Daniel Long, Town Clerk Western Electric Town Office Building 1600 Osgood Street North Andover, Mass . Petition No. 2- ' 84 Dear Mr . Long: The Board of Appeals held a public hearing on Monday evening, January 30, 1984 upon the application of Western Electric Company. The hearing was advertised in the North Andover Citizen on January 12 and 19, 1984 and all abutters were notified by regular mail. The following members were present and voting:- Frank Serio, Jr . , Chairman;__ Alfred E. Frizelle, Esq. , - Vice Chairman; Richard J. Trepanier,- Esq.-, Clerk; and Associate. Members Walter F. Soule and - Raymond A. Vivenzio, Esq. The petitioner seeks a variance from -the provisions of Section 7 , Paragraph 7 .4 and Table 2 of the Zoning By Law so as to permit the construction of a 125 foot high, guyed steel tower, which will not meet -the height requirements of the Zoning By Law in an Industrial-2 Zoning District, on premises located at 1600 Osgood Street . Testimony from Mr. Anthony Galvagna revealed that the proposed tower will serve as a test site for microwave products . The elevation at . the top of the proposed tower will be 165 feet above high tide and 125 feet above ground level . It will not be in a flight path of the nearby airport. Frizelle and seconded by Mr . Trepanier, the Board voted four to one, with Chairman Serio abstaining, to grant the variance as requested. The Board finds that the conditions set forth in Section 10 .4 of the Zoning By Law have been satisfied. In particular, the Board finds that the proposed tower in the Industrial-2 District will be used for manufacturing and testing of products used on the site. In addition, the proposed tower will not exceed the height of other structures in the area and that it actually replaces an existing tower. The Board further finds that denial of the variance would involve a substantial hardship to the petitioner and would preclude the manu- facturing of a specific product by Western Electric. Said variance, in the opinion -of the Board, may be granted-without substantial detriment to the public good and without nullifying or substantially derogating from the intent and purpose of the Zoning By Law.
