Dear Mr. Long :
The North Andover Planning Board held a public hearing on Monday evening, April 22,
1985, in the Town Office Meeting Room upon the application of Joseph and Jennifer Sobel
and Kenneth Daher. _ The hearing was advertised in the North Andover Citizen on April
4 and 11, 1985. The following members were present: Michael P. Roberts, Chairman;
Paul A. Hedstrom, Vice Chairman; Erich W. Nitzsche; John A. James,Jr. , Clerk; and
John J. Burke.
The petitioner seeks a Special Permit under Section 4. 133(d) of the North Andover Zoning
Bylaw, which requires a Special Permit to allow construction to occur 250 feet horizontally
from the annual mean high water mark of Lake Cochichewick. The premises is known as
1689 Great Pond Road, located on the south side of said road. The lot is both situated in
the Residential - 2 and Watershed Zoning Districts. Said lot possesses 51,000 square feet of
land area and 150 feet of street frontage on Great Pond Road.
At the hearing, Attorney Fitzgibbons, the applicants representative presented the proposed
plans.
In accordance with Massachusetts General Laws, Chapter 40A, Section 6, the Special Permit
must be 'issued(prior to the first publication on the change proposed to the zoning ordinance)
so as not to be effected by a change in the zoning ordinancelor bylaw'. Therefore, this
Special Permit was not issued prior to publication and is controlled by the changes enacted
at the 1985 Annual Town Meeting. Thus, the Board of Appeals will acquire jurisdiction on
such lots and will act on Special Permit requests during the moratorium.
The following members were present and voting at the May 20, 1985 meeting when the Board
made their motion on the petition : Michael P. Roberts,Chairman; Paul A. Hedstrom,Vice

SUBJ: Watershed District Special Permits
Based on Town Counsel ' s letter dated May 8, 198j , building permit
and special permit had to be approved by March, 1985, (the date of the
first moratorium legal notice) in order for the Planning Board to
maintain its jurisdiction under Sction 4. 133(d) .
Therefore, the
purpose of this memo is to take the opportunity to
comment on each application, now before the Zoning Board of Appeals .
B. Angus Realty Trust
This plan was reviewed by the Planning Bd. at several public j
meetings. The- new proposal is to remove the existing store
and construct a larger retail complex. Drainage is being
directed away from Lake Cochichewick by regrading the site, in
addition to tying into the new sewer line.
After considerable review and input from o .her departments, we
recommend that the applicant modify the pl..ns by removing that
portion of the building within 350 feet (..f the Lake and
enlarging the building elsewhere. The applicant can
accomodate this change on the plan.
C. & D. Daher & Sobel : Great Pond Rd.
The Planning Bd. approved a common driveway for these two lots
to provide access to Lot #f4 Great Pond Rd. The approval was
based on several conditions listed in the decision 4a copy of
which was forwarded to your Board) . If the applicant strictly
adheres to the Planning Board ' s decision, we recommend that
your board approve the special permit provided the applicant
completes the driveway construction by Septmeber 1 , 1985 .

The history of this parcel dates back :o a June 1984
Preliminary Subdivision Plan disapprovci ':howing 3 lots . A
definitive plan was resubmitted show .ng 2 lots on a
cul-de-sac. We had previously ,advised thecnplicant that due
to the environmental sensitivity of the parcel, one lot would
be the most feasible, thus eliminating the road construction
and crossing of a tributary to the Lake. On June 3, 1985 , the
Planning Bd. accepted the applicant ' s request to withdraw the
subdivision without prejudice.
We would recommend that there be no decision made on this
special permit until the Conservation Commission has reviewed
and provided the necessary input on the impact on both the
wetlands and Lake.
F. Coolidge Construction

The proposed new house and common driveway construction on
lots 2-5 on plan show considerable constru-tion activity on a
7 acre parcel of land located entirely i1 the Watershed
District .
Itis this type of development that should be scrutinized by
the Board of Health ( for both the septic & 7d well proposal)
and the Conservation Commission concer inq he impact on.
wetlands. The driveway, house locations a_ d septic systems
should be staked and we recommend a joint si-e visit to view
the proposed construction impact.
Lastly, the applicant must go before the Planning Board for a
special permit to construct a common driveway.
G. Coolidge Construction: Dal,a Street
Would you kindly provide our office with a plan to review in
order to make the appropriate recommendations .
We would appreciate notification of any forthcoming applications
and plans for construction by special permit in the Watershed
District. We realize that your Board has been inu.tdated with these
requests , and would like to offer any assistance n processing or

Erich W. Nitzsche; and John J. Burke.
The petitioner seeks a Special Permit under Section 2.75 - Driveways, of the
North Andover Zoning Bylaw, which requires a Special Permit for one driveway to
service more than one lot. The premises is known as 1689 Great Pond Road, located
on the south side of said road. The lot is situated in the Residential - 2 and
Watershed Zoning Districts. Said lot possesses 51,000 square feet of land and 150 feet
of frontage on Great Pond Road.
At the hearing, Attorney Joseph Fitzgibbons, the applicants representative presented
the proposedplans and informed the Board of the following :
- The petitioner was previously denied a variance on March 15, 1985 to construct a
single driveway off Great Pond Road within 150 feet of the annual mean high water mark
of Lake Cochichewick. The Board denied the variance dile to the fact that the proposed
driveway can be relocated and thereby eliminate the need to cut vegetation within 150
feet of Lake Cochichewick;the Town's water supply.
- As a result of this decision the applicant would like to use a portion of the Sobel
driveway to gain entry into `Lot 14. This would eliminate any cutting within 150 feet and
only a small portion of cutting within 250 feet. The majority of the driveway within
250 feet has already been constructed some time ago on the Sobel property.
- By using one curb cut, their w71 be one less area of conflict on Great Pond Road.
The Planning Board reminded the applicant that this Common Driveway is subject
to a Special Permit for construction within 250 feet of the Lake.
The follow-inq members were present and voting at the Ma 2A, 1985 meeting wh n the

Upon a MOTION made by Mr. Nitzsche and seconded by Mr. Burke
the Board voted to grant the petition for a Special Permit to allow for a
Common Driveway and approve the PLAN of Land in North Andover for Kenneth Daher
dated January 1985, revised March 1985 and March 14, 1985; BY Stowers Associates,
Inc. , Registered Land Surveyors, Methuen, MA for 1689 Great Pond Road. Subject
to the following :
1. Only the proposed work as shown on the plan entitled PLAN of Land in North Andover
Ma. surveyed for Kenneth Daher, dated January 1985, revised March 1985, and March
14, 1985 is allowed under this permit. Any minor changes meeting the intent of said
plan and determined to have lesser impact on the Watershed must be approved by the
by the Planning Board prior to implementation in the field.
2. Construction shall coincide with the following measures, but shall not be limited to:
a. Prevent the removal of soils from the property;
b. Provide temporary siltation and erosion control in the form of a silt fence and
or staked hay bales; to be monitored and maintained;
li c. Provide permanent siltation control in the form of loam and seed or bark mulch;
d. Prevent the use of fertilizer on the grassed areas;
e. No road salts shall be used on the driveway.
3. The applicant is subject to Section 4. 133(d) of the North Andover Zoning Bylaw
which requires a Special Permit to construct within 250 feet of Lake Cochichewick.
This permit approval is subject to the North Andover Board of Appeals. No construction
shall take place until approval is received.
4. A maintenance agreement running ini:perpetuity with the land shall be submitted to
the Planning Board for review and approval prior to construction and recorded at the
Registry of Deeds (said property deeds shall refer to the agreement and easement) .
5. An as-built plan shall be submitted at the time of completion.
6. No more than these two (2) lots shall commonly share.the proposed driveway.
7. - Construction shall be completed no later than September T, 1985.
8. 1689 and Lot 14 Great Pond Road shall have a driveway easement shown on plan. Said
driveway b
y easement to e incorporated into both deeds in suitable form to be reviewed by
Planning Board and Town Counsel.
In granting thi.s Special Permit, the Planning Board finds, pursuant to Section 10.31 -
Conditions for Approval of Special Permits of the Zoning Bylaw, the the following
conditions are met:

A. 1689 Great Pond Road is the appropriate location to permit a common driveway due to
the fact that not only did the Board of Appeals deny access to Lot 14 from its legal
frontage, but the driveway is constructed, thus minimizing disturbance to land
within 150 feet of the Lake;
B. The use of the common driveway for gaining access to a single family dwelling in the
Watershed District will minimize any impacts in the buffer zone;
C. Their will be no nuisance or serious hazard to vehicles or pedestrians due to the
elimination of a second driveway curbcut;
D. Adequate and appropriate facilities will be provided for the proper operation of the
proposed use (as provided by the maintenance agreement) .
E. Based on site visits, the public hearing process, and review and input by town boards
and departments, the driveway use is considered to be in harmony with the general
purpose and intent of the North Andover Zoning Bylaw. .

Every application for action by the Board shall be made on a form approved
by the Board . These forms shall be furnished by the Clerk upon request .
Any communication purporting to be an application shall be treated as mere
notice of intention to seek relief until such time as it is made on the
official_ application form. All infcrmation called `for' by the form shall
- - -b-e furnished by the applicant in the manner therein prescribed .
Every application shall be submitted with a list of "Parties In Interest"
which list shall include the petitioner , abutters , owners of land directly
opposite on any public or private street or way, and abutters to the
'abutters within three hundred feet ( .300 ' ) of the property line of the
petitioner as they appear on . the most recent , applicable tax list ,
notwithstanding that the land of any such owner is lo.,cated in another city
or town, the Planning Board of the city or town, anC. the Planning Board of
every abutting city or town .
*Every application shall be submitted with an appli2ation charge cost in
the amount of $•25 . 00. In addition, rthe petitioner shall be responsible
for 'any and all costs involved in bringing the petition before the Board .
Such costs shall include mailing and publication, bvt are not necessarily
limited to these .
Every application shall be submitted with a plan of land approved by the
Board. No petition will be brought before the Board unless said plan has
been submitted . Copies of the Board ' s requirements regarding plans are
attached hereto or are available from the Board of Appeals upon request .
