Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening ,
September 19 , -1983 upon the application of Leonard Gustus . The
hearing was advertised in the North Andover Citizen on August 25
and September 1 , 1983 and all abutters were notified by mail .
The following members were present and voting : Frank Serio , Jr . ,
Chairman ; Alfred E . Frizelle , . Esq . , Vice Chairman ;_ Richard J .
Trepanier , Esq . , Clerk ; and Associate ��embers Walter F . Soule
and- Maurice --S . - Foulds .
The - petitioner seeks -a variance from the provisions - of Section -6 ,
Paragraph 6 . 5 of the - Zoning By - Law so as to permit the erection
of .a lighted -sign on premises located at - 1705 Turnpike Street .
The petitioner testified that he is seeking a variance to erect
a lighted sign for his business known - as _-"The _-Farmer 's Market'-' .
Because there is an existing sign on the premises for another
business establishment , the variance is necessary .
He further testified that the sign is necessary for recognition
since his store is not easily seen from the road .
The Board voted unanimously to take the petition under advisement .
On October -17 , - 1983 the Board rendered- its decision , with- Members
Serio , Frizelle , Trepanier , and Associate Iliembers Soule and Foulds
again present and voting .

Upon a motion made by Mr . Foulds and seconded by Mr . Frizelle ,
the Board voted unanimously to grant the variance , subject to
the condition that the sign be limited to 3 ' x 5 ' and that it
be lit from within in line with the light poles and on his own
property and not to extend over the property line .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . Specifically , the Board finds that a literal enforce-
ment of the Zoning By Law would create a hardship to the petitioner .
Said variance may be granted without substantial detriment to the
public good and without nullifying or substantially derogating
from= the intent and purpose of the Zoning By Law .

The principal points upon which I base my application are as follows :

Due to the high speeds at which most autos pass this location, it would
be beneficial to my business and convenient for possible ?patrons if
they knew as a Market on the premises, in addition to the gas station,

as quickly as possible in their approach.
If it is. relevant to your decision, may I say that many patrons
- ��Kave advised me that they were unwware that there is a stDre on the
premises despite travelling by, the location regularly. It is a recog-

Sec . 1 APPLICATION FORM _,..
Every application for action by the Board shall be made on a form
F approved by the Board . -These . shall be furnished by the cler
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is . made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or town , and
the Planning Board of every abutting city or town .

in the amount of $25 . 00 . In addition , the petitioner shall be respon -
