary problem. The 1999 zoning by laws require one space per 500
s.f. of the warehouse area and the 1972 applicable by laws require one space per 1000 s.f of the warehouse
area. This indicates that the potential applicable by laws require someplace between 48 and 96 spaces. A
recent approval withmg the Town of North Andover on a comparable size warehouse project was scheduled
for 102 spaces as per the current code and was ultimately approved for 8 spaces on June 22, 1999. This latter
criteria is closer to the industry criteria for warehousing of the self storage of 5000 s.f./space. For this project
this would require about 16 spaces. Adding to this the restaurant criteria of 32 spaces indicates that a total
of 42 spaces should be allocated for this site. This is in keeping with previous approved parking spaces and
is presented as the 42 spaces on Sheet 6 of the drawing. In addition Figure 6 identifies the details for
handicapped space which will total 3 in number in between the two warehouse structures and the restaurant.
It should also be noted that the parking spaces are 9'x20'. Clearly this criteria meets criteria established by the
ZBA of North Andover. Thus within the warehouse complex ample pickup parking is available for the
deposition and shipping of stored goods.

Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior
Center, 120R Main St., North Andover, MA., on Tuesday the 11'' day of April, 2000 at
7:30 PM to all parties interested in the appeal of S.P.E.C. Realty Trust (Chris Adams,
Trustee) for premises at: 1591 Osgood Street,North Andover. Petitioner is a Party
Aggrieved of the Building Inspector. Petitioner is requesting a Variance from the
requirements of Section 7, Paragraph 7.3 for a rear setback, and from Section 8,
Supplementary Regulations, Paragraph 7 to allow for parking spaces. Petitioner is
requesting a Special Permit from Section 9, Paragraph 9.1 in order to change a use and
construct one office area and several self-storage type warehousing units.
Said premises affected is property with frontage on the,NorthWest side of 1591 Osgood
Street, within the I-S Zoning District.
Plans are available for review at the office of the Building Dept., 27 Charles Street, North
Andover, MA Monday through Thursday from the hours of 9:00 AM to 1:00 PM.

EROSION CONTROL NOTES
LJ EROSION/SEDIMENT CONTROL DEVICES
The following erosion/sedimentation control devices are planned for this site during the
n construction period. These devices shall be installed as indicated on the plans.
u 1.Silt Fence: Silt fence will be installed along the downgradient edges of disturbed areas
to trap runoff bome sediments until the site is stabilized.
�+ 2.Rip Rap: Rip rap shall be installed in areas where slopes are>2:1 and as shown on the
plans. Rip rap is intended to protect the soil surface from erosion forces of concentrated
runoff,slow the velocity of concentrated runoff while promoting infiltration,and to
stabilize slopes.
n
L1 3.Loam,Seed& Mulch: All disturbed areas,which are not otherwise treated shall
J receive permanent seeding and mulch to stabilize the disturbed areas. The disturbed areas
will be revegetated within 5 days of final grading. Seeding requirements are provided at
n the end of this report.
f'' 4.Construction Entrance: A stabilized construction entrance shall be installed,as shown
on the plans,to reduce the tracking of sediment onto public right-of-way. The placement
F1 of the construction entrance shall be at the major points of construction ingress and egress.
TEMPORARY EROSION/SEDIMENTATION CONTROL MEASURES
1� The following are planned as temporary erosion/sedimentation control measures during
construction of the Development.
1.SILTATION fence shall be installed along the downgradient side of the parking areas and
of all fill sections. The SILTATION fence will remain in place until the site is revegetated.
2.Hay bales will be installed at key locations to supplement the silt fence.
3.Temporary stockpiles of stumps,grubbing,or common excavation will be protected
W as follows:
a)Soil stockpile side slopes shall not exceed 2:1
b)Temporary stockpiles shall not be in areas with slopes over 10 percent,and shall be
located away from drainage swales.
n c)The stockpile shall be stabilized within 15 days by either temporarily seeding the
stockpile with a hydroseed method containing an emulsified mulch tackifier or by covering
u the stockpile with mulch.
n d)If stockpiles must remain in place for more than 60 days,filter fabric shall be used in
place of mulch or temporary vegetation.
e)Any stockpiled topsoil shall be surrounded by siltation fence.
4.A stabilized construction entrance will be installed at the project driveways. The construction
entrance shall consist of an approve 20 feet wide minimum by 50 feet long by 4 inch depth of crushed stone.
During construction,this entrance will be monitored and the crushed stone removed and replaced as it become
n contaminated with mud/dirt/debris from the contractor's operations.
5.All denuded areas which have been rough graded and are not located within the building pad,or parking and
driveway subbase area shall receive mulch within 30 days of initial disturbance of soil or within 15 days after
completing the rough grading operations. In the event that the Contractor completes final grading and installation of
n loam and seed within the time period presented above,installation of mulch and netting,where applicable,would i of

PERMANENT EROSION CONTROL MEASURES
n The following permanent control measures have been designed as part of the ErosioniSedimentation Control Plan:
V1.The storm water runoff from the building and paved areas will discharge into the ground.
2.All areas disturbed during construction,but not subject to other restoration (paving, rip rap,etc.),will be loamed,
n limed,fertilized and seeded. Native topsoil shall be stockpiled and reused for final restoration when it is of
sufficient quality.

3.Earth sloped greater than 2:1 will receive rip rap.
TIMING AND SEQUENCE OF EROSION/SEDIMENTATION CONTROL MEASURES
U The construction period will last approxi,—nately three months. The Contractor will be required to have the least pos ible
area exposed to the elements and will be required to maintain the erosion control elements on a regular maintenan
schedule. The sequence of events anticipated are:

I Install perimeter silt fence and construction entrance.

Demolition of existing structures.

perform out/fill operations,install wall and bring site to sub-grade elevation.
Begin installation of underground utilities,and construction of the building
n Complete fine grading of the paved area, install curb and place base pavement course to stabilize the site.
U Complete construction of the building.
t"1 Begin installation of the landscaping.
V Install surface pavement course and stripe paved area.
n Finish the perimeter landscaping,topsoil all perimeter disturbed areas and install seed and mulch.

Remove silt from behind the silt fences and mix with topsoil for use in topsoiling operations.
When vegetative cover is established on 95%of the site,remove the perimeter silt fence.
Note:All denuded areas not subject to final paving or rip rap will be revegetated. Various items in the sequence ma
U occur concurrently.
In addition to the measures list above,the following work will be performed as required:
Li 1.Remove accumulated sediment from ahead of any silt barriers(as necessary)and dispose off site.
2.Dust and wind erosion shall be controlled throughout the life of the contract. Dust control shall include,but is n
n limited to sprinkling of water on exposed soils and haul roots.

3.If excavation is interrupted by heavy rains,additional mulching or gravel work mate may be required on areas
of exposed soils. Soils which may have become unsuitable for use due to exposure to heavy rains shall be
n removed from the work area and dried or disposed of off site in a manner consistent with this plan.
j I The General Contractor will be required to submit a schedule to the Owner for completion of the work which
4J satisfies the following criteria:
1.The work shall be conducted in phase which will:
a)Revegetate disturbed areas as rapidly as possible,backslopes and fill slopes.
n b)Incorporate planned drainage systems as early as possible into the construction phase.
c)If any site work is not scheduled to be completed by November 1st and construction is planned between Octot er 15
Ll and April 15 of any calendar year,then the General Contractor shall submit a schedule which will satisfy the
following criteria:
n i.Limit the amount of exposed area to work areas intended to be undertaken during the proceeding 30 days.
ii.During the construction process,before final grade is established,all disturbed areas shall be covered with
mulch within 15 days.

iii.Incorporate planned drainage systems as early as possible.
iv.Once final grade has been established,the contractor will temporarily seed the disturbed area prior to placemi nt
n of mulch. The Contractor shall return in the spring of the following year to permanently seed areas which have n
established a sufficient cover.
The schedule will be subject to the approval of the Owner and his authorized representatives.
The Contractor must install any added measures which may be necessary to control erosion/sedimentation from
the site dependent upon the actual site and weather conditions.
The Contractor shall note that no areas shall remain denuded for a period of over 30 days before temporally
I—t stabilized. Temporary stabilization shall be the installation of gravel or mulching.

u PROVISIONS FOR MAINTENANCE OF THE EROSION/SEDIMENTATION CONTROL FEATURES
The project will be contracted by S.P.E.C.REALTY TRUST to a General Contractor. The Contractor will be require I to
designate,by name,a person responsible for implementation of all erosion control measures. Specific
u responsibilities will include:
1.Inspection of the project work site on a weekly basis,and after each rainfall(0.5 inches or more within any
n consecutive 24 hour period)with the installation of added erosion control measures in areas which appear
vulnerable to erosion. The Contractor shall maintain written records of these inspections noting compliance with
Li the plan,any deviations and corrective measures necessary to comply with the erosion control requirements of
this report.
n
2.Inspection of all erosion control measures after any significant rainfall. Accumulated sift/sediment should be
removed from the barriers when the depth of sediment reached 6 inches. A significant rainfall shall be defined as
over 1/2 inch of precipitation in any consecutive 24 hour period.
n COMPLIANCE
1.The erosion and sedimentation control plan will be made part of the bid documents. The Owner will insure
compliance by monitoring the site and withholding payment for items not completed.
