Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening,
November 19, .1984 upon the application of Gertrude Preveneau . for
Daniel Ducker . The hearing was advertised in the North Andover
Citizen on November, 1 and 8, 1984 and all abutters were notified
by regular mail . The following meihbers were present' and voting:
Frank Serio, Jr . , Chairman; William .J_ Sul..livain; Augustine W.
lickerson; and Associate Members Walter F. Soule and Maurice S.
Foulds .
Ti'ie. petitioner seeks a variance from the provisions of Section 7,
Par_agrapz5 7. 1 and 7.2 and Table 2 of..,the, Zoning By ,.Law so as to
permit relief from-the required lot. .area ,and frontage to allow the
division of a parcel of land into two parcels Dn, premises located
at 1u-.18 Bacon Avenue in the R-4 zoning distri :t .
Counsel for the petitioner. testified that the ..xisting dwelling on
Lot B has. been vacant for some time and will b renovated and that
a new dwelling is proposed f_or ,Lot A. Lot B, with the existing
dwelling and. garage , requires only an area v•.riance . - Lot A
requires both an area and a frontage variance. The petitioner has
been taxed for the entire passel with only ',ne dwelling .located on
it . The proposed .lots will be consistent with the lot sizes in
the area. Public sewer is proposed for both lots with an easement
over Lot D, to Lot A.
Ilpon .a motion made by Mr. . Sullivan and seconded by Mr.. Foulds , the
Board votes] four to one, with Member Soule voting in opposition,

of Lot #187 The petitioner seeks to sub-divide the parcel into
two separate lots, Parcel A being -lots 184 and 185 on-the attached -
Plan, and Parcel B being lots 186 & 187 . Petitioner would like
to build a single family residential dwelling on Pargel A.

Every application for action by the Board shall be made on a form
approved by the Board . These forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is mad_e____on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public. or private street or way ,

line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located

SUBJECT: Variance granted to Daniel Ducker, - Bacon Avenue
In November of 1984; the Board granted' a varinca to subdivide a
parcel of land on the corner of Bacon Avenue and.. Mass. Avenue into
two lots with the conditions "that only a single family dwelling
be constructed on Lot A and that both the exist:'.ng dwelling on Lot
B and the proposed dwelling on Lot A be tied iro the municipal
sewer system."
Since additional land owned by the petitioner wE.s not included in
Lot B on the plan, the Building Inspector x .fu:::ed to issue any
building permits . ' .
The plan has been revised to include the additional land as well
as the sewer :ea,sement . The Building Inspector has reviewed the .
plan and informed me that he is satisfied with the revisions.
The applicant has requested that the plan be signed by the Board.
members as soon as possible. I will leave the revised plan as
well as the file on the counter of the Board of Appeals office for
you to come in, and sign it at your earliest convenience .
