The 'petitionerseeks•.a Special Permit under Section.8..3 of the
North Andover Zoning Bylaw.'' The•purpose of the Site Plan Review is to
review the :proposal to 'construct _a 1,71.9 sq.ft. addition to an existing
buildingr''for . off4ice/re:tail onoland containing 49,400 sq. ft. on the north
side of Route 114 in a:-VillageResidential (VR) Zoning District.
Erich Nitzsche-read the legal notice to open the public
hearing. Letters were~received and read from the State D.P.W. and the
applicant. a

Scott Stocking,FTown�Planner, stated that the Board of Appeals
has granted a special permitgfor'the. continuing of a non-conforming use
and a variance of 100' ee•tback regulation on Route 114.
The applicant, in his letter,, has asked for a continuance of the
Public hearing until September 22ad.: A motion was#made ,by George Perna
to continue the public hearing untii September 22,.`1988. The motion was
seconded by Michael Leary and the Board voted unanimously --to,cont. nue

the public hearing.
0'n September 22, 1988 the Planning Board held a meeting. The"
.following members were present: Paul Hedstrom, Chairman; George Perna,
;Vice -Chairman; John Simons; Clerk; Erich Nitzsche and Michael. Leary.
Bill Aalerud was present and.gave the Board a description of
:what was being proposed. The addition is approximately 1,700 sq.ft. for
office, retail and storage. The site is 1740 Turnpike Street, Girl
Scout.Spar and Spindle Council.
Following a brief discussion between Erich Nitzsche and the
applicant on the mitigation of run-off and the Town Planner, Scott
Stocking, on acceleration and deceleration lanes, George Perna made a
motion., -to close the public hearing and take the matter under
advisement. John Simons seconded the motion. Erich Nitzsche wanted
details.`on the leach pits. The Board voted unanimously to close the
public,'hearing.
One October 6, 1988 the Planning Baord held•a meeting. The
following members were present: Paul Hedstrom, Chairman; George Perna,
Vice-Chairman.and Erich Nitzsche. John Simons arrived at 8:30 p.m..
Michael Leray arrived at 9:23 p.m.
A motion was made by John Simons to approve the site plan based
on the written decision. The motion was seconded by Erich Nitzsche and
the Board voted unanimously to approve the site plan.

114 as called for in the Board of Appeals decision, the
applicant shall eytend the shrubs to each side of the
parking arca .and surround on two sides, the fence which,
screeneddump5ter.
5. Adequate radius shall be provided for the driveway access to
Route 114 in accordance, with DPW standards.
6. The applicant shall provide leaching pits for the roof drains.
This notation shall be placed upon the plan.
7. The Board of Appeals decision shall be filed with the Registry
of Deeds Office.
8. The Board finds that the Site Plan submitted adheres to the
conditions placed upon this project by the Board of Appeals, and
the Board has added these conditions to further the purposes and
intents of the 2o.ning.Bylaw in keeping with the Board of Appeals
action.
The following plans shall be deemed a part of this decision:
.Plan prepared by Robert D. Morris, entitled "Drawn for Spar 7 Spindle
Girl Council", dated May.22, 1988, revised June 30, 1988 and September
19, 1988.

The P.lanni.ng Board makes .the following findings regarding thi--
Permit as required by Section 10.31. of the coning Bylaw: OCT
1. The proposed use and site deisgn for this lot are appropriate
due to its location in Town.
.2. Adequate vehicular and pedestrian access into and surrounding
the site has been provided.
3. The landscaping plan as shown meets the requirements of Section
8.4 of the Zoning Bylaw.
4. The site drainage system is designed in accordance with Town
13ylaw requirements.
5. The applicant has met the regUi.rPments of the Town for Site Plan.
Re.vi-ew as stated in Section 8.3 of .the '_'_oning Bylaw.
b.. Adequate -and appropriate facilities will be provided for the
proper operation of the proposed use.
The Planning Board finds under Section 8.35 of the Zoning'Bylaw that the
propose `
d site plan•generally.,romplies with Town Bylaw requirements but
requires mirror. cond-i.ti:ons in`order to be completely in compliance with
Town°.Bylaws:
Upon'reachng the above findings, the Planning Board approves this
Special Permit based upon. the following conditions which shall. be
submitted to..the Board prior to signing the documents to be filed with
the.Registry of Ueeds'.Office:
1. Al.l signage included in the proposed development shall conform
to the requirements of.the.Zoning'Byl.aw.
2. Show three (3) handicapped spaces adjacent to the structure.
Handicapped spaces shall be properly marked in conformance with
architectural barrier standards,
3. All.lighting shall be directed onto the site and no lighting
shall be cast onto any adjacent property.
4. Landscaping plan as submitted indicates where new trees will be
planted as called for in Section 8.4 of the Zoning Bylaw.
a. The applicant shall provide fourteen (14) trees. ,Each tree
shall be a minimum of 3 1/2" DOH at least 4 feet:1thigh at the
time of planting. These trees shall be placed adjacent to
the parking areas which front Route 114.
b. Additional planting shall be -provided in the corner island
next to the parking spaces in the 113 car lot, in the form of
trees and shrubs.
