It is not stamped. I spoke with Bill Dufresne at Merrimack engineering on Friday and he was going to contact you in reference to this issue. He said that this plan is not something that they (Merrimack) would stamp, since the height of the building is not within their purview to guarantee. He suggested that the plan be stamped by an architect, but an architect could only certify it in terms of structural integrity, which, upon approval of the building inspector, has already been certified. The responsibility of maintaining the building height depicted in thero osed P p elevation plan ultimately falls on the shoulders of the general contractor. That would be me. I am a licensed construction supervisor and a registered home improvement contractor. I would be happy to include my license and registration numbers on the plan with an assurance that the structure will be buil'C__ to plan. My client would further welcome language in the decision to the effect that, when the frame is inspected, the building official can measure the height, and if the maximum height has been exceeded, the structure will be razed (not lowered, but completely removed) . we (my client and myself) feel that this is reasonable solution to what appears to be a very important issue in the minds of the ZBA. Please page me as soon as possible on Monday so that we may discuss this and perhaps set up an appointment for me to discuss this with the person making the request for the stamped plan. Asou know, I've written to the Board in favor of the building of the garage when it was y g g first brought to my attention. I remain supportive of the continued construction of the garage at its present location regardless of the exact location of lot lines or setbacks. It is not stamped. I spoke with Bill Dufresne at Merrimack engineering on Friday and he was .going to contact you in reference to this issue. He said that this plan is not something that they (Merrimack) would stamp, since the height of the building is not within their purview to guarantee. He suggested that the plan be stamped by an architect, but an architect could only certify it in terms of stnictural integrity, which, upon approval of the building inspector, has already been certified. The responsibility of maintaining the building height depicted in the proposed elevation plan ultimately falls on the shoulders of the general contractor. That would be me. I am a licensed construction supervisor and a registered home improvement contractor. I would be happy to include my license and registration numbers on the plan with an assurance that the structure will be built o plan. My client would further welcome language in the decision to the effect that, when the frame is inspected, the building official can measure the height, and if the maximum height has been exceeded, the structure will be razed (not lowered, but completely removed) . We (my client and myself) feel that this is reasonable solution to what appears to be a very important issue in the minds of the ZBA. Please page me as soon as possible on Monday so that we may discuss this and perhaps set up an appointment for me to discuss this with the person making the request for the stamped plan. It is not stamped. I spoke with sill Dufresne at Merrimack engineering on Friday and he was going to contact you in reference to this issue. He said that this plan is not something that they (Merrimack) would stamp, since the height of the building is not within their purview to guarantee. He suggested that the plan be stamped by an architect, but an architect could only certify it in terms of structural integrity, which, upon approval of the building inspector, has already been certified. The responsibility of maintaining the building height depicted in the proposed elevation plan ultimately falls on the shoulders of the general contractor. That would be me. I am a licensed construction supervisor and a registered home improvement contractor. I would be happy to include my license and registration numbers on the plan with an assurance that the structure will be built o plan. my client would further welcome language in the decision to the effect that, when the frame is inspected, the building official can measure the height, and if the maximum height has been exceeded, the structure will be razed (not lowered, but completely removed) . We (my client and myself) feel that this is reasonable solution to -what appears to be a very important issue in the minds of the ZBA. (s) J.� Special Pe'ILic Reoues: A/I i u I MEMORANDUM Mr. & Mrs. Joseph Pirotta 17 Mablin Avenue North Andover, MA On December 8, 1998 the Zoning Board of Appeals held a hearing on a request by Mr. Pirrotta to seek a variance for the purpose of - p rp constructing a 2 car garage on his property. The Board granted a variance for the construction of the garage with certain restrictions as to the use of the garage. It was discovered by the engineer AFTER the foundation had been put in that the lot which had been represented in the original petition to the Board as 10,000 sq.ft. was in fact only 8,500 sq.ft. The deed in to the Pirrottas when they purchased the lot in the 60's gave an incorrect legal description. Based on this finding, construction of the garage was immediately halted. The garage which had been approved with an 18 foot rear setback etback was now in the ground with a zero ft. set back. The petitioner is seeking a variance from the originally granted 18 foot rear setback to one with a zero ft. set back. Please note that the location of all structures remains the same. All dimensions between structures remains the same. The foundation was back filled by the petitioner so as to eliminate the possibility of anyone falling into the disturbed area around the foundation. The removal of the foundation would cause an undue financial hardship to the petitioner. Mr. Pirrotta explained the history of the dilemma starting with the fact that he received a deed with an incorrect description when he purchased the property back in the 1960's. As you know, I wrote in favor of the building of the garage when it was first brought to my attention. I remain supportive of the continued construction of the garage at its present location regardless of the exact location of lot lines or setbacks.
