Re: Bus Stop and Parking Lot
Section 10.1 of the North Andover Zoning Bylaw provides that the Bylaw shall be enforced by
the Building Inspector.
Based on my review of the Bus Stop and Parking Lot inquiry I have determined the following:
1. Section 17.1 of the Osgood Smart Growth Overlay District(OSGOD)of the Zoning Bylaw
states in part: "a distinctive and attractive site development program that promotes compact design,
preservation of open space, and a variety of transportation options."
2. Under Section 17.6.2•—Mixed Use Development Zone, 17.6.2.2 As-Of-Right Uses, Provision
13,states"Public Building or use."
3. Under Section 17.6.3—Business Opportunity Zone, 17.6.3.2 As-Of-Right Uses, Provision 9,
states"Public Building or use."
4. Presently the bus stop is allowed for public transportation, located in the Business
Opportunity Zone, and is operated by MVRTA (Merrimack Valley Regional Transit Authority) .
In my opinion the Bus Stop and Parking Lot are allowed uses within the Mixed Use Development
Zone and the Business Opportunity Zone. However, the Bus Stop and Parking Lot are not allowed in the
Residential Mixed Use Zone.
Sincerely,
Gerald Brown
Inspector of Buildings
