The North Andover Conservation Commission has determined that the
activity described below is in violation of the Massachusetts
Wetlands Protection Act. (M.G.L. Ch. 131, Sec. 40) and/or the Town
of North Andover Wetlands Protection Bylaw.
Extent and Type of Activity!.
Discharge of hazardous material into a pond and surrounding bordering vegetated
wetlands (BVW) .
If this violation is not immediately addressed as required below,
an Enforcement Order will be issued, which may include a stop work
order, which may be followed by legal action.

RE: VIOLATION NOTICE (310 CMR 10.00): Discharge of a Hazardous
Material into a Wetland Resource Area
Dear Sir:
On Tuesday, May 2, 1995 at approximately 8:40 a.m. I responded to a request from the
Greater Lawrence Sanitary District (GLSD) to inspect a potential hazardous material
release into a pond and surrounding Bordering Vegetated Wetland (BVW) as defined
under the Massachusetts Wetlands Protection Act 310 CMR 10.55(2).
Upon arriving on-site it was clear that a release of petroleum product had occurred and
that the wetland resource areas referenced above were in fact contaminated. A sheen was
evident throughout the waterbody. Further inspection revealed a direct, point source
discharge of an unknown quantity of product into a catch basin located immediately in
front of your property at 162 Water Street. This basin discharges into a metal corrugated
pipe which discharges into the pond.
I proceeded to contact Chief Dolan of the North Andover Fire Department to coordinate
the emergency response. It was at this time that you exited from your house and stated to
the Chief and myself that approximately 4 - 5 quarts of motor oil had "leaked" from the
tan Mercury Lynx and into the catch basin. As you may recall, you produced the defective
oil filter and showed me where the gasket had dislodged.
It is the opinion of this Department that based on the volume of product in the catch basin
and the overall appearance of this basin,
a histo ryof dumping has likely occurred at this
location. DEP personnel concur. A direct discharge of hazardous material into a wetland
resource area is a violation of 310 CMR 10.00 and the Town of North Andover Wetland
ByLaw. Under the authority of the above referenced regulations I am issuing to you a
Violation Notice documenting the release. This letter and Violation Notice will be

forwarded to the applicable personnel and agencies involved in the mitigation of this
incident.
Dumping any hazardous material is not only irresponsible and negligent but quite frankly
stupid. You not only jeopardize the health of the environment but of your surrounding
community as well. Should future evidence of dumping occur at your property I will be
forced to issue an Enforcement Order mandating a substantial fine and cleanup. DEP will
continue to monitor the pond as will the Conservation Department and should any future
problems occur you will be contacted promptly.
