Attached is a copy of the plan for the holding tank at 1627 Osgood Street.
The original system was designed for 240 gallons per day and according to Mr. Murtha he will be employing
himself, one full time and 2 part time employees. On an employee loading basis he would be required to have
approximately 60 gallons per day of flow. Even if he doubled the size of his practice there would be sufficient
capacity in the existing septic system.

The two attachments to this forwarded email are the floor plans for the building at 1627 Osgood
Street, North Andover.
The revised or proposed floor plan (to be delivered by hand to you tomorrow) obviously is a
modification to the attached existing first floor plan - the second floor is not being modified per se
(other than any changes required to conform to the building code, if any) and will not be for public
access, but for private use only. Thanks.

I understood you to say that $500 of the $3000 rent would be applied to the purchase price, not the
way you phrased it in your email. I guess a face to face meeting really would be best for
communication purposes, but I will be away in New York Monday and Tuesday of next week. I would
prefer to meet at Josephs sometime on Friday or Saturday if possible, as I probably wouldn't be able
to meet with you until next Friday if we can't meet this week. I was asking about being "creative"
because I own a lakefront property in Maine that's for sale - it has no mortgage and my interest in the
property is worth about $100,000 - I was looking for a lease with a purchase option because I had
planned to use the proceeds from the sale of that property as a downpayment on this property, but

with the current RE market it's going to take some time to sell the property. If your ownership group
had interest in such a property and were motivated to sell your property now instead of in the future -
perhaps the property could be used as collateral (essentially a downpayment until it sells) - it may
facilitate a sale of your property at this time, especially if your ownership group were willing to take
money back on the property (a note or second mortgage). Food for thought.

I explained to all involved that I told you the lease would be $3000.00 per month with an additional
$500.00 held towards the purchase of the building.
There are expenses that have to be met for the lease to work. If you can forward your ideas for the
lease and any finance Ideas prior to the meeting we can all have time to review the possibilities.

I can't meet today but can probably meet with you either tomorrow late afternoon/evening or friday
mid-day to afternoon. I've had the chance to crunch some numbers and my upstart costs would be
considerable. I will have to make a very sizable investment in equipment as well as drugs and
supplies for me to get started. Because the location is somewhat remote and not near any real
population centers, I will also have to spend a great deal of money on advertising to households in

area towns to make people aware of where I am. For these reasons, I had planned to
propose graduated rent payments that would escalate to reach the $3,000 you were looking for by
year 3. You had also stated that a portion of my rent would be applied towards the purchase price -
yet I saw nothing to that effect in the lease agreement you forwarded to me yesterday (though I admit
that I did not read the entire agreement once I saw the changes you had made). I am certainly
interested in the property and entertaining further discussions if we are even close to being in the
same ballpark. A purchase price would need to be established at this time and easily executable
purchase options written into the lease coinciding with each annual renewal. Would your ownership
group consider taking money back (a note) and/or any "creative" financing to consumate the sale of
the property? Please respond at your earliest convenience.

Industrial Wastewater
Wastewater from washing animals, equipment, cages and kennels must be properly
managed in accordance with all applicable state and local rules, and must also meet
effluent limits, which can vary from one municipality or sewer district to another.
Wastewater from fluids used to develop x-ray film can contain silver concentrations of
several thousand parts per million (ppm). Any wastewater with silver content of more
than five(5) ppm is classified as hazardous waste and may not be discharged to
sewers. If your facility generates silver-bearing wastewater, MassDEP recommends
that you either install a silver recovery unit and ship spent cartridges to a precious metal
recovery facility, or use a compatible pre-treatment system to reduce the silver
concentration of your x-ray wastewater to two (2) ppm or less, which the state's photo
processors are required to do and is widely recognized as practical and achievable.'

The Massachusetts Department of Environmental Protection (MassDEP)developed this
fact sheet to help animal care and hospital facility operators and employees safely
M a s s a c h u s e t t s manage waste and wastewater, and minimize their operations'environmental impacts.

P R O T E C T I O N
Discarded chemicals, off-specification products, and liquid or solid residues are
regulated as"hazardous waste" if they are: corrosive(pH of less than 2 or 12.5 and
greater), ignitable(flash point of 1400F), reactive with water or acid, or toxic as
determined by a special laboratory test. Veterinary facilities commonly generate several
types of hazardous wastes:
• Spent X-ray film development solutions. These contain silver, which is a listed
hazardous waste. Your facility may install a silver recovery unit and ship spent
cartridges to a precious metal recovery facility.
• Unused medications. Many of these cannot be disposed with other medical waste
or regular trash. They must instead be returned to the places,of purchase through
approved "reverse distribution" programs or managed as hazardous waste. Of the
medications your facility is likely to use most:
✓ Chlorambucil, Cyclophosphamide, Diethylstilbestrol, Melphalan, Mitomycin C,
Nitroglycerine, Paraldehyde, Reserpine, Streptozotocin,Warfarin and Warfarin
Salts are specifically listed or defined as hazardous wastes by state regulation:

✓ Arsenic Trioxide, Epinephrine(excluding Epinephrine Salts), Nicotine and
Nicotine Salts must be managed as"acutely hazardous waste" because they
are extremely toxic or reactive, and therefore are regulated more strictly than
other hazardous wastes.
• Unused cleaners and disinfectants. Many of these chemicals may be classified
as hazardous waste. Check the Material Safety Data Sheet(MSDS)for each
product you use, or see if it contains chemicals listed or defined as hazardous by
state regulation.
• Mercury. The Massachusetts Mercury Management Act of 2006 requires the
collection, management and proper disposal of mercury-containing devices and
materials. Many items—including thermometers, other medical measuring devices,
thermostats and mercury switches—need to be managed accordingly. To learn

Know Your Generator Status& Storage Limits
Any facility that generates hazardous waste needs to register its status with MassDEP,
obtain a site-specific identification (ID) number, store and label wastes appropriately,
and arrange for timely off-site shipment of accumulated wastes.
Refer to the following table. Your generator status determines how much waste you
may accumulate and for how long before shipping it off-site for recycling or disposal.

To maintain your generator status, you may not accumulate a larger volume of waste on
site or store it for longer than allowed.
Register With MassDEP& Obtain a Site-Specific ID Number
• VSQG and/or SQG: Submit a Generator Registration Form to MassDEP.

• VSQG: Self-assign an ID number using the prefix"MV"followed by your ten-digit
telephone number. Enter this number on your Generator Registration form.

(c) the owner of an existing system has obtained a variance from this requirement pursuant
to 310 CMR 15.410 through 15.415.

facilities subject to the following SIC codes may be approved under 310 CMR 15.000. Nothing
