Petition #8-89 365 Woburn St. * Wilmington, MA 01887 * DECISION * The Board of Appeals held a public hearing on Tuesday evening, August 9, 1988 upon the application of Aalerud Co., Spar & Spindle Girl Scout Council, Inc. requesting a variation from the requirements of Section 7, Paragraph 7.3 and Table 2 and a Special Permit of Section 9, Paragraph 9.2 of the Zoning ByLaws so as to permit relief of frontage setback, rear setback and continuance of non -conforming structure and use on the premises located at 1740 Turmpike St. (Route 114). The following members were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on July 21 and July 28, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board voted, unanimously, to GRANT the Variance and Special Permit as requested, subject to the following conditions: 1., The parking lot be screened from Route 114 with trees & shrubs. The shrubs shall be placed to grow as a solid screen at least 3' high. 2• The existing curb cut be approved in accordance with the requirements of the State DPW. 3., The location of the wetlands along the rear of the property be placed on the plans. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 and 10.4 of the Zoning ByLaws and the granting of this variance and Special Permit will not derogate from the intent and purpose of the Zoning Bylaws. Stocking. �1-11ianner DATE: June 1, 1988 RE: Setback Variance/Special Permit 1740 Turnpike Street 120 Main Street North Andover, Massachusetts O 1845 (617) 685-4775 Staff has met with the applicant and I have the following comments: (1) After discussing the application with Joe DiAngelo of the State DPW, he expressed the following: �(a) Lack of adequate right of way at this location, 50' shown, 80' needed. (b) Difficulty in designing a deceleration lane for north bound traffic due to the location of the parking lot to the right of way. (2) v Have the applicant explain why the addition must be 7' closer to the roadway than the original structure. The addition should be able to be accommodated within the 30' and 93' setback lines. A clear hardship should be indicated as to why he cannot adhere to the 30' rear setback and keep the front of the building 93' from the Route 114 right of way. (3) The parking lot shall meet the requirements of Section 8,4 of the zoning bylaw regarding landscaping in the parking lot. (4) The Board should follow the requirements contained in Section 9.2 regarding the alterations of a non -conforming use.. Be advised that the proposed addition exceeds the limit of 25% increase in area requirement.
