".. a proposed 10'X 20'deck/porch on a non-conforming lot with the condition that it remain a deck only and shall not be enclosed. You have indicated that the decision implies that only a deck can be built, and no roof is allowed, given standard building code definitions. We believe that this interpretation was not the intent of the Zoning Board of Appeals when they granted the appeal. I ask that you please listen to the recording of that evening's hearing(at approx. 11:30pm), and I believe you will hear that it was the intent of the Zoning Board of Appeals to grant the proposed porch as clearly drawn on the construction plan(with roof, columns and ballisters). When the ruling was unanimously approved, you will hear that there was never a mention of the removal of the roof as a condition. Our understanding of the decision that the porch "remain a deck only"was that it would never include a subfloor and finished flooring. I believe the board members' intent was to protect the character of the neighborhood, and not allow the conversion of the porch into heated, permanent living space (as a 4th bedroom for example). Since we have no objection to the placement of this restriction,we had no problem with this condition. Please let us know what steps we need to take to clarify this issue. I will be happy to go back before the Zoning Board of Appeals at their next meeting in February, 2002 to clarify this language, or do whatever else is necessary to move our project along. "...a proposed 10'X 20'decklporch on a non-conforming lot with the condirion that it remain a deck only and shall not be enclosed." When our contractor went to obtain the building permit,Building Inspector Michael McGuire indicated that the decision implies that only a deck can be built, and no roof is allowed, given standard building code definitions. We believe that this interpretation was not the intent of the Zoning Board of Appeals when they granted the appeal. As you know,the audiotape of that evening's heating was garbled, and Mr.McGuire was unable to listen to it. The ruling was unanimously approved as the plans were drawn (with footings,roof, and ballisters),and there was never a mention of the removal of the roof as a condition. Our understanding of the decision that the porch "remain a deck only"was that it would never include a subfloor and finished flooring. I believe the board members' intent was to protect the character of the neighborhood, and not allow the conversion of the porch into heated,permanent living space(as a 4`h bedroom for example). Since we have no objection to the placement of this restriction, we still have no problem agreeing with this condition. Please allow us to go before the Zoning Board of Appeals at the February 12,2002 meeting to request a clarification of the condition imposed. My wife Ann and I have lived in town 11 years, and we purchased 165 Greene Street in May, 1987. As these plans indicate, we seek to remove an aging detached garage and build an attached family suite for my 72 year old mother-in-law, Mary Sheehan. This requires a 9 foot variance from the rear property line and a 2 foot variance from the street. In February, 1996 my father-in-law died suddenly, leaving Mary alone on Cape Cod. In November, 1996, Mary sold her home and moved to a N. Andover apartment to be near Ann and I, Ann being her only daughter. Since her husband's death, Mary has experienced bouts of depression and isolation, and is at our home virtually every day, all day. In addition, she suffers from sciatic nerve damage, which rendered her disabled in 1991 as a result of a work related injury. These hardships are compounded by the fact that Mary is fearful of apartment living, and relies solely on her only daughter, my wife Ann. We love living in town and in our immediate neighborhood, and wish to remain in this home while also providing my mother-in-law with private living quarters. Our in-town location also allows her to walk to church, lib and downtown which racy, nunrrruus her isolation. We have taken great pride in our home. In 1995, we completed a $30,000 full shed dormer addition which added a third bedroom and full bathroom upstairs. In addition, we have made many home improvements to update the property. The proposed addition has been carefully designed to compliment the current home and not encroach on our neighbors properties any further than the existing garage. The exterior and interior of the addition will match the main house in materials and quality of construction. Our neighborhood is made up of predominantly single family owner occupied well maintained homes. We have no intention of ever renting this family suite, and we wish to maintain this home as a single family dwelling with an attached family suite. Our goal is to accommodate my mother-in-law while also preserving the single family character of the neighborhood, and the positive and friendly atmosphere we share with our neighbors.
