Sullivan, Conservation Administrator RE: 177 Great Pond Road, North Andover 120 Main Street North Andover, Massachusetts 01845 (617) 685-4775 On June 16, 1987 the North Andover Conservation Commission considered a Determination of Applicability for the construction of an addition to an existing dwelling located within 100 feet horizontally of a tributary to Lake Cochichewick. This application is allowed under 4.133 4b of the Lake Cochichewick Preservation Amendment, however a variance would have to be obtained from the Zoning Board of Appeals as required by 4.133 d. The applicant is aware of this responsibility. The Conservation Commission in response to the Request to. Determination issued a negative determination with stipulations, those being the placement of hay bales and siltation fencing. The following members were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, Anna O'Connor and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on July 23 and July 30, 1987 and all abutters were notified by regular mail. Attorney J. Hyde represented the petitioner and a lenghly discussion was held on this petition. Upon a motion made by Mr. Vivenzio and seconded by Ms. O'Connor, th Board voted to GRANT the variance as requested. Vote was unanimous. Mr. Sullivan had sat on the original hearing, but he was absent from this meeting. The Board finds that the petitioner has Paragraph 10.4 of the Zoning ByLaws and derogate from the intent and purpose of affect the neighborhood. Nels ireTor of Planning & Community Development Date: August 11, 1987 Re: Meeting of Board of Appeals - August 11, 1987 Agenda I would like to make your.board aware of the following issues concerning a few of the items on your agenda: Sullivan/Variance - The applicant is subject to Site Plan Review for this project if the number of parking spaces required are five or more. Consult Section 8.3 of the North Andover Zoning Bylaw. DiGaetano/Variance - In order to evaluate the environmental impacts of this variance request I would like to see additional information placed on the plan. topography, proposed grading plan and existing grade [slope]. soils type and condition. construction schedule. post bond to ensure that erosion/sedimentation does not occur. Lastly, why can't the applicant construct the addition on the other side of the dwelling to minimize adverse environmental impacts to the brook. I would also appreciate the board circulating these types of plans to the professional staff to review in assist in the decision making process. Slipp/Variance - As noted above, information is lacking on the plan and based on petition to the Planning Board previously I do not read any compelling reason for the peition to be granted. McPhee/Variance & Special Permit - This peition is subject to Site Plan Review of the North Andover Zoning Bylaw and must seek a Special Permit from the Planning Board if the use will require five or more parking spaces. Scanlon/Variance - If the petitioner is seeking to add a 'family suite' it is in fact a second dwelling since family suites are not noted in the Residential 4 zoning district. It should be more appropriately considered as an additional unit. Spicer/Special Permit - In reviewing this petition take into consideration Article 24 that was an amendment to Section 4.122[14].
