Prime Energy, 1725 Turnpike Street (Rte. 114), North Andover, Massachusetts in noncompliance with one or more laws, regulations, orders, licenses, permits, or approvals enforced by the Department. Enclosed is a Notice of Noncompliance which describes (1) the activity referred to above, (2) the requirements violated, (3) the action the Department now wants you to take, and (4) the deadline for taking such action. An administrative penalty may be assessed for every day from now on that you are in noncompliance with the requirements described in this Notice of Noncompliance. Prime Energy LOCATION WHERE NONCOMPLIANCE OCCURRED OR WAS OBSERVED: 1725 Turnpike Street (Rte. 114), North Andover, Massachusetts DATE WHEN NONCOMPLIANCE WAS OBSERVED: June 4, 1999 DESCRIPTION OF NONCOMPLIANCE AND OF THE REQUIREMENTS NOT COMPLIED WITH: Personnel from the Department conducted a compliance inspection at A. L. Prime Energy. The following are the observed violations: AIR QUALITY (1) 310 CMR 7.24(6)(f): On the date of the inspection, Stage II recordkeeping requirements were not being met. The regulation requires ... Any person who owns, leases, operates or controls a facility subject to 310 CMR 7.24(6)(a) shall maintain records sufficient to demonstrate compliance. Records kept to demonstrate compliance shall be kept on site for at least five years, except that records of testing results under 310 CMR 7.24(6)(8) and (i) shall be kept permanently on site. All records shall be made available to representatives of the Department or EPA upon request. Such records shall include, but are not limited to: 1. a continuous record of all failures of the vapor collection and control system, including the type of failure, malfunction, the date the failure was first observed and the date of repair; 2. records of all maintenance performed, including the type of maintenance and the date the maintenance was performed; 3. records of the daily and monthly thoughputs of motor vehicle fuel; 4. the results of and dates of any testing performed under 310 CMR 7.24(6)(g) or (i), and the identity of the person who performed such tests; 5. certification that facility operators and employees have received training in accordance with 310 CMR 7.24(6)(c)3.; 6. any and all permits, orders or licenses to operate issued for the facility by the Department; 7. a chronological file of any inspection reports or other compliance documents issued for the facility by the Department; 8. any other requirements specified by the Department in any approval(s) or order(s) issued to the person. Prime Energy did not notify and inform the Department prior to the installation of the vapor collection and control system for its gasoline dispensing facility on a form obtained from the Department, of the dates of installation and the specific type of vapor collection and control system to be installed. (3) 310 CMR 7.24 (6)(c)5: A. L. Prime Energy failed to install signs on the dispensers to show how to properly use the vapor recovery system. The regulation requires... that any person who owns, leases, operates or controls a motor vehicle fuel dispensing facility shall conspicuously post operating instructions for dispensing motor vehicle fuel using the vapor collection and control system in the motor vehicle fuel dispensing area. ACTION TO BE TAKEN, AND THE DEADLINE FOR TAKING SUCH ACTION: AIR QUALITY (1) Immediately upon receipt of this Notice, A. L. Prime Energy must maintain and keep the necessary records at the facility as required in Air Quality violation number 1. Within thirty (30) days of your receipt of this Notice, this office must be in receipt of written confirmation that this has been done, and will continue to be done. (2) Within thirty (30) days of your receipt of this Notice, please complete the Stage II Facility Installation and Compliance Form, and return it to the Department of Environmental Protection, Division of Air Quality Control, Stage II Program, One Winter Street, 9' Floor, Boston, MA 02108. (3) Immediately upon receipt of this Notice, A. L. Prime Energy must conspicuously post the necessary signs and instructions to maintain compliance with the above referenced regulation in Air Quality violation number 3. Prime Energy, Inc., 3198 Salem St., Wakefield, MA for premises at: 1725 Turnpike St., North Andover, requesting a Variance from (Section 6, Signage, P 6. 1, 6.6 A&D and (Section 7, Dimensional Requirements, P 7.1 lot size & 7.3 setbacks) and (Section 8, Supplemental Regulations, P 8.2 Auto Service Station) in order to remove existing motor fuel facility to make it similar and competitive with other businesses located elsewhere in town and along Rte. #114. And for a Special Permit from the requirements of Section 9, P 9.2 to altar existing non -conforming building and add canopy over gas islands and for allowance of 2"' sign within the G-8 Zoning District. The following members were present: William J. Sullivan, Walter F. Soule, Robert Ford, John Pallone & Scott Karpinski. The hearing was advertised in the Lawrence Tribune on 5i25i99 & 6!1!99 and all abutters were notified by regular mail. No persons appeared in cpposition to the petition. Upon a motion made by Robert Ford and 2' by John Pallcne, the Board agreed that signage should be in full compliance with Section 6 of the Zoning Bylaw, on the condition according to the revised Plan submitted by Anthony Guba, P. E., Registered Engineer, #32727, dated: April 22, 1999, as per revised drawings: C1, C2, 2 & 3 the Board voted to GRANT a Variance from the requirements of Section 7, P 7.1 & 7.3, & 7.8 relative to the following: To allow relief of a setback of 100' from Rte. #114, the lot is only 90 feet deep at deepest point; the proposed canopy is only 14' 6" from front property line. To allow relief of a setback of 25' plus 15 additional for abutting residential zone from rear line, both the existing building and proposed canopy do not meet these setbacks. To allow for a 15' buffer along property line abutting a residential zone. To allow a 50' setback from residence district, and limit driveways to 30' wide which is not met as existing driveways exceed this, one being 73' and the other being 50'.
