notice of intention to seek relief until such time as it is made on the

be furnished by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties In Interest" -
which list shall include the petitioner, abutters, owners'of land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet (300') of the property line of the.
petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of

*Every application shall be submitted with an application charge cost in
the amount of $25.00. In addition, the petitioner shall be responsible
for any and all costs involved in bringing the petition before the Board.

The Board of Appeals held a public hearing on August 12, 1986 upon
the application of Michael Leary requesting a Special Permit from
the requirements of Section 4, Paragraph 4.122(14) of the Zoning
ByLaws so as to permit an addition of two (2) residential units
to t -he existing structure for a total of four (4) units allowing
some exterior structural change and an unenclosed stairway to the
second fl-oor. The -following members were present and voting: Frank
Serio, Jr., Chairman, Alfred Frizelle, Vice-chairman, William Sullivan
and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on July 24
and July 31, 1986 and all abutters were notified by regular mail,.
Motion made by Alfred Frizelle and seconded by William Sullivan to
GRANT this petition as requested with the following conditions;
1 - Construction and paving of ten (10) parking spaces
prior to the issuance of Occupancy Permit
2 - No further construction on building until parking
lot completed.

)elieves that the location is an appropriate location for'such a use as it is at the
.oning boundary district and abuts on all sides but one, commercial and retail zoning dis-
:ricts. The proposed use will enhance the value of the property by upgrading both the interior
and exterior of the building and thus improving the neighborhood. Petitioner asserts that he
ias provided through their offstreet parking plan, a safe and adequate means of handling the
additional vehicles and by providing the offstreet parking, it will alleviate any present and
suture vehicle and parking problems in the area. It is believed by the Petitioner that the
Structure, when completed, will utilize the building in an optimum fashion as was the general
)urpose for the conversion by-law being placed into the Town's zoning by-law. It is also
_elt that the building will act as a buffer between the residential zones and the rapidly
jrowing caimercial and business use which is encroaching on the residential character of the
ieighborhood. The Petitioner is further requesting as necessary, a determination as to
whether the proposed exterior changes amount to a major exterior structural change under
he by-law. If the Board so determines that such is the case, the Petitioner is requesting
:hat a variance be granted to allow for the limited exterior structural changes proposed.
Che Petitioner is asking for a variance of the zoning requirement that any stairway leading
-o a second or higher floor be enclosed, as the Petitioner believes the stairways to the
Second floor to the rear of the building would be safer and more aesthetically pleasing if
Left open and connecting to an open deck on the roof of the building. The Petitioner asserts
hat due to the size and shape of his lot and the architectural design for his particular
Structure, a literal interpretation of the zoning by-law would create a substantial financial
iardship to the Petitioner and would adversely impact the neighborhood and the Petitioner
in the final design and not be aesthetically reasonable for the area. The Petitioner asserts
=urther that this relief could be granted by the Board without constituting any substantial
letrimenent to the public good and would not derrogate or negate from the general intent
ind purpose of the zoning by-law.
