Long: The Board of Appeals held a public hearing on"onday evening, De- cember 10, 1984 upon the application of Alvan and Jennie Poutenis. The hearing,was advertised in the North Andover Citizen on November 21 and 29, 1984 and all abutters were notified by regular mail. The following members were present and'vdting:. Frc:lk Serio, Jr., Chair- man; Richard J. Trepanier, Esq.,.Clerk; William J. Sullivan; and Associate Members Walter F. Soule and Mauric^ S. Fould's. The petitioners seek a Special Permit under Sec:,ion 4.122•, Paragraph 14 of the Zoning By Law so as to permit the conversion of a three- family dwelling to a four -family dwelling on premises located at 160-162 Waverly Road in the Residential -4 (R-4) zoning district. Counsel for the petitioners testified that the Board of Appeals granted a Special Permit in August of 1982 to convert the then existing duplex from a two-family dwelling to a three-family unit. At that time, the third unit was made on the first floor. The petitioners reconstructed the parking area on Morris Street to accommodate the third unit and the same parking area can accommodate the proposed fourth unit`. They are now requesting that the second floor be renovated the same as the first floor, resulting in the four -family dwelling. The only exterior change will be the addition of an enclosed staircase. lie further testified that there are other multi -family dwellings in the neighborhood. Ply #8q --- Upon a motion made by Mr Soule and seconded by Mr. Trepanier, the Board voted unanimously to grant the Special Permit as requested: In granting the Special Permit, the Board finds that Section 10.31 of the Zoning By Law has been satisfied. In.pdrticular, the Board finds that the specific site, being a neighborh<)od consisting of multi -family dwellings and scattered small bus i-,esses , is an appro- priate location for such a structure; the use a., developed will not adversely affect the neighborhood, since the neighborhood is an older, established multi -family one,• there will be no nuisance or serious hazard to vehicles or pedestrians, since adequate off-street parking will be provided off Morris Street f:r she added unit; and adequate and appropriate facilities of water an,,: sewer service are available. The Board further finds that the use is in harmony with the general purpose and intent of the Zoning By Law.
